The Independent National Electoral Commission was also ordered to refrain from recognising, dealing and relating with the New PDP.

The court, presided by Justice Elvis Chukwu, made the order while delivering judgment in a suit in which the Alhaji Bamanga Tukur-led faction of the party asked it to stop the Alhaji Abubakar Baraje-led group from further parading themselves as the party's elected executive officers.

The defendants in the suit - Baraje, Dr. Sam Jaja, Prince Olagunsoye Oyinlola and former Vice President Alhaji Atiku Abubakar - were backed by seven state governors, including Sule Lamido (Jigawa), Rabiu Kwankwaso (Kano), Murtala Nyako (Adamawa), Babangida Aliyu (Niger), Aliyu Wamakko (Sokoto), Abdulfatah Ahmed (Kwara) and Rotimi Amaechi (Rivers).

Emboldened by their serial successes including the INEC express declaration penultimate week that its is the authentic PDP, The Peoples' Democratic Party under Bamanga Tukur came out to warn the Alhaji Kawu Baraje led New PDP, to stop making utterances, issuing press statements, holding meetings under the banner of PDP or be treated as impostors and criminals.

Seizing the legitimacy bestowed on its leadership by the court, the Tukur-led PDP warned that it would no longer tolerate the excesses of the Baraje faction.

In a statement by its National Publicity Secretary, Chief Olisa Metuh, PDP shortly after the Abuja court ruling, he said; "For the avoidance of doubt, the ruling of the court in this regard is absolutely clear, direct and unambiguous. The PDP has only one duly elected National Executive Committee under the National Chairmanship of Alhaji Bamanga Tukur.

"We wish therefore to state with all emphasis that any group of persons parading themselves as leaders of this organ of our party are impostors and must be treated as criminals by all and sundry.

The Peoples Democratic Party (PDP) is about to suffer another major casualty, following the decision by the Adamawa State Governor Murtala Nyako and his supporters in the state to defect to the All Progressives Congress (APC).

Of the seven aggrieved governors, who broke away from the PDP last August, Nyako has been the most keen to cross carpet to the opposition.

But Nyako’s loss of patience with the ruling party occurred just as the PDP exempted its aggrieved members from facing its disciplinary committee, headed by Second Republic Minister of Transport, Alhaji Umar Dikko.

The party, after the inauguration of the committee yesterday in Abuja, said the decision was to give the ongoing reconciliation efforts in the party a chance to succeed.

Former Vice-President Atiku Abubakar, seven governors of the party, as well as two former PDP national secretaries, Alhaji Kawu Baraje and Olagunsoye Oyinlola, among others, had stormed out of the PDP special national convention last August to announce the birth of the splinter group, christened New PDP.

However, since the formation of the New PDP, their effort to wrest the leadership of the ruling party from the National Chairman of the mainstream party, Alhaji Bamanga Tukur, has suffered repeated setbacks.

Just last Friday, the Federal High Court, sitting in Abuja, affirmed Tukur's leadership of the party just as it ordered the leaders of the New PDP to stop parading themselves as PDP leaders.
But the splinter group has headed to the Court of Appeal to challenge the judgment of Justice Elvis Chukwu and is also seeking a stay of execution of the court order.

In giving reasons for his decision to dump the PDP, Nyako described the party as a “dead body” which he and his supporters would not have any regret if they left it.

The factional state chairman of the ruling party, Alhaji Mijinyawa Kugama, said in Yola yesterday that plans had been concluded by the governor's camp to defect and they were only waiting for Nyako’s approval to know when they would leave the ruling party.

Nyako, who was in Dutse, the Jigawa State capital, for a meeting with his counterpart in the state, Alhaji Sule Lamido, when Kugama spoke at a meeting with APC leaders, described the PDP as a dead body that he and his supporters would not have any regrets leaving.

Kugama, at the meeting, which held at the Government House, said Tukur’s highhandedness in handling the affairs of the party would cause its defeat in the 2015 polls.

The meeting was attended by members of Nyako’s cabinet, other political appointees, 19 members of the state House of Assembly, other political stakeholders loyal to the governor and Nyako’s first son, Commander Abdulaziz Nyako (rtd), who declared his membership of the APC at the meeting.

A source told THISDAY that the meeting was holding at the time the aggrieved PDP governors were holding another meeting in Dutse to determine whether they should defect from the PDP or not.
One of the APC leaders in the state, Alhaji Abdulrahman Adamu, assured Nyako and his supporters of equal treatment and fair play in the party, stating that the APC was founded on the pillars of equity, justice and fair play.

