I'm interested in this topic. My experience, my accounts were PND for 9 months running and no justice. Eventually, EFCC who initiated the PND orders has finally exonerated me and written to the banks to vacate the order. 3 of the banks have done so almost immediately. But Access bank still held my account for 7 days now. Saying, their compliance unit have not responded. How long will a bank who was so swift to PND my account, who was not a party to the allegation upon which my accounts were PND, but now that the order to vacate the PND has come from my accusers still be holding my account? What legal action can I take against the bank #AccessBank

Court awards N25m damages against bank for unlawfully freezing lawyer’s account

An Ikeja High Court has ordered Diamond Bank Plc to pay a Lagos-based legal practitioner, Adetokunbo Odutola, N25 million as damages for unlawfully freezing his bank account. Justice Sybil Nwaka held that the bank failed in its duty of care to Odutola and was so liable for the injury that arose therefrom.

The court further held as unacceptable, the bank’s contention that it froze the lawyer’s account on the instruction of Economic and Financial Crimes Commission (EFCC), noting that only a court could make such an order. Justice Nwaka delivered the judgment in a suit marked LD/ADR/800/17 between Odutola as sole claimant and Diamond Bank as the sole defendant.

The suit originally involved three banks as defendants but the first and third defendants settled with the lawyer out of court, leaving Diamond as the remaining defendant. In his statement of claim, Odutola, who represented himself, sought N25m against the bank as both special and general damages he incurred due to the bank’s “negligence and breach of duty of care.”He averred that he “suffered embarrassment, hardship, disgrace and loss of income” following the unlawful freezing of his account. In particular, the lawyer claimed that a cheque he issued was rejected by the bank, his practice was financially affected and he had to resort to borrowing “N500,000 to repay N750,000” from a money lender.

The lawyer further stated that during the blockage, he was “engaged in a brief which would have earned him N10million”, but which he lost. But the bank, through its counsel, Olatunji Muritala, countered that the cheque was dishonoured on November 29, 2016, when it got a letter from the EFCC asking it to place a lien on the customer’s account.

It also challenged the claim for N25million on the ground that Odutola “failed to prove any economic loss suffered when his account was placed on Post No Debit (PND).” The defendant urged the court to dismiss the suit in its entirety and refuse all reliefs sought with substantial cost against the claimant.

In her judgment of December 16, 2019, the judge upheld the lawyer’s claims. Justice Nwaka held: “The bank went ahead to place PND on the account of the claimant on the instruction of EFCC. The bank ought to have demanded from the EFCC an order of court to that effect.

“It is not in the power of EFCC to authorize a PND on any customer’s account. The EFCC must not usurp the powers of a court of law. The duty of care owed the claimant by the second defendant (Diamond Bank) is nothing but breached.”The judge said the bank’s inaction of not demanding for an order of court or an official letter authorizing it to place PND on the claimant’s account amounts to negligence.

“And this negligence is traced to the embarrassment and loss suffered by the Claimant.“This is a society whose affairs are supposed to be governed and conducted in accordance with the law. The EFCC and the bank taking law into their hands is nothing but shameful. “I am satisfied that the claimant has proved his case on the preponderance of evidence and I so hold. Judgment is hereby entered for the claimant against the second defendant as per his claims”, the judge held.

Honda pilot because the parts are cheaper and more original to acquire, it is a very good knock about vehicle compared to the rest.
The Honda also has good mechanic to fix any issues on ground, what's more blends well within the environment.

pick the highlander 4 cylinder if you are all about fuel economy.

XC90 too is a good solid SUV though not as maintenance friendly in the technician department but solid rock.

please share with us the vin number so we can check

Most of you often quickly jump into conclusions that golf 4 is electrical nightmare,

1. most people who sees golf as electrical nightmare have little or no knowledge about German cars electrical electronics system.

2. Car owners that complained that this cars are troublesome have a very legitimate poor maintenance habits.

3. Most mechanics who find this car troublesome are lunatics who knows nothing a computer, car engine management sensors and how there work together

The European idea of mechanic is not a butcher or lunatic but enthusiast sharp brains creative and psychologically inclined personalities,

Ofcourse most of our mechanics are good psychologists but they lacks lot of information stream that makes this hectic job a lot easy to deal with..

And if they know this, the last thing they will need is a peanut payment to do a job..

In a nutshell if you find any mechanic who fixes these hot head European cars, listed above in Nigeria, when i talk about mechanics i mean 80% percent of the work on these cars.. such as computer diagnostics, Ac, electrical & electronics , bodywork, and mechanical.. you need to respect him him cos it's not easy.. ofcourse I know some that knows like 60% it's impressive..

Japanese cars are simple engineering for bush brain mechanics... Car for average people that's why 80% Nigerian will be named after Toyota

Dear NL,

I am interested in buying an SUV and the one I am seriously considering is 2008/09 MDX. However, my mechanic including dealer has been trying to discourage me from going for it. That I should rather go for RX350 or at worst Highlander because it's better and if I look around I will see more of it than MDX (I am based in Lagos).

Now I need your advice on the genuity of these people's assertion. Are the sins of MDX that many making people to avoid it?

Oh, By the way OP If you do decide to buy the MDX I advice you to take ALOT of time and Do alot of careful searching.
The MDX is not as common as the Rxs in Naija, so your search options and pretty limited. Especially if you have high standards.
It took 4hrs in Cotonu, Three trips to Berger, and countless weeks scouring the internet with over 6 VIN history reports from computerglobal for me to find one that "kinda" met my standard.

-Avoid Canadian stock if you can ( the MDX is not the kinda Car you want to buy with rust problems)

-Avoid the Sports Package (if you can) the Active Damping System is expensive to keep stock

Engine Power- MDX wins
Handling- MDX wins
Luxury/Comfort- MDX wins
Safety ratings - MDX wins
Traction Control Design - MDX wins

So, Asides from better fuel consumption (which is to be expected as the MDX has a bigger, more powerful engine and greater curb weight) and cheaper maintence ( MDX is a premium car, not for
the thrifty tho is cheaper to maintain than the rx350 which is in its class)
Please tell me with 22 yrs experience how the RX330 betters the 2nd Gen MDX.

Fuel economy is a relative issue. Engine is bigger than most v6 all wheel drives at 3.7l (current models have been dropped to 3.5l), and review at release puts it ahead of cars in its class (eg. BMW X5) in fuel economy (www.edmunds.com). If you are moving up from a 4 cylinder engine then you may need some time to adjust.

If all is well with the particular car you are buying then you will be fine.

When you have maintenance apart from very basic oil change, make out time to go to Oyingbo and find Muri's yard.
