The Chief Judge may simply be reassigning d cases, maybe to even fasten up d cases that hv been crawling in courts for upwards of 10 yrs in sm cases...... By d way, d GEJ Govt just a few days ago removed d nation from d Watchlist of d Financial Action Task Force (FATC), a long process that was painstaking and extensive, and one that hv radicali improved transperancy in d Financial transactions (both Private and Govt) in Nigeria. By d way, for such a huge event, to my knowledge SR hv not even considered reporting d feat. #heightofhypocrisy

I regret ever encouraging poeople to viote for GEJ. Now most Nigerians don't know if they should vote for fanatic Buhari or this same Jonathan. Its really difficult but in the end corrupotion is killing a lot of innocent people who should benefit from govt. So any body else but buhari or jonathan will do

We are truly a very GULLIBLE set of people- believing any story without checking how it measures up to standard procedure of operating in the concerned environment and situation.
We have a very long way to go indeed as we wait for some messiah in khaki & boots or sarong & sandals rather than use our God-given brain and time to enrich ourselves continuously with ever-increasing KNOWLEDGE about out immediate & relevant environment.

You should obtain the reason for such withdrawal before drawing conclusion that it was ordered by His Excellency. The Chief Judge is waiting to take your questions. Go to him and stop blaming President Goodluck for everything.

Now can someone tell me reasons why Jonathan can know his way back to Aso Rock come 2015? A clueless president who has practical failed in all the spheres of the nation's interest? NASS whose job are to propagate "check and balances" in the presidency are there doing nothing than looting thier own? Is a reason like this not enough for Mr. Clueless President to be impeached? The leaders are stealing and destroying the future of the youths and the generation unborn and are going scot-free, is this not enough why the youths shld stand up to tell the leaders "enough is enough"?

#225,000,000/160,000,000 Nigerians = #1.41.

So if the money is to be shared among Nigerians, we will collect #1.41k each, not #1,000,000

The newly-appointed Chief Judge of the Federal Capital Territory (FCT) Justice Ibrahim Bukar, today in Abuja withdrew the case files of former Nigerian governors undergoing trial for corruption.

How many cases are NOT being handled in Abuja?
I seem to remember that at least Gbenga Daniel and Akala are NOT being tried in Abuja shocked shocked
Apart from the fact that a CJ cannot withdraw cases, since only the PROSECUTOR who initiated the case can do so.
When emotion overtakes reasoning, I guess one becomes an easy pawn in the game of power!

The EFCC is this morning arraigning former governor of Ogun state, Otunba Gbenga Daniel before Justice Olarenwaju Mabekoje at Court 4, State High Court.

Gbenga Daniel who came into the court at 9:08 am, quickly excused himself to the toilet. Proceedings resumed upon his return at 9:20am and Counsel to the EFCC, Rotimi Jacobs, SAN, read out the prosecution's charges.

The Court's attention was then drawn to a notice which was confirmed to have been received by Counsel to Daniel. However, the Counsel sought for a further 30 minutes break to study the document which the Judge agreed to.

Meanwhile, outside the court premises, supporters of Gbenga Daniel and students drawn from several tertiary institutions have been engaging each other in war of words, with both parties chanting opposing messages - for and against Daniel - at each other.

The Court has adjourned till October 15 when it will hear the bail application against Gbenga Daniel. He is to be remanded in EFCC custody until then.

When the issue of remanding him in custody was mentioned, Prosecuting counsel sought to get clarification from Daniel's counsel if he was averse to him being remanded further in the custory of the EFCC, especially following statements earlier credited to him, claiming that his client had suffered abuse at the hands of the Commission's operatives and that he was presently on hunger strike.

However, counsel to Daniel said he had no objection to his client remaining in EFCC custody despite the earlier claims.

And this one is about Alao-Akala's trial in Ibadan, Oyo state not in any phantom Federal Capital Territory court where a CJ who has no such powers can be repoted by SR as having withdrawn cases against ALL governors.

