The Federal High Court Sitting in Lagos has ruled that the Fundamental Rights Enforcement Suit filed by Suspected Billionaire Kidnapper, Chukwudumeme Onwuamadike popularly known as ‘Evans’ can proceed.

Justice Abdulaziz Anka dismissed the objections of Emmanuel Eze, the counsel for the third and fourth respondent and agreed with Counsel to Evans, Olukoya Ogungbeje that service on the Ist and 2nd respondent had been properly effected.

The first and second respondents in the suit are the Inspector General of Police, the Nigeria Police Force. The other respondents are the Lagos State Police Commissioner and the Special Anti Robbery Squad, SARS.

In his ruling, Justice Anka also held that leave was not required for the matter to be heard during vacation as Order 4 Rule 5 of the Fundamental Rights Enforcement Procedure Rules of 2009, enjoins the court to pursue speed and justice on issues of fundamental human rights.

In the application, the suspected Kidnapper, ‘Evans’ is challenging his continued detention since June 10 without arraignment.

He claims that his parade on June 11 before journalists at the Lagos police command headquarters in Ikeja, without a court order, is unconstitutional and illegal.

Evan wants the court to award him N300m as exemplary damages for his alleged illegal detention and the alleged harm caused by his media trial.

He has also asked the court to order the police authorities to immediately arraign him before a law court, or release him from custody.

MR EVANS has done well to represent his people and region.He has shown to Nigeria and the world as a whole that any criminal activity that emanate from this country must have been spearheaded by a member of the I-Pigs.

For this conspicuous reason,I will call for the urgent release of honourable Mr Evans to his kinsmen who awaits him.

The basis of our legal system (I'm no lawyer...but bear with me!)...is that everyone is

1.Innocent until proven guilty

2.Everyone has a right to a fair hearing in the courts.

3.Rights, even of crooks, must be respected within the limits of the law.

The Nigerian legal system has its flaws....but this isn't one of them. (After all in the UK...an illegal immigrant who knocked down and killed a child and got jailed for seven years for manslaughter...was able to successfully prevent the British govt from deporting him at the end of his sentence in the ECHR...European Court of Human rights).


If we can't be fair to bad gent Evans today...why should we be fair to good guy you tomorrow....or even innocent me?

They may bungle this case so much that the man gets a light sentence, or walks away altogether.

Nigerian police is a huge joke... they have never played by the book. I know the reason why there are so many awaiting trial cases is because the police is procedurally weak. If they were to take all those suspects to court, a huge percentage of them will walk free.

Not true, terrorists kept in Guantánamo Bay, Cuba sues the US government all the time in US court and sometimes they win, sometimes they lost.

Anyone charged with any offense even if red-handed and it does not matter if that individual confesses or not; he/she is assumed innocent until proven otherwise in a law court or the facts of their confession and content are fully adjudicated in the law court and as such, they have right like everyone else to sue and be sued.

All these arguments are because the guy hold some billions. Assuming it is this poor kidnappers, they would have been executed by now......After God, just do yourself a favour and respect anybody with enough money.
