LEGISREPORTS NG – The Ad hoc Committee on the Review of the 1999 Constitution, which was constituted mid last year by the House of representatives submitted its report this afternoon before the House. urging the House to consider granting autonomy to Local Governments and allowing for independent candidature in future elections among other things. The Deputy Speaker of the House, Hon. Chukwuemeka Nkem Ihedioha and Chairman of the Ad hoc Committee, submitted the report.

As contained in the report, un-elected local government Chairmen would be barred from getting funding from the Nations treasury

The Deputy Speaker who briefed the House read the report The Constitution Alteration Bill attached to this Report is a reflection of Members’ Bills referred to the Committee after second reading and results of the Peoples’ Public Sessions on the Review of the Constitution.

As regards to Section 65, the Deputy Speaker proffered that “The Committee agreed to allow for independent candidacy in elections in Nigeria. This would however be subject to conditions stipulated under the Electoral Act”.
Below are highlights of contentious issues the report addressed;

Section 7: Local Government System: The Committee followed from the recommendation of the Peoples Public Sessions which clearly underscored the need to create independence and autonomy for local government councils and give the councils their deserved role as catalysts for development at the grassroots level. Accordingly, the Committee created a fixed uniform term of four years for local government councils and prescribed denial of appropriation to councils that are not democratically elected.
If the wishes of the committee are to be granted in areas of reforms, mode of election of local government officials, their functions, tenure, qualifications for elections, and other related matters, will be managed by the national election management body, INEC.

Section 8: New States and Boundary Adjustment: The Committee reviewed the provisions of section 8 to emphasize the importance of elected local government councils, by inserting alterations that will ensure that only elected local government officials can participate in the process for creation of new States. Also, clarifying that onlyregistered voters in a local government area can participate in a referendum for the creation of a new State.

Section 9: In this section, the Committee sought to clarify and remove ambiguities in language with respect to the alteration of the Constitution and further dispense with the requirement for assent of the president to be obtained for the amendment of the Constitution. The Committee came to the conclusion that the rigorous provisions for the alteration of the Constitution by members of the National Assembly and the participation of the 36 State Houses of Assembly represented such adequate participation of Nigerians and that assent of the President negated the principle contained therein.

Section 12: The Committee altered the provisions relating to Nigeria’s international treaty obligations, to provide for National Assembly’s ratification and enactment.

Chapter III Alteration:
In Section 25 report stated: ”In order to address the various conflicts and crises surrounding the question of who is an indigene or settler in the community, the Committee has redefined citizenship to take away this divide meaning that a person who has lived in a community for a specified period is entitled to the same rights and privileges as citizens of that community.

“The amendment under this chapter fully defines indegeneship in a way to eliminate the conflict that this has posed in the past”.

There-in Section 42, the Committtee stated that: “The Committee altered section 42 of the Constitution to specifically prohibit discrimination against persons living with disability”.

However, the Committee introduced a new section 45A – D To make ” enforceable certain socio-economic rights as fundamental rights and incorporating them into Chapter IV, the justiciable part of the Constitution, thus creating as justiciable, the rights to education, right to favorable environment, right to free primary and maternal health care services, and the right to basic housing”.

The Committee he said, also amended Section 66 “To give seriousness to the issue of electoral offence, the Committee decided that is now provides grounds for disqualification of a candidate from contesting elections where he has been found guilty of an offence. This is also applicable at the State level”

The Committee, according to Ihedioha, also reworked Constitution, “In order to entrench the independence of the offices of the Attorney-General of the Federation, the Accountant-General of the Federation and the Auditor-General of the Federation, and insulate them from political control, the Committee put this office on the first line change of the Consolidated Revenue Fund of the Federation”.

Section 80 was also altered and “strengthened the provisions of section 80 of the Constitution to plug leakages from the Consolidated Revenue Fund of the Federation and public funds of Nigeria to ensure that no expenditure is made by any organ of government without appropriation by the legislature”.

Sections 81 and 82, according to the Deputy Speaker, was altered by his Committee, “To ensure timely passage of the National Budget, and discipline in expenditure, the Committee stipulated that budgets be submitted by the executive for approval no later than ninety days before the expiration of the fiscal year.

In Sections 84A – C: ”The Committee included a new section in the Constitution creating a new office of the Accountant-General of the Federation and Accountant-General of the Federal Government to ensure that persons are appointed into these two separate offices for professional management of resources

The Committee also reworked Section 150 “To give effect to the results of the Peoples’ Public Session which voted to separate the office of the Minister of Justice from that of the Attorney-General of the Federation, the Committee made amendments to reflect this and insulating an independent office of the Attorney-General of the Federation from partisanship and to be managed by a professional lawyer. This is also applicable at the State level”.

In Section 153: Hon. Ihedioha told the House that “The Committee felt that the issue of electoral offences is of such importance as to warrant the creation of an independent electoral offences commission to handle it”.

