Presidential candidate of the Peoples Democratic Party in the February 23 election, Atiku Abubakar has formally filed an appeal against the judgement of the presidential election petitions tribunal at the Supreme Court.

The appellants want the apex court to hold that the tribunal erred in its decision to dismiss its petition against the election of President Muhammadu Buhari.

Atiku and his party filed the appeal on five grounds.

They alleged that the panel of the presidential election tribunal erred in law “when they relied on “overall interest of justice” to hold that the second Respondent’s (President Muhammadu Buhari) exhibits R1 to R26, P85, and P86 were properly admitted in evidence.”



They also alleged amongst other reasons that the tribunal erred in law “when they held thus: “My firm view is that Section 76 of the Electoral Act is clearly inapplicable to the issues under consideration.

“The form referred to are the form to be used in the conduct of the election as FORM CF001 had been taken care of in Section 31 of the Electoral Act and the said FORM CF001 is tied to the steps laid down in the said Section 31 of the Electoral Act.

“More importantly, the law is firmly settled that a candidate is not required by the Constitution or the Electoral Act to attach his certificates to FORM CF001 before the candidate can be considered or adjudged to have the requisite educational qualifications to contest the election.”

They also alleged that the tribunal erred in law when they held thus: “There was/is no pleadings in the Petition to the effect that 2nd Respondents failure to attach his certificates to Form CF001 amounts to lack of educational qualification to contest the election.


“In other words, the issue of failure to attach certificates which have been flogged throughout the length and breadth of the Petitioners Address (es) in Reply to 1st, 2nd and 3rd Respondents final written address is not the case of the Petitioner in the pleadings. No issue was joined on nonproduction of certificates or failure to attach them as an infraction of section 131, 137 and 138 of the Constitution of Federal Republic of Nigeria, 1999 as amended.

“All submission about the failure to produce certificates or attach same to CF001 is hereby discountenanced. Even if it can be said that the submissions made are in tandem with the Petitioners Pleadings on issues 1 and 2 the fact remains that none of the facts pleaded were proved or established as required by law.”

The Minister of Transportation, Mr Rotimi Amaechi, says 10 more coaches will be provided by November to address the upsurge of passengers at railway stations across the country.

Amaechi told News Agency of Nigeria (NAN) on Tuesday that the additional coaches would solve the problem of high demand for the services.



He said: ”We delivered Abuja-Kaduna, but the pressure is now high with the influx of passengers. We started with about 300 passengers, now we are doing 2,500 passengers, nearly twenty times the number.

“We placed order for some more coaches because the problem is not e-ticketing as they say, but the demand has by far outweighed the supply. By November we should be able to launch 10 more coaches to help address this challenge.”

The Minister explained that by November, two sets of Diesel Multiple Units (DMU) made up of motor car and coaches of various classes would be made available for the rail stations.

He expressed optimism that the coaches would assist in addressing the passenger surge at Abuja-Kaduna and Itakpe-Warri rail stations.

Meanwhile, the Managing Director, Nigerian Railway Corporation, (NRC) Mr Fidet Okhiria, said the DMU’s would be deployed to Lagos-Ibadan and Abuja-Kaduna routes.



Okhiria explained that by the time the other 32 coaches and the locomotives arrived, there would be additional round trips on the various stations.

”We are targeting 16 round trips on Abuja-Kaduna and at the same time Lagos-Ibadan and four round trips on Itakpe-Warri every day.

Commenting on the progress of the Lagos-Ibadan rail project, Okhiria commended the Minister of Transportation for ensuring steady and diligent supervision of the project.

He said: “It’s a good thing to come out ones every month to see the level of work they have done.

“I think our major issue now is to see how we can get to Apapa port, because without the track getting to Apapa port the idea of making this rail has not been achieved.



“As you can see, it is quiet pleasurable to travel by train, we used the narrow gauge within Apapa to Iju after which we used the standard gauge and we are very close to Ibadan.

“I think it is good to always do it like this, inspect it, since the tracks have been done, because if we don’t, people may come and start vandalising it.

“It is a good thing, they have made progress and we hope by November when the coaches come, nothing will stop us from running train till we get to Apapa.”

Similarly, Malam Ibrahim Alhassan, Chairman NRC, commended the work done so far by the Chinese contractors.

“For the first time, we were able to go into the Apapa wharf by train and it is all in the effort to show that whatever encumbrances there are, we will deal with them.

“This is to ensure that the target date of commissioning of this project which is January 2020 is realised.

“As we can see from Iju to Ibadan we have the tracks. In some areas the formation work has been done. We are relocating some of the narrow gauge to another place to give way for the new standard gauge.

“So generally, we are making progress but we are not very impressed with the pace of the work.”

An accident involving a trailer and a bus belonging to the Benue State Government popularly known as Benue Links has claimed the life of at least 13 people and injuring several other persons.

