Very good one. I will see how this will help when I am renewing my rent in January. My landlord doesn't pay common tenement rate. He shifts it to us, tenants.

I go look for trouble by paying 3 months rents. If he rejects it, then I will threaten to file a case against him for which he will be sentenced to 3 month imprisonment. grin

3months is quite unfavourable ,especially to landlords abi how many landlords go o court in Lagos state and we all know the judiciary system is terrible

Number 4 and number 12 are quite contradictory, I think. How can one be a yearly tenant when max rent payment is 3 months? Abi I'm misunderstanding something?

Can anyone knowledgeable about this clarify the law's position on rent payment by new tenants. Has there been a change, this was not indicated in the write up, only referred to payment by a sitting tenant.

Also, any mainland agents or landlords here that strictly adhere to Lagos tenancy law?

Pls, this article should be forwarded to Rivers state House of Assembly for celebration too. Ikwerre Landlords in Port Harcourt are using tenant to build mention because of high cost of rent. U need to visit stores and shops in Port Harcourt and see what business men and women are passing through.

Na the only thing way Lagos dey use f-up be dat, my tenant dey tell me 'patapata you will give me quit notice and I go still spend 6 months on top money I owe you ', to rent house out dey fear person, the law helps the tenant,, what of poor landlord that laboured so hard? For UK the day your rent expire you are in trouble

You can not compare the housing stock in the Uk to Nigeria, the law has to lean more to tenants, because the government has failed in the delivery of housing to its citizens. Giving more power to the landlord will be more disastrous.

To be sincere, I feel 3 months isn’t workable in a country like Nigeria, what housing means to a Nigerian is quite different to countries that pay rent monthly and quarterly. I think the year 1 thing should stay..... when tenants owing know quit notice lasts 6months, they’ll just pay 6months and spend the remains 6months on quit notice

This is a good development. But the 3months rent is not good for the tenants. Don't forget, NO COURT OF LAW CAN STOP A LANDLORD FROM INCREASING A HOUSE RENT.


Apartment of 1M/annum will now go for 450-500K/3months. Which is not cool. These people doesnt reason well before making a law.


We want to be like the western countries but our systems doesnt support their ways for now. Alot of things has been put in place before they make any law.


The state should find a way to reduce or subsidise building materials thats been used in the state first.

This is cool if can be well implemented. Nigeria as a country has one of the best laws globally, our problem is full implementation and bribery.

Nigerian Laws doesn't really make for good reading and understanding to be honest. They are not explicit and are always subject to interpretations and loopholes that lawyers can exploit and twist to their advantage.

While a part of the law says things like either of the tenant/landlord shall not collect rent in excess of three months, another section 12 is ascribing time-bound tenants like monthly, half-yearly, and yearly tenants which pre-supposes that the payment schedule is actually at the discretion of the initial agreement entered by both parties.

Infact, Landlords can easily spell out how they want their rents to be paid in an agreement and if a tenant append his signature to it, he is duty-bound to follow through with that.

Lawyers can help explain that part better if I didn't just get it Anyways, Landlords still have the upper hand in my opinion

If the terms of the agreement violate the statute, the contract would likely be declared illegal even though the contract was properly formed

Some of us are used to yearly payments. The law may prevent people from investing in investment property.

I pay annually for my business premises and it is cool by me.
