It's obvious you are a landlady. I am a landlord too. Only a hungry landlord or lady builds a house with the sole aim of living off rent proceeds. Not in Nigeria. Using all the money you have to build a house for rent in Lagos, and hoping to live on rent returns is suicide.
For me, only IDLE money should be invested in a property for rentage. You must have other sources of regular income.

Legally ,he doesn't have the right to break into your apartment, unless with a court order and issue of quit notice which should be about minimum of 6-12 months before eviction.

Now, the issue is this, the money you'd use to go chase after him in this country is sufficient to get a new house and even get a new TV , trust me.

That asides, one thing I've realized in dealing with landlords is that, you either go the route of force/unknown or the route of family/friends. My advise is to go with the former, in between or cowardice will land you in trouble.

A landlord will not take the property of a violent and aggressive tenant or someone he sees as family. But if you show hints of weakness ,doesn't matter how long you stay with him he'd do you like trash .

When dealing with people, especially for the very first time neve ever show any hint of weakness, you must be larger than life and unpredictable.

Even though I pay my rent always, my landlord and caretaker know better to not mess with me, one way I've established tis is to be hot and cold.,e.g. breaking down the padlock outside the gate , next day I'm buying drinks for everyone in the compound , another day some muscular boys will pay me a visit ,then it's hot numerous chick and then I'm going to church and sharing Bible messages the other week. The month I refused to pay for PHCN bill no one asked questions, then other month I paid for everyone.

Majority of the peeps that commented on the front are kind of slow and I'm very sure they don't know the position of the law in this matter. Except op has been giving a quit notice which he defaulted on and the court ordered this eviction then the landlord acted illegally. Op shouldn't have owed the landlord this much but then the landlord can't just simply break into the apartment and steal things the way he likes. Op some lawyers likes cases like this because enough money will be made from the landlord through the court of law.

You mean the OP employed his landlord as security again? so if the landlord sees your brother moving your things out after 13 months abseentism, the landlord should start arresting the OP's brother. Who told you the landlord Is even living in the apartment? So if the landlord was told the OP' s brother came to park things out then he should leave whatever he is doing and go and police the place for the OP. You guys assume too much. Get to court and police station first and see how they turn case upside down. Most of you don't know that in court, you won't even be able to say what you want to say. The lawyer may be asking you just yes and no question and you probably have 30minutes for your own testimony. The rest na lawyer wey get 100 cases whose details he barely remember that will be throwing technical jargons. Make the OP just pack his load and leave wahala behind

I just went to the police station and made a report about illegal eviction and damaging of property. Same day I got a restraining order against the landlord. He bribed the police and the police started taking his side
Then we started the legal battle. After 6 months of legal tussle, he had to start begging. At the end I ask for one year free of rent to cover the damages. He and his lawyer gladly signed. I left after 9 months.

I called the landlord to ask what he has done, he blatantly lied telling me I sent my 'brother' to clear my things off the apartment that he has reported me to Police.
Yes, I owe him 8months rent and I've away for 13 months even before the last year rent I paid expired. I told him I'll be back by November and I'll pay once I get in.
Pls even though I owe him, it doesn't feel right stealing my property and throwing the rest in the rain
Pls I'm lost and dire need of legal advice
Edit: while I'm not absolving my self of the guilt that I owe the landlord this long and purely due to loss of job (covid19 problems) and there's no way I go there and get my stuff without paying the backlog. He has absolutely no right to break your apartment no matter how much you owe him without an order of the court..
so you can take legal action but think about this 'the property he took will it cover for the eight months rent' ? That money you want to pay him maybe you can use it to pay for another apartment.

You don't even understand. Your own landlord admitted doing it..This one denied it. They are two different things.
NB- That he doesn't want further trouble doesn't mean you will win in court. Many times, it is cheaper to move on and settle out of court

So tell me how landlord will indict Op brother without a video recording evidences when Op brother was actually doing the packings himself..

You have been away for 13months, you owe rent of 8months. And you lock up a landlord's house abi? Even if you have been away, in this day and age, payment can be made with a snap of transfer, isn't it?

Oga, abeg you Jo get case. If you no wan stay house again, send your people to pack all your kaya and vacate the space make another tenant enter so land lord can be making his money.

You can't look up a rented apartment, owe 8months and be talking till you show up, you will pay backlog. If na you be the landlord, na so you want run your own business enterprise?

irrespective of the fact that you are owing does not give him the effontery to break into your house. The law frowns at such acts. The law only permits him to eject you by an order of court executed through the court bailiffs.There are several lawyers that will be willing to handle your case pro bond and I can assure you that if you sue him for trespass you will win.