Speaking earlier, the National Vice-Chairman (North-east) of APC, Alhaji Umar Duhu, praised Nyako for his achievements in the state, adding that they were eagerly awaiting his return to the progressives’ fold.

Nyako also lent credence to Kugama's comments on the readiness of the members of the New PDP in Adamawa State to leave the ruling party.

He told reporters after visiting Lamido that PDP was a dead body, adding: “People used to leave their religions for another but PDP is not a religion which means leaving it would not be regrettable.
“There is no regret for us to be accused of deserting a dead body because to me I would not want to be buried with the dead body; so PDP is a dead party and if they feel like expelling us from the party, so be it.

“The leadership of the party in Abuja has already been given a terrifying fatal uppercut like in boxing and to leave a dead body like PDP is better than being buried with it.”
According to him, he and his colleagues in the New PDP were not afraid of being expelled from the PDP because there was nothing much again to the party.

On his mission in Dutse, he said: "The visit to the Jigawa governor is purely based on fraternity and to discuss the way forward on common issues bordering on security concerning us as northerners, as Nigerians and to discuss how to develop our entire region.”

He said: "The Dutse Airport would serve as a gateway for massive exportation of farm produce when completed and as the Chairman of the National Farmers Association, I will use my connections to actualise the aspiration of the Jigawa governor on the basis with which the airport is meant for.”
In a related incident, shortly after the inauguration of the disciplinary committee of the PDP in Abuja, the party’s spokesman, Mr. Olisa Metuh, told reporters that contrary to the perception that the party would make Atiku and his associates in the New PDP face the committee, there was no such plan.
According to him, the decision by the National Working Committee (NWC) of the party to excuse them was because of the ongoing reconciliation in the party.

He said: “Members of the G7 governors and others in the so-called faction will not face any disciplinary committee. There is none in the offing. There is no move to impose any sanction on them.

“We are doing this because our doors are still open for reconciliation. The leader of the party and other members will commence further reconciliation when they return from the pilgrimage to Jerusalem. So no disciplinary measure is being contemplated against them.”

On whether the party will review the suspension of the Rivers State Governor, Mr. Chibuike Amaechi, who is one of the seven aggrieved governors of the party, Metuh said: “The matter is in court and we did not take Governor Amaechi to court; but by and large, PDP wants peace, mutual respect based on equity and justice.”

He explained that the members of the New PDP were still committed members of the party and therefore had no other party to go to, saying, “They believe in the same principle in the management of the party to ensure equity and justice.”

However, he warned that despite the olive branch by the party, it would not entertain further distractions nor would it condone other people destroying it.
Earlier at the swearing-in of the disciplinary committee, Tukur said the PDP would adhere to party discipline as enshrined in its constitution.

On why the party picked Dikko to chair the committee, Tukur said his choice was informed by his defence of democracy that made the military government uncomfortable, leading to a failed attempt by the Major General Muhammadu Buhari regime, which overthrew the civilian administration in 1983, to smuggle him to Nigeria from Britain where he had sought asylum.

“You are chosen to this important committee based on your past record and love for democracy,” he said to Dikko.

He also eulogised the committee members, noting that “they are people who will not witch hunt anybody, but you can be sure not to come to them when you cross the line.”

Notwithstanding the party's bid not to sanction members of the New PDP, the splinter group said it had filed a notice of appeal against the Federal High Court  order restraining it from using the PDP’s logo and colours and recognising the Tukur-led NWC as the authentic leadership of the party.
In a statement   by its National Publicity Secretary, Eze Chukwuemeka Eze, the faction said the notice of appeal was filed yesterday by its lawyers.

According to the statement, “The decision to file the appeal was taken at an emergency meeting of the New PDP National Working Committee (NWC) following the return of the party’s National Chairman, Alhaji Abubakar Baraje, from the 2013 pilgrimage to Mecca, Saudi Arabia.
“The decision was taken after the NWC carefully studied last Friday’s ruling by the Federal High Court and after due consultations with our team of lawyers.

“We once more wish to reiterate that we remain convinced that we have a good case and are thus determined to ensure that Tukur and his cohorts are not allowed to hold sway as the leaders of our great party.

“Our teeming members and supporters should therefore entertain no fears whatsoever and should remain steadfast as we seek to legally establish our case and logically conclude our mission to rescue the PDP from anti-democratic forces so as to restore the noble vision of the party’s founding fathers.”
He also said the planned meeting of the group had been put off until next week.

