What Is Commercial Surrogacy?

Commercial surrogacy is the process in which an individual or couple pays a fee to a woman in exchange for her carrying and delivering a baby. At birth, the child is turned over to the individual or couple, either privately or through a legal adoption process. Couples with fertility problems, same-sex couples, and single people who
wish to be parents are the most common types of people who seek surrogate mothers. Some celebrities, including Robert
De Niro, Kelsey Grammer, and Sarah Jessica Parker, have used surrogates as recently as 2009.
Surrogate mothers may get pregnant through intercourse that may or may not involve the child’s parent. Other surrogacy contracts involve artificial insemination,
either at a clinic or at home. In vitro fertilization, a method wherein eggs are fertilized with sperm outside the womb, and implanted in the mother later, is less common for surrogates due to the cost involved, but it is a possible method.
In the United States and many European countries, the issue of commercial surrogacy is often scrutinized heavily by local and federal governments. Some U.S.
states ban surrogacy contracts altogether, while others allow them with certain restrictions. Surrogacy is legal in England, but agencies that charge a fee for finding a surrogate mother are not. As of 2010, surrogacy was completely illegal in France, Germany, Norway, Italy, and several other countries, regardless of whether it is for profit or not. Strict laws in such developed
countries have led to a rise in international surrogacy in lesser developed nations, such as India, which legalized commercial
surrogacy in 2002.
In the United States, many surrogate mothers are paid tens of thousands of dollars to carry a baby. The couple or individual paying the mother may also pay
for her medical expenses and provide her with other, non-monetary compensation, like transportation and food. In India, the cost of a surrogate mother is far less, and international surrogacy can allow people who want a baby to avoid many of the legal restrictions common in North America and Europe.
Countries that have declared commercial surrogacy illegal usually cite ethical reasons for the decision. Some see paying for a
surrogate mother as renting or buying the human body or a human life. Proponents of
surrogacy arrangements maintain that the process is mutually beneficial, allowing the pregnant mother to earn money, while
providing a child to people who may not otherwise be able to experience parenthood.

What are the Types of Surrogacy?
While all surrogacy arrangements involve a woman carrying a baby for another person or couple, there are two basic types of surrogacy. The first is traditional surrogacy.
With this type of arrangement, a woman is artificially inseminated with the sperm of either the intended father or a sperm donor. The child she becomes pregnant
with and eventually delivers is genetically her own baby, as her own egg is fertilized as part of the process.
Traditional surrogacy is typically employed when a single heterosexual or gay male wishes to have a child and does not have a suitable female partner for carrying the baby. It is also employed when a woman wishes to have a baby and her eggs are
unsuitable for some reason. For example, if a woman's eggs are not viable or she has an inheritable genetic condition that could put her biological child at risk, she may choose to contract with a traditional surrogate instead.
Gestational surrogacy is the most common of the two types of surrogacy. With this type of arrangement, a surrogate mother is impregnated with the egg of another woman; the egg is fertilized by the sperm of the intended father or a donor prior to implantation, via a process called in vitro fertilization. In such a case, the surrogate mother is not genetically linked in any way
to the unborn child. For this type of surrogacy, the surrogate mother may be required to take fertility drugs to ensure successful impregnation.
Besides the two basic types of surrogacy, these arrangements are often categorized according to whether payment is exchanged or not. For commercial types of
surrogacy, the surrogate mother is typically paid a fee to compensate her for her participation. This fee will cover not only her medical expenses and any other expenses related to the pregnancy, including travel arrangements, but also a sum for her time and effort. In some cases, surrogacy fees can amount to thousands of dollars in compensation.
The other monetary categorization for surrogacy is the altruistic arrangement.
With this type of arrangement, the surrogate mother agrees to become pregnant with and deliver the baby of another person or couple without any monetary compensation. However, in this
case, she may still be reimbursed for medical care and other pregnancy-related expenses. The difference here is

that she
will receive payment above and beyond the
things that are related to the pregnancy.

What Are the Pros and Cons of Surrogacy?
Surrogacy involves a woman carrying a
baby to term for a couple that has had
trouble conceiving. Not surprisingly, due to
the complexity of this type of arrangement,
there are various pros and cons. One of the
most worrisome issues is the possibility of
the surrogate mother refusing to part with
the baby after he is born. Additionally, there
are often high costs involved with this
procedure, as the childless couple typically
pays the medical costs of the surrogate
mother, along with a fee for providing this
service. On the other hand, surrogacy is
often one of the only ways for a couple to
have a biological child, and it can also allow
the surrogate to greatly help someone in
need.
One of the problems with surrogacy that is
most often discussed is the possibility that
the surrogate mother will not be able to
hand the baby over to the infertile couple,
as most women develop a bond with the
baby they are carrying. This issue is
especially likely when the baby is
biologically the surrogate mother's, as in
some cases, she may provide her own egg
for the pregnancy. Some surrogate mothers
may also refuse to part with a baby that is
not theirs biologically, as some couples
provide the sperm and egg so that the
surrogate is only the gestational carrier. The
chances of this issue occurring can be
reduced by both using legal contracts, and
performing psychological screenings for
potential surrogates, but of course there is
typically no way to know for sure if this
problem will occur.
The costs of surrogacy are typically high,
which means that childless couples who
want a baby must have money to spare.
They are usually responsible for paying the
medical costs of the surrogate mother
throughout the pregnancy, but they also
often have to pay a large fee for this service.
This allows the surrogate to be
compensated for being pregnant for almost
a year of her life, especially since it may be
difficult to work a regular job for at least
part of the pregnancy. Of course, the costs
of surrogacy are usually on par with both
fertility treatments and adoption.
This arrangement may be the only way for a
couple to have a child that is biologically
their own, as some women have no
problem conceiving, but cannot carry a
pregnancy to term. Thus, a couple may
choose a surrogate, and then begin the
process of in vitro fertilization, which
involves mixing the sperm and egg so that
the embryo can be implanted into the
surrogate mother. On the other hand, some
couples have either male or female factor
infertility, barring them from conceiving on
their own. In such cases, the healthy sperm
or egg may be mixed with donor egg or
sperm, and then placed inside the
surrogate. This can allow the couple to have
a child that is related to at least one of
them, which is not a possibility with
traditional adoption.
Finally, surrogacy is often a good way for
some women to help others using a unique
method. In fact, some women enjoy being
pregnant, but do not have enough money
to raise another child, which may prompt
them to get involved in surrogacy.
Additionally, this service can allow the
surrogate to make some extra income
while doing something she enjoys and
which she feels is deeply meaningful.
