You'd be surprised how much these states are willing to spend to lock up people they don't. I do think certain offenses like alcohol intake in sharia will be gladly funded. Traffic crimes will ticketed more since it's revenue generation. I don't think the judiciary runs the prisons that will be the executive branch. Assuming states copy the federal structure.

Judiciary should run jail houses while FG and states run prisons .

Jail houses are meant for awaiting trial and those on remand sentence


Prisons should be for those convicted and their sentences be served in the respective state or federal prison based on the court of conviction .

This is how it is done in the US.

All bail monies go to the judiciary .

Once an individual jumps bail or escapes from remand , a court sherrif will be in charge of bringing him or her back to custody and before the courts .

That same Court Sheriff will run the jail facility via subvention from the judiciary and will also be in charge of securing court premises and security of judges at the bench at in their respective private residences.

A federal court sheriff will also exist for this same purpose and will form the armed enforcers of the bench to execute a warrant issued by the bench.

Awaiting Trial inmates need to be housed separately in federal or state jails (depending on which court they are undergoing trial).

State judiciary must be responsible for such jails while federal high courts for those arraigned before it.

Sending someone being tried before a state high court or sharia court to a federal prison prior to a bail hearing, during trial or after a conviction without the respective state bearing the burden of providing for them during their trial and convicted periods in detention is unfair to the FG.

States have criminalized so many petty offences like traffic offense to littering to having a cold beer (sharia states).

The state judiciary contributes the highest backlog of Awaiting Trial inmates . Once this happens , states will be forced to review their sentencing laws to simple fines or community service or probation sentences since the states will bear the cost in housing inmates .

Also, the respective state prosecutors office will be up on their feet since the judiciary that will be saddled with operating jails will not allow the ongoing police abuse of the judiciary process to get innocent individuals thrown in jail pending a bail application.