The Committee also altered the contentious Section 162 of the 1999 Constitution “to abrogate State Joint Local Government accounts and empower each Local Government to maintain its own special account to be called “Local Government Council Allocation account” into which shall be paid directly allocations made to the localgovernment by the Federal Government from the Federation Account and from the government of the State”.

Hon. Ihedioha, said the Committee also altered Section 197 to abrogate State Independent Electoral Commissions(SIECs)

According to him, “to protect the integrity of the electoral process at local government level and respond to the complaints of partisanship of State Independent Electoral Commissions (SIEC) accordingly, it deleted the existence of SIECs and vested the power to conduct local government councils across the federation in the Independent National Electoral Commission (INEC)”.

According to him, the Committee amended “Section 201 and 3rd Schedule, Part I: Role for Traditional Rulers to “create a role for traditional rulers at the Federal and State levels providing for representation of traditional rulers in the National Council of States and the creation of a State Council of Chiefs at the State level”.

He said Section 214 of the Constitution was amended “to delete the word “Force” from the name of the Nigeria Police providing for the name of the Police to now be “Nigerian Police” rather than “Nigeria Police Force”.

The Committee also amended Section 241 ” to address concerns over delay in the courts by limiting the use of interlocutory appeals to stay proceedings in court”.

The Committee also altered section 315 this section of the Constitution as approved by the Peoples’ Public Session removing the powers of the President and governor of the State to modify existing laws”.

He said “Section 308 was amended In line with the results from the Peoples’ Public Sessions, the Committee also removed the immunity from prosecution from criminal offences for persons occupying the position of president, vice president, governor and deputy governor, and to stem impunity levels”.

Constitution Amendment: Presidents, Governors To Lose Immunity



Public officeholders who hide behind the immunity clause to steal will soon be licking their wounds, as the House of Representatives is set to withdraw the contentious clause from the constitution.

This is one of the recommendations contained in the report of the House of Representatives ad-hoc Committee on Review of the 1999 Constitution which is scheduled to be laid on the floor of the House today.

Among other things, LEADERSHIP gathered from a member of the committee who craved anonymity since the report has not been debated by the House, that the report also recommended, despite variance with the Senate, that two terms be maintained, with a four-year span for political officeholders including the president and his deputy.

On local government, the special committee headed by the deputy speaker of the House, Hon. Emeka Ihedioha, asked that a definite uniform tenure be provided for all local government officeholders in line with the request of the Nigerian public.

The committee had, last November, nationwide people’s public sessions held in all constituencies to collect input of the public on constitution amendment, the results of which were announced in a public presentation at the National Assembly earlier this year.

Key elements in the template used for the opinion gathering exercise include the granting of full autonomy, including financial autonomy, to local government administrations and removal of immunity against prosecution from the president, vice president, governors and their deputies, , particularly as ıt relates to criminal offences.

Others include rotation of the office of the president, scrapping of state independent electoral commissions (SIECs), state creation, state police as well as autonomy to state legislatures.

At least it might motivate the executhieves to work and distance their illiterates.. parading themselves as First Ladies and Philanthropists; as they give peanut handouts from LOOTED FUNDS. If we can't find any achievement in this new development I pray let the egyptian revolution spirit come to 9ja soonest.

I sense that NLers are vigorously going to debate these proposed changes over the coming weeks. They signal quite a radical departure in some areas and would certainly alter the calculus of political power to an appreciable degree.

It of course remains to be seen whether or not the recommendations resulting from a similar exercise in the upper house would be harmonised with this one, especially in light of yesterday's pandemonium which compelled a postponement of further deliberations till next Tuesday.

Ihedioha also disclosed that the committee threw out over 35 requests for new states, granted financial autonomy to local governments and approved independent candidacy in future elections. Also recommended by the committee was that a person who has lived in a community for a specific period of time should have the same rights as its citizens.

The House is now expected to harmonize the recommendation with the Senate ahead of the final amendment of the constitution.

Why should duly elected political office holders lose their immunity, therefore subjecting them to civil and criminal prosecution? Removal of immunity clause will generate a lot of distractions and would impermissibly interfere in the discharge of their duties. We cannot afford to have leaders whose energies are diverted by concerns with lawsuits thereby neglecting the effective functioning of government.

We already have an impeachment clause in the constitution, Impeachment should precede prosecution. Whenever an elected official is found wanting most especially in the areas of financial impropriety or misuse/abuse of power, such person should be impeached by the House of Assembly or the National Assembly and then face prosecution. What we should rise against is legislative docility, they should be alive to their statutory duties of scrutinizing the activities of the executive, check the profligacy and recklessness of the executive arm, and not to serve as an appendage to it. Removal of immunity clause will leave room for agents of the pull-him-down syndicate to hamstring the operation of government apparatus.

