Jama’atu Nasril Islam (JNI) has denied issuing a death fatwa on Malam Muhammad Bello Masaba Bida for marrying 86 wives but that it only condemned his act and advised him to repent. The Islamic group said it has no legal authority to pass such a death sentence.
The clarification which was contained in a press release issued yesterday, said JNI only informed Malam Bello Bida of "what could have happened to him under a strict Islamic injunction for anybody who deliberately misinterprets the Holy Qur’an and Hadith and refuses to repent."

The statement noted that as an organisation which preaches Islam through peaceful coexistence and dialogue, JNI "will not resort to such hasty decision as was widely and wrongly speculated." The Islamic group said that it merely responded to the challenge which Malam Bello Bida threw to Muslim scholars to "show him relevant portions of the Qur’an that limit marrying only four wives and also the type of punishment that will be meted outfor such act.

Signed by Sheikh Usman Babantune and Alhaji Abdulkarim Mu’azu, the statement said that JNI wishes to clear the wrong impression which has been "circulated by a section of the the media that it has passed judgement and sentenced Malam Bello Bida for marrying more than four wives.

However, in an earlier press release issued on August 18, the Fatwa committee of JNI had decreed that "any muslim that marries more than four wives either by mistake or out of ignorance, is instructed to choose but only four and seek Allah’s forgiveness."
In addition, a Muslim who marries more than four wives in contradiction to the instructions of the Prophet (SAW), is not a Muslim, the fatwa noted. It further asked the erring person to repent within three days and if not, he "shall be sentenced to death according to the shari’ah"

Also, Shiekh Ahmad Muhammad Sanusi Gumbi, a Kaduna-based cleric said yesterday the JNI had no right to pass a death sentence on Malam Mohammed Abubakar Masaba Bida for marrying 86 wives because only the authorities can do so.
Sheikh Sanusi Gumbi was reacting to the alleged Fatwa which was issued by JNI’s committee of ulamas which gave Malam Mohammed Masaba Bida the option of either divorcing 82 of his wives and remain with the Islamically prescribed four, or face a death penalty.

According to Sanusi Gumbi, only a governor or the president can execute such a sentence and not even a court can do so. The court, he pointed out, "can only give judgement but it can not execute the sentence.’’ For this reason, it is wrong for JNI to have issued the Fatwa, he added, although he claimed that he has not heard the directive himself.

The Islamic cleric further said that spilling a Muslim’s blood is permissible in only three instances; "if he commits adultery and it has been proven that he did it, if he kills another Muslim, or if he goes out of the religion." He said that JNI has a standing committee of ulamas that is responsible for looking into such intricate matters should they arise and issue a Fatwa if necessary.

Sheikh Sanusi Gumbi said that he doubts if the entire members of the committee had sat down before the verdict was handed down on Malam Mohammed Bida. "If all the committee members had sat down, may be this kind of answer wouldn’t have arisen,"he added.

Malam Mohammed Bida can not be accused of adultery, he also said, because he has exceeded the Islamic limit of four wives. "A Muslim can’t be accused of adultery if there is some ambiguity; since there are some sects around the world that believe in this interpretation of the Qur’an, he can’t be accused of adultery, the Sheikh said.

However, Sheikh Sanusi Gumbi said that what Malam Mohammed Bida has done is haram, which is a sin in Islam. He further said that deeds that are considered as haram are "not necessarily offences that necessitate the spilling of a Muslim’s blood." According to him, Islam prescribes the marrying of up to four wives "because of peaceful co-existence within the ummah (Islamic community) and justice." He wondered how Malam Mohammed Bida "can satisfy 86 women in accordance with sharia."

The Etsu Nupe, Alhaji Yahaya Abubakar has given the man with 86 wives a two-day ultimatum: Retain four and divorce the rest or leave Nupe land.

Under Islamic law, a muslim is allowed to marry not  more than four wives but Muhammed Bello Abubakar Masaba Bida has over the years gone ahead to accumulate a harem of 86 spouses.

The Jama’atu Nasurul Islam, an umbrella organisation of emirs and top muslim clerics weekend wrote the Etsu Nupe and chairman Niger State Council of Chiefs to summon Bello and explain the law to him. 

The Etsu Nupe did exactly that at a meeting with Bello  which was also attended by Muslims leaders. He said the safety of the man could not be guaranteed if he failed to abide by the instructions.   

The meeting where the fate of Bello was decided started around 12noon at the Etsu Nupe’s palace in Bida, with the Acting Chief Imam of Bida, Mallam Adamu Yakatu, reading out the relevant part of the scripture and other stipulations regarding marriage to the 84 years old man.   

Yakatu, who made refer ences to Bello ’s interview as contained in the press both electronic and prints, said his offence included having 86 wives which he said is against Islamic tenets.   He quoted  several verses from the Quran to buttress the point, but Bello in his response said he had stopped reading the Quran and that he could recall any potion in the Holy Book that says one should not marry more than four wives, adding that he had read the Quran several times before he stopped.   

He claimed  1972 was hit by a strange wind and as a result he became unconscious. He also said  20 years ago after meeting Allah he stopped reading the Holy Quran. 

He denied ever saying he was a  prophet but claimed that he had seen Prophet Muhammad. But when the Imam reminded him that the Holy Quran stated that no one can see Allah, he insisted that he had seen Allah.   

After much argument, the Etsu Nupe made his pronouncement saying that “From the facts available to us, you are not a true Muslim and you are hereby given two days to divorce 82 wives from your 86 wives and if you fail to do so, we cannot guarantee your safety in Bida and the entire Nupe kingdom and as such you should pack your load and leave.”

The Etsu Nupe said he was convinced Bello has mental problem and advised that he should see a psychiatric. Bello, in his response sought for two weeks against two days pronouncement by the emir for him to ponder over the ultimatum.   

According to him, “to reduce the number of wives needed a lot of negotiations and one had to think of the children and what becomes of them”.   

The Etsu Nupe in his response said the Sharia Commission in the state would take care of the 82 women divorced while the social welfare department would take care of the children.     

Etsu Nupe declined Bello’s request for two weeks. He also said he did not agree  the man hailed from Bida, adding that every available evidence to the emirate council reflected that the man came from Lokoja not Bida.

divorce extra wives for who to marry them. you are not being fair at all to those married women; I mean legal wives indeed. this advice is wrong whether from sharia or from other wise.

After all Muhammed whom he claimed to have seen married 15 wives - good example. Muslim should follow all the foot step of their prophet.

Sharia means laws from Qur'an. Qur'an is the words of God, Allah the Almighty Lord of all. Comprende, seniorita May Kelly? lol. You need sharia laws in your life. Queenisha said you should marry a muslim, since she missed the boat, at least for now herself. I hope you are ready, there is a muslim around the way for you. I can see you wearing Hijab, even though Queenisha said you will be fine in holeless Burqa! She, Queenisha can wait until Oga reverted to Islam and she can legally put her own Burqa on, instead of tinnie winnie black dress she is hoping to wear out there.

There are some things that are meant for Prophe Muhammad (as), alone. One of them is the more than 4 wives, at a time. For example, none of his wives, is permitted to remain a Jew or Christian. Yet the general population of muslim males, and no t females are permitted marry from the Jews and Christians. Their Jewish and Christian wives are not to be forced to revert, but can continue to practice their religion.