To forcefully evict a tenant without a court order is wrong on its own, to now break in to someone else's apartment in his absence is a bigger crime. It's ok to feel emotional and all, 8 months rent? Haba! But we are not in the jungle, there are laws and there are procedures which the landlord obviously ignored. Get a lawyer, sue the landlord or at least, negotiate the release of your properties he took.

Something of such happened in Lagos here 9 years ago, the tenant rented an half plot, I don't really know how much he pays then for the rent, but he wasn't paying very well. He was owing the landlord a year rent.

He built a restaurant and bar on the land.

One day, Landlord got angry and arranged boys to destroy the man's shop. They destroy the walls without going inside not touching anything. The man told me this himself because I was going to rent part of the the land for my viewing center business that I wanted to open at the area then.

He reported the case to the police and got himself a lawyer because he was educated and an Ebo man. He took pictures for evidence and told the Judge that he left 5 million naira in his bar, his lawyer asked him to say that.

They charged the man to court and he explained what led to his actions but the Judge punished him by asking him to pay 8 million for damages or he can forget the land, and it belongs to the tenant until otherwise.

The man begged his tenant but he refused and got stroke. So, his children went to the man to beg and he asked them to go and bring 3 million and he will drop the case. Till today, the tenant has been using the land as he likes and renting it to other tenants like he owns it. The owner is late now so and the children never see 3m.

This happens at Aguda Ogba Lagos.

I don't see any reason why someone will deliberately lock an apartment for 8months..it's just wickedness

The landlord should've gotten some policemen involved before breaking it .at least to bare witness.

Simply just obtain a police report and proceed to court. Even though you owe him, he should have obtained an eviction order from the court. He has broken the law. If you don't sue him, he will do it again. We are not in a jungle, there's a due process for everything. Being owed is not a reason to act outside the ambit of the law. Also, don't allow anyone harass you. Going by the ACJA 2015, police should not interfere in civil matters such as this. Indebtedness is not a criminal offence. The reason why you are reporting to the police is because a criminal offence has been committed by your landlord i.e obtaining your asset without your notice (a.k.a stealing) and breaking into your apartment (a.k.a burglary)

The compensation you will get will surpass the rent you are owing. Make sure you pay your rent from that. All the best.

Which court after signing agreement letter stating the grace period you were given and you will also pay for the period of time you were there or they will auction your stuff.

Please, you guys should go and read lago tenancy act again... You get mind to carry landlord go court. Chai!

According to the law u v every ryt to sue his ass claim damages and claim u had 10million naira in ur bedroom which u we're saving ... He wil be compelled to pay up but make sure u don't build a house because nemesis will come looking for u .... And trust me it will Bleep u up badly ... Ur tenants will do worse ... So I advice u pay him and take ur property

You are the one that is not comprehending. That is the Op side of the story. Did anyone actually see the landlord breaking the door? You think the landlord didn't know it is illegal? The landlord denies it for Christ sake. You want the landlord to have video evidence? Why? He is not the accuser. The Op is the one that will provide video evidence of the landlord breaking his door. The landlord is saying the op's brother came to park the load...while the op is saying landlord broke his apartment. Both of them have reasons to do it. The OP may send his brother to pack his load to avoid paying the landlord accumulated rent while the landlord too could illegally break the door truly. So, it is the better lawyer with the better evidence that will win. Forget the sentiment of the op story. the landlord would have thought about it very well unless he is a fool

I am pained that you are a fellow architect but you are reasoning like a draughtsman. That you are owing a person does not permit you to resort to self service, that's jungle justice. The landlord would have gone to court to recover his property if he could not get hold of the tenant.

What the landlord did was purely a crime. Go and report to the police, take a police approved photographer take photos of your property and any damage done by the landlord. Write a list of all your damaged and missing items (I hope you have receipts for most of them). Then get a lawyer and sue the landlord for theft and illegal eviction. Also get the lawyer to obtain a protective order to stop the landlord from harassing you for the duration of your tenancy as you are still a legal tenant. Don't forget to add emotional damage to your suit.

The only problem will 7days to send notice then grace period (papers). After which you will asked to pay for grace period.

Oga go to police station.. And go and write.

Shey na police go settle matter ni!

Na court now. When you waste money for lawyer and court case.

Then I will look for things to put on your head, so next time, you will know your place...
