Legal Instruments Buhari Used To Traumatize Nigerians by uprigtd: 4:50pm On Jan 14, 2015
Here are some of the draconian decrees Buhari’s illegal
administration used to traumatize Nigerians when he
was the Head of State
I have listed them in chronological order, this way the
escalating fascism of his admin can be clearly perceived.
Federal Military Government Constitution (Suspension
and Modification) Decree Number 1, 1984
“No question as to the validity of this or any other
Decree or Edict shall be entertained by any court of law
in Nigeria”
This decree vested the Federal Military Government
(FMG) with power of life and death over all Nigerians
and gave it supremacy over all strata of Nigerian society.
Federal Military Government State Security (Detention of
Persons) Decree Number 2, 1984
This decree allowed the FMG to detain anyone it
suspected of
“acts prejudicial to state security or . . . [contributing] to
the economic adversity of the nation.”
The decree also authorized any police officer or member
of the armed forces to detain and imprison such
individuals.
The Nigerian Security Organization used this as
justification to fill the cells of its 15 Awolowo Road Lagos
HQ with Nigerians on a daily basis based on nothing but
suspicion.
Federal Military Government Recovery of Public
Property (Special Military Tribunal) Decree Number
3, 1984
This decree set up special tribunals run by military
officers, the goal of the tribunals was to determine if
public officers who were locked up on presumption of
guilt could prove their innocence.
Over 600 political figures were locked up under this
decree, some like Odumegwu Ojukwu had not even held
public office in the 2nd Republic.
Federal Military Government Public Officers
(Protection Against False Accusation) Tribunal,
Decree Number 4, 1984
This decree stated that anyone who brought the Federal
Military Government into disrepute via a publication of
any sort was automatically guilty, and those locked up
on presumption of such guilt were responsible for
proving their innocence.
Under this decree, Haruna Adamu (Punch) who had
written an article critical of Buhari in 1980 http://
/6fr30E) , Lade Bunola and Femi Kusa (Guardian)
http:///4AhJkN, Duro Onabule (National Concord),
A.B Ahmed (New Nigerian) were detained and released,
while Nduka Irabor and Tunde Thompson (Guardian)
were detained and charged (http:///NDt5L2).
Federal Military Government (Supremacy and
Enforcement of Powers) Decree Number 13, 1984
This decree enforced Decree Number 1 by stating no
court of law could act on any decision taken by the FMG.
Federal Military Government Special Tribunal
(Miscallaneous Offense) Decree Number 20, 1984
This decree proscribed death by public execution as the
penalty for ‘miscellaneous offenses’ including but not
limited to drug dealing, arson of public buildings, illegal
bunkering, tampering with NEPA Cables, tampering with
NET cables, importing or exporting minerals without the
proper license, etc.
Thankfully, only the drug dealing provision of this decree
was utilized before Buhari was kicked out of office,
under it, Bartholomew Owoh (26), Lawal Akanni Ojulope
(30) and Bernard Ogedegbe (29) were executed. Suffice
to say, if Buhari had stayed, there is no reason to doubt
the other provisions would have been used as the basis
for murdering even more Nigerians.
Many of the aforementioned decrees were applied
retroactively, and most treated Nigerians as people who
were guilty until proven innocent.