Having pondered over this issue for some time now, I have no qualms stating that my views are aligned with those who want the immunity clause expunged from our constitution. I understand the fears you cited but feel the attendant risk of interference from detractors and naysayers, which an elected official is likely to face, is a price worth paying.

It is either we bite the bullet now, through the adoption of extra checking mechanisms, or our politicians to continue pushing the envelope of impunity across new frontiers, as they have done for the past 14 years. The later is a luxury we can ill afford, in my opinion.

Here is a list of a few countries that cope just fine without an immunity clause -


Malaysia
In Malaysia, an amendment to the constitution in 1993 made it possible to bring proceedings against the king or any ruler of a component state in the Special Court. Prior to 1993, rulers, in their personal capacity, were immune from any proceedings brought against them.

Norway
Article 5 of the Constitution of Norway states: The King's person is sacred; he cannot be censured or accused. The responsibility rests with his Council.[9] Accordingly the monarch cannot be prosecuted or sued in his or her personal capacity, but this immunity does not extend to the state as such.

Ireland
In Byrne v Ireland, the Irish Supreme Court declared that sovereign immunity had not survived the creation of the Irish Free State in 1922, and that accordingly the state could be sued for and held vicariously liable for the acts and omissions of its servants and agents.

Belgium
Article 88 of the Constitution of Belgium states: The King’s person is inviolable; his ministers are accountable.

Australia
There is no automatic Crown immunity in Australia, although the Crown may be explicitly or implicitly immune from any particular statute. There is a rebuttable presumption that the Crown is not bound by a statute: Bropho v State of Western Australia. The Crown's immunity may also apply to other parties in certain circumstances: see Australian Competition and Consumer Commission v Baxter Healthcare.

State governors will oppose and frustrate the entrenchment and full autonomy of local governments in the constitution. It is left for Nigerians to rise against the stranglehold of state governors on local government. Local government system should not be tied to the apron strings of the state government.

Independent candidacy is a welcome development. In a country that has no decent history of internal party political democracy, where party leaders give away nomination certificate as though it were just a piece of paper. The independent option will stop politicians from running from one party to another, and also promote the culture of merit.

I hope they pass these amendments this time around because this isn't their first time of proposing them, only to dump later.

Knowing Nigerian politicians, they will take advantage of the removal of immunity clause to push forward fictitious petitions and open a floodgate of litigation in order to destabilize the polity and harass elected office holders. Even though I agree that we need to curtail the culture of impunity by this category of people(president and state governors), The argument for removal of the clause is already trumped by the impeachment clause. As soon as they leave office, they answer for their errors of omission or commission.

We need to understand that we have a corrupt justice system, if immunity clause is removed, corrupt public office holders will still use public funds to defend themselves(buy legal services), they can manipulate the process, delay their trials and even evade justice. Removal of immunity clause won't stop corruption!

Can a Chief Justice or judges appointed by the president or governors convict their benefactor? Can the EFCC or police boss appointed by the president sincerely investigate and prosecute him? We need to strengthen our institutions before thinking of removing the clause!

If they dont approve anything else, I want them to approve just the following:
1) Independent candidature ( Kill off the Tinubu-style selection process).
2) Local Government Autonomy ( Kill off the Godfatherism issues with states remitting security votes to brigands and thieves).
3) Zero Immunity ( lets punish criminals even those in power)
4) 2 Four Year Terms ( Anything else will reintroduce the impunity we are trying to correct).


My additional suggestions would have been:

2: a midterm referendum to allow the country or the Sole legislative body to pass a vote of confidence on the govt and if failed, call for early elections. That way we can kick them out earlier.

it won't see the light of the day. Removal of immunity is the problem of Nigeria rather the problem of Nigeria is the Judiciary that frees criminals who stole billions of naira and charge them 700k. If we can fix our judiciary that they will start sentencing corrupt Government officials to prison/deaths then any other politicians will be afraid to steal public money because at the end he/she knows that he/she must end up doing a lifetime or even getting hanged but reverse is the case.

Immunty clause is quite an entity that is different from the judiciary system. Infact, it is this immunity cause that actually corrupts the system.

I will tell u how:

A president, or a govnr, who under the foolish constitution of being immune to the law, will give orders directly to the judges on seat to overturn certain judgements. Only a judge who can really dare, will oppose such entity. And biliv me, he will loose his job without d govt being indicted!

And keeping ur job with some little cash will make most judges accept. With d clear knowledge that the entity is above the law!

But if this clause is gone, any wayward president, or govnr cld be set up with the right evidences and sentenced.

Even the activists knw it's futile fightin the govt. U can only get ur evidence against them, but u can't proceed a bit!!

I believe giving the local government full autonomy will make the LGA to do more at the grassroot level. And these might reduce the number of ghost workers at the grassroot, with more development at that level.
Let's hope politics will not play a role here.