“One of the major issues slated for discussion is how to receive our new members, particularly the five additional PDP governors who have indicated interest in joining us,” the faction added.

He said he recognizes only the mainstream PDP. Could he be planning to cross-carpet to the mainstream PDP?

Special Adviser to the President on Political Matters, Mr. Ahmed Gulak, in this interview with OLALEKAN ADETAYO, insists that President Goodluck Jonathan did not sign any one-term agreement with PDP governors

Despite the President’s statement that he did not sign a one-term pact with anybody, members of the New PDP are insisting that he signed the agreement and that at the appropriate time, they will release a copy. What is your position on this?

Eight months ago, when the Governor of Niger State came up with the claim on the one- term agreement, I particularly challenged him to come up with a copy of the agreement. This is because as a political adviser to the President, I know there are only three organs of the party at where such decision can be taken. They are the national caucus, the Board of Trustees and the National Executive Council and there was no time that such as issue came up at the level of any of these organs.

I challenged him to come up with the agreement, but up till now, the so-called agreement is nowhere to be found. I have repeatedly said it that Mr. President has never signed any agreement with anybody not to run for second term. The President himself said it at the last presidential media chat that he did not sign such an agreement with anybody.

Their plan is to tell Nigerians lies in order to intimidate the President or abridge his constitutional right to offer himself for second term if he so chooses. They should leave Nigerians to decide who they will vote for. It is not a group of five or six people that will tell the President what to do. I am happy to say that from G7 governors, they have reduced to G5. Two governors have backed out because they know it is not true. So there was no agreement signed by the President.

What then could have informed this insistence by the governors that there was an agreement?

I have said it that it is part of their plan to issue out tissue of lies in order to abridge Mr. President’s constitutional right. It is power. Certain people want to be President or vice president. It is part of their strategy. We have debunked this claim. We challenged them eight months ago and we still challenge them to present this agreement.

If the President decides to run, can these aggrieved governors and other members of the New PDP stop him?

Nobody can stop him. Are we not governed by constitution in this country? The constitution allows the President to contest for the second term. Nobody can stop him from contesting, if he chooses to contest. It is only Mr. President himself that will say, “Look, I will not contest in 2015.” That prerogative belongs to him to decide whether or not to contest. So let us wait for the man. He has said he will only declare his intention to contest or not in 2014. So why are they pressurising him and heating up the polity? They are trying to drag the President into the ring before the time. They should go and prepare if they want to contest the Presidency of this country. They should not wait to know whether the President will contest or not. If you want to be President, go and prepare yourself and present yourself to Nigerians.

You have just claimed that two governors have backed out of the G7 whereas the group claimed five more governors would be declaring for them next week. Which one should Nigerians believe?

Their claim was mere propaganda. I am telling you authoritatively that two governors have backed out. They are now G5. Only that I won’t mention names but go and find out. Even the statements that some of them have been making are also indicating that what I just told you is right. Two governors have backed out. It is authoritative, go and cross-check.

The Baraje group also issued a statement asking the President to postpone the peace talk earlier billed for October 7 because some of their members would be on Hajj. What is the Presidency’s position?

I don’t believe they are sincere from the beginning. If you have followed the trend of events, you will see that the President has been bending backward to accommodate everybody. He is ready to go to any length to achieve peace. But it just appears that they are not ready for peace. Immediately after the last meeting was adjourned to October 7, they went to the National Assembly and you know there was no need for that. It was a fundamental breach of the agreement reached at the meeting, that all parties should refrain from further actions until October 7. Nigerians now know that they are not sincere. So whenever they are ready, I believe Mr. President will be ready to listen to them once more.

You said the President could go to any length to achieve peace. Will he forego second term if that will bring peace?

There can never be agreement to abridge constitutional provision. It is for the President to decide if he wants to contest or not, that is his constitutional right. You cannot intimidate Mr. President out of contest, who are you and who do you think you are? When the constitution gives a man the opportunity to offer himself, who are you to say he will not? Unless you go and amend the constitution and that does not lie within the powers of the governors.

There are reports that a copy of the agreement is with a South-South governor who is a loyalist of the President and he will not make the copy available. What is your position on this?

Is that what they are saying again? That is just propaganda. If there is an agreement, they will have more than one copy. There will be duplicate copies. But I am telling you again that there was no such agreement between the President and any other persons. Agreements must be between two or more parties, except the agreement was entered into in the absence of the President.

With the way the New PDP has been issuing statements criticising the President and government policies, do you think genuine reconciliation can still be achieved?

