LIVE, SUPREME COURT, 12.20pm: Counsel for Udom Emmanuel, PDP , ors ejusdem generis are contending that the court of appeal erred when it ruled thus on the number of accredited voters. "From the state of the evidence therefore, the total number of voters accredited by the card readers is 437,128...the votes of 1,122,836 cast on the date of the election as declared by the 3rd respondents, was in excess of the number of voters accredited with the card readers by 685,708 votes" The lawyers are instead arguing that according to INEC'S EXHIBIT EEEE1, the total number of voters that were accredited for the election was 1, 122, 836. They insist that it is the position of the law that the law presumes the regularity of the election results declared by INEC meaning the number of accredited voters for the election and the onus is on the petitioners (Umana) to rebut that presumption. Udom's lawyers contend that the appeal court ignored all the INEC witnesses DW 24, 25,26,26 and DW 27. In their respective evidence in chief, the INEC witnesses acknowledged that there were card reader machine challenges during the election in consequence whereof " the process of accreditation preceded as was expressly provided for in the Electoral Act". The INEC guidelines actually contemplated that these mechanical failures of the card reader. The court is still on adoption of written briefs accompanied by short arguments. And states as follows: Olanipekun says the judgment of the Tribunal was based not only on Card Reader but on the totality of the election including: 1. Accreditation 2. Voting 3. Collation Etc -------- Olanipekun says all the Voters Register for all the polling units in Akwa Ibom State were tendered. ------- Olanipekun says this was the only case where the governorship candidate of three political parties and a former governor gave evidence that they were not allowed to vote. -------- Chief Olanipekun says this is the only case before the Supreme Court where ballot papers were tendered. --------- Olanipekun says INEC admitted that ballot papers were bungled up. --------- Olanipekun says video clip was tendered showing that there was no collation at the State Collation Centre 1 Like |