An eyewitness told News9naija that the accident occurred at about 4:30 pm today along Akwanga-Lafia road in a village called Angwan chiyawa, in Nasarawa Eggon local government area of the state.

The accident was caused by break failure of the traile.

The spokesman of the Federal Road Safety Commission (FRSC) in the state, Deputy Route Commander Johnson Martins, confirmed the accident, adding that rescue operation has since commenced.

The dead bodies and injured victims were taken to the General Hospital Nasarawa Eggon, by men of the FRSC.

The All Progressives Congress (APC) in Benue state has raised the alarm that the National/State Assemblies election petitions tribunal is frustrating her members in respect of whose petitions judgment have been delivered by the honourable tribunal from proceeding on appeal against the judgements.

Addressing a press conference in Makurdi , the Youth wing of APC led by Tersoo Kulas said the tribunal led by Hon. Justice R O Odugu with Hon. Justice M A Onyetenu and Hon. Justice Esther Tata as members, contrary to the the provisions of the 1999 constitution of the Federal Republic of Nigeria (as amended) that copies of judgement(s) be given to parties within 24hrs from the time it was delivered has withheld the judgements it delivered against the APC for 4 days (96hrs) as at today (Thursday, 12th September, 2019).

“Let it be known that according to the provisions of the constitution, our party has a legal window of only 14 days to prepare, file and serve the notices of appeal to the respondents.

“But with this development, the Justices have already unwittingly delayed us, eating 4 days out of our 14 days.



“We are at cross road and are tempted to say that this may be a way to frustrate the proper filing of the notices of appeal and pursue of the appeals, owing to the fact that the appeal itself from the time of delivery of judgement by the tribunal; the filing of he notice of appeal; the compilation of the records of appeal; the filing of briefs and the hearing of the appeals and then, the delivery of judgement of the appeal court has to be done within 60 days and no more.

“We are particularly worried over the case of the Kwande/Ushongo federal constituency, between Benjamin Wayo (APC) and Robert A. Tyough (PDP); Katsina-Ala/Ukum/Logo federal constituency between Solomon Wombo (APC) and Richard Gbande (PDP) and John Ali (APC) and Enemere (PDP), judgements all delivered on Monday, 9th September 2019 and those of Makurdi/Guma federal constituency between Terhile Utaan (APC) and Benjamin Mzondu (PDP) and Benue North West senatorial district, between George Akume (APC) and Emmanuel O. Jev (PDP)”.

The party also said if the judgements are not released tomorrow, Friday, 13th September, 2019, it will have no other option than to petition the president of the Court of Appeal and the chairman of the National Judicial Council (NJC) to address such injustice.

Attempt to speak with the secretary of the tribunal failed as he said he will first seek the permission of the chairman of the tribunal .

The President of South Africa, Cyril Ramaphosa has sent out special envoys to deliver messages of solidarity to several Heads of State and Governments across Africa.



The team, comprising former minister in the presidency, Mr Jeff Radebe, Ambassador Kingsley Mmabolo and Dr. Khulu Mbatha, will visit Nigeria, Niger, Ghana, Senegal, Tanzania, the Democratic Republic of Congo and Zambia.

News9naija reports that the Special Envoys will deliver a message from President Ramaphosa regarding the incidents of violence that recently erupted in some parts of South Africa, which resulted in attacks on foreign nationals and destruction of their properties.

They are also expected to reassure fellow African countries that South Africa is committed to the ideals of pan-African unity and to the rule of law.

Beyond that, they will also brief governments in the identified countries about the steps that the South African government is taking to bring a stop to the attacks and to hold the perpetrators to account.

News9naija earlier reported that 188 Nigerians where successfully evacuated from South Africa via an Air Peace Airline, following an order by President Muhammadu Buhari.

Imo State government has approved a mobile money/agent banking training on financial technology programme for 5,000 youths to tackle unemployment in the state.

Disclosing this at the flag-off of the programme in Owerri, the state capital, the Commissioner for Youths and Social Development, Okechukwu Umez-Eronini, said the initiative, which is the brainchild of the State Ministry of Technology Development in partnership with the Iwuanyanwu Foundation and E-Transact International Plc in collaboration with the State Ministry of Youth and Social Development is aimed at youth empowerment and skill acquisition.

Umez-Eronini said that with it, the youths would develop a positive attitude towards being self-reliant and not dependent on white collar jobs which would help in improving their quality, standard and entrepreneurial skills.

According to him, the innovation when fully implemented would create a crop of technologically and financially literate youths, empower them, eliminate high rate of crime and crime related activities in the state.



He added that the programme would also bring financial services closer to the people of the state in their various localities and also enhance the GDP of the state and the IGR collection.

Speaking on the initiative, Chief Emmanuel Iwuanyanwu founder/chairman, said, as an organisation established in 1988 which seeks ways and means of improving the quality and standard of life of the people, the Foundation had since incorporation played major role in fighting unemployment through the award of scholarship to gifted students as well as assisting students whose parents/families are unable to finance their education, in development of infrastructure and endowments.