I am telling you from my own experience in politics that there is no sincerity in everything these people are doing. They can go on to criticise the government and we will go on to tell Nigerians that what they are saying are tissues of lies. Nigerians are watching everybody. Ninety per cent of Nigerians have come to realise that these people are just out for their selfish ambitions. They should go about fighting poverty in their states, not fighting President Goodluck Jonathan. Thank God two of them have backed out, having realised that their move is not in tandem with the constitution of the country. Mr. President has the constitutional right to contest and it is left for Nigerians to decide whether to vote for him or not.

What then is all this noise about?

It is about power, it is about their last term in office, it is about what next in their political career. It is not unexpected.

Apart from this agreement that you said is not in existence, are there no genuine conditions among the ones put forward by these men?

There are no genuine grievances. One, the President is entitled to offer himself for second term if he so desires and it is left for Nigerians to decide. Two, that the Economic and Financial Crimes Commission should stop probing them: it is not within Mr. President’s power to stop EFCC from probing them. EFCC is doing its statutory job and whoever is involved, EFCC must investigate that administration. The commission is also probing the Federal Government. Haven’t you seen the fuel subsidy probe and people being prosecuted? It is a nonsense thing for a governor to say EFCC should stop probing his administration. In fact, I expect them to invite EFCC themselves to look into their books if they are genuine and sincere.

The third is about the national chairman. I have always maintained that the national chairman is a product of an election at the national convention and his election was observed to be correct by the supervisory body, which is the Independent National Electoral Commission. As there was process of emergence, there is process in our constitution for his removal. No governor or group of persons can just stand up and say you must sack the chairman.

Senator Smart Adeyemi is the vice chairman of Northern Senators Forum and chairs the Senate committee on FCT. In this interview, Adeyemi blames the military for the stagnation of Nigeria’s socio-economic and political development and appealed to northern governors to concentrate on issues of poverty reduction rather than fighting for 2015.

