Justice Abdulfatai Lawal of the Lagos High Court, Igbosere on Friday ordered the Lagos State Independent Electoral Commission (LASIEC) to conduct local government election in the state within 30 days.

He gave the order while delivering judgment in a suit brought before the court by the National Conscience Party (NCP) against the state and LASIEC.

The NCP had instituted the case in January 2014, to challenge the appointment of caretaker committees to run the affairs of local government councils in Lagos State and sought an order of mandamus to direct LASIEC to conduct elections into the council.

The NCP legal team was led by Mr Ebun-Olu Adegboruwa,a Lagos-based human rights lawyer while Mr Lawal Pedro, SAN, led the team of lawyers for the state.

Justice Lawal also held that the appointment of caretaker committees over the administration of local government councils in Lagos State, is illegal and unconstitutional.

According to the court, no governor is empowered by the constitution to take over the administration of local governments through sole administrators or caretaker committees.

The court held that the Lagos State Local Government law, which allows for the appointment of caretaker committees, is illegal and unconstitutional.

Lagos can't conduct local govt election.

What is overdue. That justice have no power to give such order.


You can't have local government.


Because the justice is not from western Nigeria. He does not know. This justice is suppose to take bar exam inside the country of western Nigeria.