While commending the Governor Emeka Ihedioha for placing premium on welfare of youths, however, enjoined the people of the state to support his administration, which he said, was divinely installed for the liberation of the masses.

Governor Ihedioha who was represented by the Deputy Governor Gerald Irona said that his determination to rebuild Imo project was anchored on security, human capital development, infrastructure and technological development.

“We have set up a ministry that is technologically driven and ICT compliant to create jobs and to fight criminality in the state.”

Also speaking, the Commissioner for Technology Development Nze Meekan Mgbenwelu said that the flag-off was indicative of the government’s acknowledged partnership for sustainable development, and which brings together public sector, private sector (E-Transact) and civil society.

A religious celebration was marred by tragedy this week as a man participating in a traditional Islamic mourning ritual accidentally beheaded himself.

Mohammed Sayum was displaying his prowess at swordsmanship in the Nalanda district of Bihar, in east India, as part of a ritual procession known as the Mourning of Muharram. According to reports, Sayum, 60, accidentally cut his own neck and was rushed to Sadar Hospital, but died from loss of blood before he arrived.

The accident sparked chaos in the area, according to the news site Swarajya, where hundreds of others were also observing the ritual procession. Sayum’s son, Mohammad Feroz, told police he witnessed the incident.

Police in Bihar are still investigating and sent Sayum’s body for an autopsy.



Muharram is considered one of the most sacred months of the Islamic calendar. The Mourning of Muharram, or Muharram Observances, is a commemoration honoring the death of Imam Hussain Ali, grandson of the Prophet Muhammad and third Imam of the Shiite community, who was killed by the Caliph Yazid’s army in 680 AD at the battle of Karbala. For Shiite Muslims, Imam Hussain’s death is symbolic of the struggle against tyranny and injustice.

Observances of the Muharram procession vary, but traditionally involve a march from the Hussainia (congregation hall) into the streets, where participants light bonfires and partake in acts of self-flagellation, cutting, chest-beating and face-slapping. Some devotees visit the shrine to Imam Hussain in Karbala in modern-day Iraq.

Fatal accidents and violence have long plagued Muharram commemorations: On Tuesday, at least 31 people were killed in a stampede in Karbala, with 100 more injured. According to the AP, the stampede started when a walkway collapsed.

The same day, 20 people were injured watching a Muharram procession in Andhra Pradesh, in southeast India, when the roof they were standing on collapsed at about 2 a.m. Police report the victims were viewing the Pedda Saragathi ritual, where devotees walk on a hot bed of coals.

Also on Tuesday, a man in Uttar Pradesh was electrocuted, and others wounded, when a tazia they were carrying came in contact with a live electrical wire. A tazia is a replica of Imam Hussain’s tomb, carried during Muharram processions.

Days earlier, at least four people died in Karachi, Pakistan, when a tazia collided with overhead electrical cables. The incident happened on Saturday, in the Bhittaiabad neighbourhood of Gulistan-e-Jauhar.

In 2004, bombings at shrines in Karbala and Baghdad during the Day of Ashura, the tenth day of Muharram and the focal day for mourning, killed 140 people.

A Federal High Court sitting in Port Harcourt Rivers State has vacated a forfeiture order secured by the Economic and Financial Crime Commission (EFCC) on some properties belonging to former Imo Governor Rochas Okorocha and some members of his family.

The anti-graft agency had early this month obtained the court’s orders for the interim forfeiture of assets traced to the former governor, his wife, Nneoma Nkechi and their daughter.

The properties are: “a 16 – block 96 – flat structure and an eight – bungalow multimillion naira estate, hotel, two schools, shopping plaza, supermarket, hospital and four vehicles.

“The same were known to those close to the state as, East High College, East High Academy, Willowood Hotel, House of Freeda, Dews of Hope hospital and Market Square Supermarket.”

The commission in an earlier statement said it would like to know how Rochas Foundation and “other accomplices” acquired and or converted some of the property for personal use.

It alleged that a prima facie cases had been established against the suspects, which they would answer to.

Vacating the Order, the presiding Judge, Kolawole Omotoso, lifted the forfeiture order on some of the properties especially the schools to enable students to resume for the new academic year.

The court however made another Order restraining the respondents (Okorocha and family members) from selling any of the properties pending the conclusion of investigation by the EFCC.

The development followed the submission by Okorocha’s Lawyer, Okey Amaechi, that the forfeiture order displayed on the school gates would negatively affect resumption of academic activities in the new session, insisting that parents would be discouraged to register their children and wards in the schools.

Meanwhile the EFCC had asked the Court to exclude two of the properties earlier listed in the forfeiture order after it was discovered that they were not owned by the former governor or any of his family members.

I think it should be closed until it is repaired
Thanks for the info, but as it stands now, there has not been any structural effect/change to the bridge since the incident happened.
Closing too is a good option.
