The Judiciary, especially the Chief Judge of the State is the main pointman when it comes to the impeachment of the Governor. For this impeachment to succeed, the 27 lawmakers must first impeach and remove the Chief Judge from office, they started something along that line by opening an investigation into Age falsification by him, but they will be fighting too many wars on many fronts.

Within two weeks, the lawmaker will have to vote on a motion to investigate these allegations in their impeachment motion, if that debate passed by a 2/3 majority, it will be forwarded to the Chief Judge of the State, who will appoint a seven persons panels and none of them can be public servants, legislators, etc...if this panel finds that these allegations are not proven, the impeachment dies.

The final impeachment vote by a 2/3 majority can only take place if the panel setup by the Chief Judge finds that the allegations are proven and guess what, the Chief Judge is Furbara's staunch backer.

I believe there are plans on ground to remove the Chief Judge. Politics na truly dirty game.

They will hold on to the words of the several Supreme Court Justices who already indicted Fubara.

2) Fubara presented budget to people who he believes are the law makers

3) it suspect to ask fubara to present a budget when court has not ruled on who and who are lawmakers in rivers state

A natural court would have asked the budget to be presented to the national Assembly house of reps since they can take over the function of state House of assembly of they can't function

4) the ruling can't be enforced until the appeal process has ended

Instead of misinforming the public, pick up some legal books and enlighten yourself. Ask questions and open your heart to learn!

You are so wrong! The Courts have the discretion to grant a stay of execution. It has never been a "MUST" affair and will never be.

Again, an appeal on it's own does not act as a stay of execution.

That affidavit is worthless because it contains information that is manifestly untrue. The law is that where an affidavit contains manifestly untrue statements, then the court MUST discard it.

Why do I say so? They were not and are still not members of the APC. The defection would have been complete if they actually registered as members of the APC in accordance with Article 9 of the APC Constitution that deals with membership.

An affidavit cannot make them APC members because the is a peculiar way to join APC as enshrined in Article 9 of the APC Constitution.

An affidavit cannot make me Governor of Rivers State.

This is elementary law and it has nothing to do with emotions.

They however should be charged with perjury because they misled the court.

Amaewhule and group openly left the PDP through which they came to office and declared that they are now APC members.
There is no constitutional backing for Amaewhule to still remain Speaker of Rivers State House of Assembly.

This can be argued from different angles.

1. I might be wrong, but I don't think Nigeria has ever experienced a situation where majority of the members allegedly defected including the speaker. Section 109 (2) holds that the Speaker shall declare the seat of such a person vacant.
Who then declared their seats vacant? Remember, Edison Ehie and 3 ors were already suspended. So could not have pulled such as suspended members.

2. Go to court and challenge the alleged defection. Is there a judgement today against Martins Amaewhule and co as the legit Assembly members? Instead, there is a fresh COA judgement recognising Amaewhule and co.

3. The law is that an affidavit containing statements that are "MANIFESTLY UNTRUE" will be discarded. If I depose to an affidavit stating that "I am now the Chief of Army Staff," does it make the the COAS? Amaewhule and co should them be charged with perjury because they were never members of APC and did not comply with Article 9 of the APC constitution that borders on membership which I will upload below for your perusal.

My brother, Section 109 IS NOT self-executory.
It should be fought up to the Supreme Court.

Hate Wike and the 27 lawmakers all you want but on this issue, they are on the side of the law.

Answer these questions

1. The FHC via a judgement recognised them (Amaewhule and co) as the legit assembly. Has that judgement been vacated by a superior court?
2. Did the same judgement not state that the budget should be brought before Amaewhule over 10 months ago?
3. The COA ordered Fubara to present the same budget before Amaewhule and derecognized the 3-man Assembly. Did he obey?
4. Is Fubara not in gross violation of the constitution via à vis Sections 120 -122 of the CFRN 1999 as amended?
5. Did Fubara and his team not approach a court without jurisdiction (SHC) to vacate the seats of Amaewhule and co in gross violation of Section 272 (3) of the CFRN 1999 as amended?
6. Did the said State High Court not meddle in that matter? Was it not celebrated by his wing, including the AG of the State who is to know better?
7. Did Fubara appoint commissioners without due screening by the Amaewhule-led Assembly?

Law has absolutely nothing to do with emotions.
Fubara and his team will keep losing out because they are not operating in consonance with the law.

Guess what? If the Supreme Court goes ahead to recognise the Amaewhule-led Assembly, then he will be gone in a week. His actions are impeachable offences. He should pray that the Supreme Court acts in his favour.

Instead of wailing and abusing Wike and blackmailing the Judiciary, TAKE YOUR TIME AND STUDY THESE LEGAL PRINCIPLES ESTABLISHED IN OUR DIE GRUNDNORM.

Seek for a copy of the judgement and keep yourself intellectually afloat. No go dey argue empty.

People are too emotional for my liking. You may hate Wike all you want but in this case, the law is on his side.

I just pity those urging Fubara to fight. The guy has committed lots of impeachable offences and should ordinarily retract his steps.

What stopped him from representing the budget? I guess he didn't want to give validity to Amaewhule's Assembly, but he's only postponing the inevitable. The Supreme Court will still align with the COA judgement.

Again, instead of being emotional, pick up a copy of the judgement and read. Read the 1999 constitution of Nigeria with specific reference to the appropriation bill.

I only pity the civil servants.

I am aware of pre-election matter but your claim of flaw in the election was what made me to to say, if there were flaws in an election, you go through the normal channel. The grouse of the case, if in a normal setting where rule of law is paramount and the judiciary are up to their game, if the petitioner goes back to the court, the judge would give an order that the suit has been overtaken by events because the judge did not say don't conduct election.

The court didn't expressly state that. However, we both know no election can be held without Voters Register. If INEC is saying "We didn't issue RSIEC the VR dey claim to have," don't you think it is a big deal that goes to the very root of election preparation?