An Ibadan High Court presided over by Justice Okanlawon Akintunde Boade Wednesday declared that a former governor of Oyo State, Christopher Alao-Akala and two others have cases to answer.

Alao-Akala and the two accused persons are standing trial on an 11-count charge of corruption slammed on them by the Economic and Financial Crimes Commission (EFCC).

Boade, who ruled on the preliminary objection brought by the accused persons to quash the charges against them, insisted that the trio must explain their roles in the charges preferred against them.

The 11-count charge border on conspiracy, illegal award of contracts, obtaining by false presence, acquiring properties with money derived from illegal act, and concealing the ownership of such properties.

Counsel to the accused person, led by Lateef Fagbemi (SAN), had filed a preliminary objection, asking the court to quash the charges as they did not disclose any substantial evidence to warrant the accused persons standing full trial based on the allegations.

The defence counsel had asked Justice Boade to strike out or dismiss the charge, noting that it was sheer oppression and abuse of power to put anybody on trial on an offence that was not proved.

The prosecution led by Mr. Godwin Obla, however told the court that the plethora of evidence adduced by the EFCC against the accused persons deserved an explanation.

He prayed the court to discountenance the application seeking to quash the charges.

Justice Boade in his 40-minute ruling yesterday, said the application to quash the charges was not meritorious and consequently dismissed it.
According to him, the three accused persons have some things to explain, stressing that: “I am of the strong view that the proof of evidence is established against the accused persons.”

He said having taken the pleas of the accused persons in line with the provision of Section 167 of the Civil Procedure Law, the accused persons could not challenge the jurisdiction of the court.

The court held that Alao-Akala was a public officer and so could be tried by the EFCC and added that the proof of evidence has disclosed prima facie case that will warrant him being questioned.

Leading the defence counsel yesterday was Mamman Osumor (SAN), who after the ruling, commended the judge for his industry, but said, “notwithstanding, we do not accept this ruling as a correct position of law.

“For we the lawyers, who are counsel to the three accused persons, our legal opinion is that the position taken by the judge is erroneous in law. But because we are not the litigants, or the accused persons, we will await further instructions from our clients,” Osumor said, indicating that the ruling might be appealed.

Osumor, therefore, requested that the Certified True Copy (CTC) be ready on time, and which the judge said would be ready within seven days.

I have some knowledge of the Judicial system.

I can tell you that yes a Chief Judge can cause cases to be systematically killed off. Those saying Nigerian system doesn't permit a Chief Judge to do this or that are naive.

Does Nigerian law grant the NCAA responsibility for purchasing cars for the Minister of Aviation's use? No.
Does budgeting protocol permit a Minister of Aviation to commandeer an independent agency under its Ministry to purchase a fleet of cars for her personal/official use? No

But in practice, these things happen because for the most part, people always want to curry favour with their boss, hence they will go along with the boss.

In Nigeria, there's a big gulf between what the law, rules, procedures say and what officials do in practice.

Abuja High Court Judges are not from a different planet. They are Nigerians, so to hold them to a superficial and unrealistic standard of behaviour is naive. There's a lot of 'paddy' 'paddy' in the judicial system. Every High Court judge has aspiration to become a Chief Judge some day. Being seen to be 'stubborn' will not help.

Remember that the Chief Judge plays a big role in determining which Judge sits over a case - if he wishes to kill off a case, he will simply allocate those cases to those judges that can make it happen. He would know which Judge can do the dirty job, and which one not to approach.

Also, those saying how can Abuja Chief Judge kill off cases that are outside of his jurisdiction ie., Federal High Court, Appeal Court, Supreme Court.

But the news report does not suggest that this is what is happening. The report clearly relates to cases within the purview of the Abuja High Court, and most of the type of cases in question were started and are still at the Abuja High Court. If you can sabotage the cases at that level, then it will be left for the EFCC to appeal, and we know that organisation is even more corrupt and incompetent.

Just to add that systematically killing off a case is different from withdrawing a case. A Chief Judge cannot and will not do the latter as it will be too obvious. But using the system and personnel to kill them off slowly - that's doable.