Nigeria is celebrating 53 years of independence, how has it fared as a nation?
I will want to start by commending the nationalists, those who fought for the independence and liberation of our people. People like the Sardauna of Sokoto, Nnamdi Azikiwe, Awolowo, Aminu Kano and all those foremost nationalists. We have every good reason to commend them for their courage towards getting us liberated from the chains of colonialism after which they did their best to lay a solid socio-economic foundation for their regions but was truncated by the military.
The nationalist started by putting in place the foundation for our political development as a nation. They did their best, Sardauna united the people of the north, he was a premier for all northerners and we were one north. He was not an ethnic champion and even though he was a devoted Muslim he gave room for everybody to practice their religion and that explained why most of those who surrounded him were Christians and he did not make any effort to make them jettison their religions thereby planting the seed of unity. He established many economic programme and projects like the Kainji Dam before the federal government took it over, Jebba paper mills, NNDC, New Nigeria newspapers, those were leaders that were totality committed to the overall development of their people. The same with Obafemi Awolowo and Zik.
In the 60s, Nigeria was at par with countries like Brazil and we were even ahead of some of them. All the regions have universities of their own and we were seen as the future leaders of Africa. This was the vision that was ahead of Nigeria then but in 1966 the worst thing happened to Nigeria, the military came and truncated the vision of these nationalists.
Many of them who came at that time were very young officers whose level of education and exposure was limited but they found themselves in power so they couldn’t manage the resources that was available and they couldn’t equally carry on with the vision of the nationalists and the worst thing that happened was that, we had these issue  of sentiments that tend to divide us because under the military there was pronouncement of the state where you come from, your tribe and even religion given priority. The good news is that we are back to democratic government in the last 14 years and I hold the view that no matter how anybody will assess the democratic dispensation, there is no doubt that it is far better than military era.
At 53 we shouldn’t be taking about federal character because the Sardauna is no longer available who will not look at your tribe or position before giving you appointment. We’re talking about federal character now because today we have people in power who see themselves as representatives of their own communities or tribes. I come from the northern region and I have studied the style of leadership and administration of the Sardauna of Sokoto and I discovered that he carried every part of the northern region along. Those of us who were from parts of Kwara and Kogi had a fair share of his government’s  largesse so nobody complained. In Kabba we had the College of agriculture which he established in 1963 but up to today it has not been upgraded to a degree awarding institution 50 years after.
But some of your colleagues who were once in uniform have blamed the politicians for the state of the nation, what is your reaction?
When you asses an already built house and when an expert tells you that the house is not well built then you will now have to doubt the competence of those who built those structures. It is saying in essence that the foundation is faulty. The military came at the very foundation of our nation so they gave us a bad foundation and that is why some people are still calling for national conference today because of the failure, maladministration and misplacement of priority and the inexplicable institutionalization of corruption in the country by the military. The states structures that we have today, were created under the military and were created on the basis of compensating some of the boys in uniform.
The 1999 constitution as handed over to us by the military is faulty so much that it is even difficult to amend. When you start the amendment you discover so many problems. For example, we are talking about local government autonomy the military did a good thing by creating the third tier of government but they equally didn’t put it in the constitution that they should have direct funding. Now they are left in the hands of the states. About three years ago I said it was equally wrong for us to have a bicameral system of government because it is very expensive to run. The military government put so many things in place to make governance very difficult for us.
Do you still hold that view?
I hold the view that we don’t need a bicameral legislature because it is expensive but how do you correct that when everything must go through democratic process? Can you ask people to vote against a situation where they have to go home? That is the question, I am ready to leave my seat if its okayed.
I am ready to leave my seat if leaving as a Senator will make Nigeria to move faster and be more peaceful and improve the welfare of Nigerians I am ready to leave my seat.
For a developing nation like Nigeria we do not have to copy American system of governance hook line and sinker, it must be based on the resources available to us. The bicameral system of legislature that we have is too expensive. But again, we need to equally appreciate the fact that there is the need to carry every section of this country along.
There is this agitation that power should return to the North while some are saying President Jonathan is qualified to contest. Do you see the agitation as justified?
To me, that is for Mr. President to decide. The north has the right to ask for power to shift back or to rotate to north. But let us also take into consideration that nobody knew that Yar’adua would die. So God brought Goodluck. I see Good luck as a man of covenant, when they say in Islam, ‘Kaddaral Allahu hakkan Kadarihi’ when God does certain things, is beyond man to change. So I see him as a man who is empowered by divine Hands of God.
Like you rightly said, he has a right to contest. Let us wait until we hear the final pronouncement of Mr. President that yes I am going to run. But what I would tell my brothers in the north and governors is that it is too early to start this fight, I want to look at the situation where the northern governors can start a fight for more resources to bail the region from poverty.  I want to look at a situation where the north will agitate for the rehabilitation of the northeast. I want to support the reconstruction of the Northeast, let them vote money for that. Because after the civil war of 1957, we had a reconstruction program. If it is that, the agitation is classical. But for governors to start agitation for power, at whose expense is the cost for traveling?
Now they leave the duty post, at whose expense? For me there are more challenging problems. President Jonathan is yet to even make pronouncement. So why don’t we allow him to make pronouncement before we start asking him questions.
Let the governors look at the overhead, the income per capita as it affects the people. Let look at how to graduate the people from the abject poverty. About two years ago, the former governor of Central Bank, Mr Soludo, said 70 percent of Nigerians are poor. Majority of them are in northern region. That to me is a major issue to attract the attention of the governors to examine. The moment you come in to Kwara, from the Lagos end, or you come in from the Southeast, you see poverty graduating.
So I think the governors need to concentrate on issues of poverty and providing job opportunities.
You talk about power, is it when you have power that determines what you do, to solve all your problems?

Because we have been in power for 30 years and we are paying for the period we have been in power. For 30 years, power has been in the north, yet poverty is seen as high as it is. This is the time to say let us woo the man who is in power, who is not from our region to do this for us.

Rebel PDP Governors Ask Jonathan To Remove Sambo As Vice President.

**President Jonathan must replace Vice-President, Namadi Sambo with one of us for peace to reign in PDP.

The crises in the ruling Peoples Democratic Party (PDP) has taken another turn as rebel group are soft pedaling and now making one condition to both the PDP executive and the President.
Four of the seven rebel Peoples Democratic Party (PDP) governors, Murtala Nyako (Adamawa), Babangida Aliyu (Niger), Sule Lamido (Jigawa) and Aliyu Wamakko (Sokoto) has protested to President and gave another condition for peace to reign in the Party.

The rebel group led by Alhaji Atiku Abubakar said that only recipe for peace and the only reason that they will be supporting President Goodluck Jonathan's second term bid the President to replace Vice-President Namadi Sambo with one of them.

This adds to five, the number of conditions given by the rebellious PDP group to President Jonathan and PDP executives.
Prominent among these conditions is for the President to take an undertaking, that EFCC will not investigate and try after they leave office. - Hope For Nigeria.
