Truly, it is absurd!
Many voted for the candidate not the party. Now that the candidate voted for is gone, a fresh election or the next candidate with the higher score should be ushered in!
AUDU should not be usurped!
APC=Audu, Audu is not =APC!he joined the party to be voted for,the party didn't join him.APC gave him the ticket and conducted the primaries to choose him as a representative of the party and the people.besides, he has a running mate that is also entitled to the vote casted,still alive and healthy.I'm not in support of Audu though,but I think that decision is just the best.moreover, it can happen to any party.

PDP should go and sit down. They've lost the election already, so, what are they saying? They disagree with the legal opinion of the AGF and the decision of INEC but failed to offer their opinion on what should happened considering the legal quagmire that followed Audu's death.

Anybody or party that is not satisfied with INEC's decision should simply go to court. No need for any long story.

Amaechi was firstly the right candidate who won the Primary , he won in the court because he won the primary but OBJ sub-bed him, so was seen as the one the ppl were voting for not Omeha. Amaechi was "UNLAWFULLY " substituted, the word is unlawfully, so APC cannot unlawfully substitute Audu. INEC should conduct another election period.

But INEC will not. And neither the INEC chairman nor the AGF will resign. So you can choose to accept this or you know where the nearest lagoon is cheesy

Oh, it's going to be a glorious few years watching the PDP flounder in opposition.

I predict Metuh himself will decamp to APC in the next few years.

But actually, since the deceased is yet to be 'duly elected' as prescribed by the constitution.
Pdp should aproach the supreme court and Annul the poll.

The constitution and electoral act are both silent in the event of the present situation in Kogi state. So therefore, it is left for INEC as the umpire to take a decision based on the spirit of the law and what they can infer to be the intention of the drafters of the law. If PDP is not satisfied with INEC's decision, they should go to court.

When constitution is silent then, INEC must not take decision. INEC should go to supreme court for interpretation of law.

And through the interpretation of law, party logo is always on the ballot paper not candidate. And in this case the running mate can be substituted for the deceased and we move on to the next level.. Just my cents.
If Audu had died before the commencement of the elections, it would've been cancelled even though it is APC logo that is on the ballot paper. That's how important a candidate is.

In Amaechi's case no fresh primaries were conducted. That's the difference. Fresh Primaries is not done when elections has commenced! It contravenes sections within the Electoral Act. INEC should have continued with the election with Faleke as APC candidate.

Why didn't the running mate continue the race since he shares a joint ticket with Audu? Why is APC conducting another primaries in the middle of an election?! The Courts will nullify this election if APC conducts this fresh primaries in the middle of a gubernatorial election.

That would have been worst, Faleke didn't contest any primaries, we all saw what happened in Taraba where a governor was removed from office cuz of "primaries wahala" and hope you know deputies are assigned to the governors after primary elections

And after the election, is it the name of the party that would be written on the certificate of return or the candidate that contested for the position under his party? The candidate is as important as the party so stop saying party was voted for not candidate.

If the candidate name will not appear on the certificate of return then you are right it is only party that is recognized.

The Supreme Court had once ruled that a governorship candidate of a party and his deputy shares a joint ticket. So Faleke is the legitimate person to continue with the elections (the election is still ongoing in the eyes of the law) and not a new candidate from a new primaries when elections is ongoing!
