LordVoldermort: I have been a tenant and l am also a Landlord. When l was a tenant, l lived in a House without the Landlord and most times, l get frustrated because l have to champion every repair in an environment where the other Tenants are not cooperative and some are outright not operating at my own 'frequency'! The "common areas" are left dirty and abused, while l want cleanliness, some others dont mind living in a dirty, decrepit environment. When something gets spoilt, it takes ages for us to reach a consensus on how to fix it. Come and see fight between them, at times! If l complain to the Landlord, he simply says: You people should go and sort it out between yourselves. But in a House where the Landlord lives, he sees everything and l am sure he wont close his eyes and watch the House getting spoilt, he would act immediately. The issue with people who complain about living in the same House where the Landlord lives, in my experience, is that they are mostly wayward people who like to behave ANYHOW or use the property ANYHOW .............. such people always feel uncomfortable with the presence of their Landlord in the same building. Decent Tenants who pay their rents on time when due, are always happy to live in the same building with their Landlord because they know that they would always have a good relationship with him/her. I have helped my tenants to couple renewable energy solutions for free (save they buy the equipments they need, which l also help them to source cheaply) , saving them Hundred of thousands of Naira, using my personal knowledge, since l also enjoy the same thing but these are Tenants who are decent, matured, well-polished, dont owe me and are not the yahoo-yahoo, untrained sort that litter the Capital. I screen my tenants seriously, at the point of Entry, l wont give you House just because you carry cash, ready to pay. I ensure that all Tenants are people with "similar outlook/vision" to Life! You cant mix an educated or Corporate person with an illiterate Trader, or a jobless Loafer, in the same compound, it is a recipe for disaster! TCD: A Landlord needs a reason to quit a tenant, and the first and most basic and legally acceptable reason is that he wants the Tenant out of his House! It is a REASON and it is as simple as that. It is his House and his has the Right to determine who lives there, that is settled in law. But even at that, the Landlord DOES NOT have the Right to throw a Tenant's property out, without a Court order! - The procedure is to issue a "VALID" Quit Notice. - Then issue another Seven Day Notice of Intention to Recover Property. - Then Apply to the Court to Issue and Order to recover property and recover any Outstanding Debt of the tenant (There are ways to fast-track this process). - Tenant is served the Court process or it is pasted on his Door and process of Service properly documented (Substituted Service), if he tries to evade Service. - Then, whether he shows up in Court or not, Court will decide on the matter and issue a Vacate Order. order will be served on Tenant and forcefully executed by a Court Bailiff, if tenant doe snot comply. What most Tenants do or bank-on, is to make the Landlord go through the process and then try to abscond (without paying their Debts), just when the process is about to "conclude", making the Landlord waste time and resources on the Court process! The very wicked ones among them will even lock the Door and run away, knowing that by law, you cant forcefully Open the door, in their absence, without a Court order! SOLUTION: - Collect a sizeable REFUNDABLE Caution Deposit (to cover about 2Months Rent), from the tenant on Entry. That would relieve you a bit, if you did not waste time to file the Court process. - Once the Court process has started, MONITOR the Tenants Movement properly (Day and Night), to ensure they dont try to pack out suddenly, running away with their Debt ! You should be watching and pretending you dont know they are packing (some of them do it in bits ), inform the nearest Police Station of what is happening (It is a Crime!) and when the Tenant has moved out "most valuables", in a manner that can establish that they have or are moving out, BLOCK HIM from locking the Door and call the Police. At that point, you are trying to prevent a Crime from being committed and the Police can be involved. Make sure he cant get back inside, he has moved out by his own will and is no longer considered a tenant and is not covered by current Tenancy laws!. Seize some valuable Property at that point, unless he is willing to settle their Debt IMMEDIATELY. Make sure someone is Video-Recording this final phase, in-case the tenant wants to make some spurious Claim, afterwards. A tenant that cannot afford to pay his rent, is the one that can afford a good Lawyer? And who told you that the Quit Notice has to be from a "Law Chamber"? Can you cite the relevant Chapter of the Tenancy Laws that gave you such idea? Some of you sef, you can lead somebody to his grave and run back Moreover, let us assume he can afford a "good Lawyer" and the Landlord too can afford one. That means both Lawyers will meet in Court and at that stage, it is the JUDGE and what the LAW SAYS, that will determine the Outcome. So, does the law says a tenant can live in a rented property for Two years, without Paying or illegally? Will a Judge just "dash" the Tenants "good Lawyer", a false Judgment that does not comply with the Statutes? Judges just dont dish out Judgements, they are guided by the relevant Laws. clericuzzio: Mense profit and damages are two different things. Mense profit is any unpaid rent owed to the landlord. If the landlord wants that money and goes to court, the tenant must pay. |

Excuzeme: Thank you for this. So many Nigerians are ignorant about Tenacy laws. They believe tenants are entitled to perpetual accommodation as far as he has paid rent at one time. A rented apartment is a business. What business offers free products for two years? The ee-diot even mentioned quit notice must come from the chambers and all. Lol. Ignorance everywhere. I pray they jam a knowledgeable landlord. Their eye go clear. |

I will say this for the last time, the landlady does not need a reason to give a quit notice. Who are you to tell her how to run her property? He is a tenant not a shareholder. I think it's people like you that are part of the reason Nigeria is this bad and lawless. If you owe, you pay up. No one cares if you have to sleep under the bridge to raise the money. Business isn't run with emotions. Lastly, a landlord doesn't need a reason to give you a quit notice. If a landlord doesn't like you, he can give you quit notice, if you like take it to any court available in this country, you won't win. This goes to lack of shame being the reason that I think is the core of issues in this country. Once you lack shame then you can stop paying rent and glare comfortable at your landlord. It will also allow you to research ways to game your landlord. Life is easy. You have 12 months to gather your annual rent, just pay your rent. If issues occur that will waylay this then simply pack out. Pack into cheaper place, etc. Or work with your landlord on a plan. If your landlord gives you quit notice, abide by it. We are Nigerians with culture, why anyone would want to stay any longer than necessary in a place they are not wanted goes back to that lack of shame. 4 Likes 1 Share |

udatso: I think you are the most uncivil person not me, in a sane country no landlord just wake up and evict a tenant because he doesn't like the tenant, and besides if you are evicting someone the court order is to give such person six months to look for somewhere. Besides am a human that care and have conscious unlike heartless and wicked people like you and that landlady that think because you build one house you think you are God and can do what you like to your tenant. Anakazo22: Like I stated earlier, you are moved by emtions. In this case, the tenant said he was given 6 months quit notice. So what else do you want? By law, a landlord doesn't need to give you reasons to vacate his property, however he must give you quit notice corresponding to the tenancy agreement you have. And this landlady has given 6 months quit notice. Just in case you are unaware, quit notice is not similar to eviction notice. No landlord can just wake up and evict you but can wake up and give you quit notice. You can cry and get angry as much as you want but her actions haven't broken any known law to us in this country. Feel free to go to your sane country where 1. Tenant wants to be discussed with before rent is increased. 2. Tenant wants to be contacted always after his rent has expired to confirm his renewal status. 3. Tenant can boycott meetings without speaking with the landlord to know why he couldn't attend such meeting 4. Tenant insults the caretaker for simply telling him why he thinks he was being served with a quit notice. 5. Tenant who has been duly served a quit notice wants to show the landlord "pepper". The truth is, you can't even survive in a sane country cos you have no idea what a sane country is or should be. |

clericuzzio: Quit notice is usually given several months before the expiration of the one year rent that has already been paid for. Nobody gives quit notice after the rent has expired. So its not free. |
