Four plaintiffs have asked the Federal High Court in Abuja to order the postponement of the general elections scheduled for February 14 and 28 till when all eligible voters have their Permanent Voter Card.

The plaintiffs who claimed that the Independent National Electoral Commission had yet to issue them their PVC, are Asogo Torkuma Venatius, Ola Solomon Oluwasanmi, Sunday Attah and Philip Agbese.

Insisting that INEC was under statutory obligation to provide them with the PVC, they are also asking the court to order the use of Temporary Voters Card for those who are unable to collect their PVC.

They argued that should the election be allowed to go on, “millions of eligible voters stand the risk of being disenfranchised.”

Their counsel, Mr. Amobi Nzelu, who filed their suit with number FHC/ABJ/CS/DW/2015, joined the Independent National Electoral Commission and the Attorney-General of the Federation, Mr. Bello Adoke, as the first and second defendants respectively.

In the plaintiffs’ statement of claim, they said contrary to the promise by INEC in 2014 that it would issue all eligible voters with PVC before the February 2015 election, only few days to the polls, about half of eligible voters were yet to obtain theirs.

The statement of claim read in part, “Till date, over 40 percent of eligible voters who were registered by the 1st defendant for the upcoming general elections were yet to receive their Permanent Voter Card.

“There have been several protests all over the country against the decision of the 1st defendant to go on with the conduct of the general elections without distributing the Permanent voters Card to millions of registered voters all over the country.”

The statement added, “The Electoral Act does not make the PVC a condition precedent for registered voters to cast their votes at the general elections.”

The case has not been assigned to a judge and no date has been fixed for the hearing of the case.

@jars9, these your pictures are hilarious, truthful and on-point. I have saved them and will use as needed.

@topic: I have my PVC, I've had it as far back as 2014. Whenever the elections hold, as long as God gives me breath and health, I will be out to vote Goodluck Ebele Jonathan, I will make sure my vote counts.

This case is as baseless as the people that instituted it are worthless.
-They claimed over 40% of eligible voters have not collected their PVCs.
Big lie because as at last week,INEC said about 65% have collected,leaving about 35% uncollected as at last week.
-They want INEC to wait till all registered voters have collected their cards.
Rubbish.@least 10% of cards wud remain uncollected from a combination of the following reasons,bearing in mind we talking of a registration exercise that took place 4yrs ago:
deaths,distant relocations,travel,immobility due to hospitalizations, people who have lost their PVCs and can't locate their reg points; some people registered at any convenient place they found then;e.g,there are cases of people who were just passing a point,saw it going on and got registered, they don't av any serious desire to collect their PVC.
-What finally makes this case fit for the wastebasket it belongs is this:so if one decides not to collect his/her card for ulterior motives,that person can run to the court and get an election shifted?
Registration for voting and voting itself are voluntary not obligatory acts.The duty to vote lies on the voter and this starts from making effort to get registered and collecting one's card.INEC cannot be expected to register someone,beg the person to collect and then deliver the card to the person's bedroom.
I bet these litigants are paid PDP agents who have either hidden their cards or collected but self destroyed them.

If this elections are postponed, Jonathan and the FG will not be able to handle the fracas that will follow, these are signs of desperation by the corrupt and thieving ruling party.

Jonathan, must you remain the president of this country angry

I hope GEJ knows what a "flawless victory" is, he will witness it first hand by the morning of 15th feb and it will dawn on him that otuoke is home

Well In Nigeria, anything Goes.
When there is no discipline. Orderliness nor plans.

4years was enough time for INEC to prepare for this election, why postponement?
The staffs will go to the office doing nothing rather collecting salary and watch movie, eat boli and epa, now they have too much job on there neck after so many piled up of unattended jobs.

In everything we do in life, the total time wasted is the time taken to get started.
PVC should have been distributed by over 90% even before 2015.
Somedays to go now they want election postponement.

Whereas, so many people have relocated from where they got there TVC from, some are dead, some have traveled out of the country,some have lost there TVC, some are no longer in existence, so those once where is there statistics.

Shai: No wonder my father still before his death always keep reference to Buahari/Idiagbon regime cos it was all about discipline.

Well in my own opinion they want more time cos the rate of people chanting for changes are just so much.

We don't need postponement of election for the purpose of collecting PVCs. We need a day (or two) public holidays for that otherwise people should be allowed to use their temporary voters cards for the election. No postponement.angry

Today is just 3rd February. Using 10th as a benchmark, that's 7 days allowance from today. Why don't these lawyers push for a 3-day public holiday for citizens to get their PVCs if they are really truthful about their motives?

INEC has declared that PVCs are now ready so I expect the government to create a friendly environment for citizens to collect their PVCs and that can only be acheived through a public holiday.

Postponing the elections is suspicious and there's definitely a hidden agenda behind it. There's about 11 days left to elections. Government should declare a 2-day public holiday and stop fooling around trying to create chaos by postponing the electios.
