Mimiko and Jegede should accept defeat and realign before it is too late. There is really no point in beating a dead horse, Jimoh Ibrahim will be PDP's candidate in the November 26th election and nothing will change this fact. Modu Sheriff has won this legal battle already.

Sola Oke has the momentum now, Mimiko's faction of PDP should coalesce around his candidature and support him to victory.

With this notice of appeal, the appeal court will have to halt the ongoing hearing of the case until the supreme court decides on Poroye and Jimoh Ibrahim's appeal. If the Mimiko/Jegede camp succeeds at the supreme court, appeal court will resume hearing on the substantive matter and rule on it. If you ask me, that's really a long way to go considering that the election is 11 days away. The main purpose of this appeal is to delay the eventual judgement of the appeal court on the matter and as it is, this is a victory for Jimoh Ibrahim and Ali Modu Sheriff.

Hahaha... . The same Legal trick Olanipekun used in Abia case is being used by Jimoh Ibrahim's lawyer to ensure this case is stalled. In Abia he argued that Appeal amounts to a stay.... He quoted Ojukwu vs Lagos State Govt.. I wonder what he will quote now. Kcnwaigbo come and see Oooooooooooooo

There is really no point arguing over what is obvious. In a matter of days, we will know who is wrong and who is right. But trust me, Jegede will not participate in the November 26th election.

Remba this was the same reason Justice Abang was banged by the appeal court justices because he insisted on hearing the Abia case even when Wole Olanipekun called his attention to the fact that the records of the appeal has been transmitted to the appeal court.

The Court of Appeal in Abuja, on Thursday, berated Justice Okon Abang of the Federal High Court in Abuja over his refusal to hands-off the suit that led to the removal of Governor Okezie Ikpeazu of Abia State.

The appellate court held that Justice Abang “placed the law on its head”, when he declined to suspend further proceeding on the matter, having been notified that an appeal had already been lodged against an interlocutory ruling he delivered on July 8.

A five-man panel of Justices of the appellate court, led by Justice Morenike Ogunwumiju, equally faulted Justice Abang for “over reaching his powers”, by wrongly interpreting the Appeal Court Rules.

Ikpeazu had in his first appeal marked CS/S/390B/2016, urged the appellate court to determine whether Justice Abang was right to have proceeded with hearing and determining the suit against him, even when he was notified that the appellate court was already seized of facts of the case.

He argued that Justice Abang was wrong to have gone ahead to interpret Order 4 Rules 10 & 11 of the Court of Appeal Act, after the record of appeal had been duly transmitted to the higher court.

He maintained that the lower court ought to have suspended proceedings before it to abide by decision of the appellate court.


Meantime, in a unanimous decision, the appellate court panel faulted Justice Abang for not according due respect to judicial hierarchy, saying he refused to tow the line of laid down precedents.

According to Justice Philomena Ekpe who delivered the lead verdict: “It appears the lower court made somersault of the law. Once an appeal has been entered, there is indeed nothing to be heard or determined once the record of appeal has been transmitted.

“The lower court had no jurisdiction or business to interpret the rules of a high court when the rules are clear and unambiguous. I am in agreement with argument of learned counsel to the appellant that the trial lower court judge acted ultra-vires his powers”.

The appellate court held that Justice Abang placed the law on its head when he refused to hands-off the matter having been notified of the pendency of the appeal.


“Consequently, this appeal is meritorious, the decision of the lower court delivered on July 8 is hereby set aside, cost of N100, 000 is awarded in favour of the appellant”, the court held.

Maybe I have to break it down to the smallest details for some of you to understand. With this notice of appeal, Jimoh Ibrahim and Poroye's lawyers will simply file an application before the court of appeal for stay of proceeding till the matter is decided by the supreme court. Since the case on appeal at the supreme court will have a substantial effect on the case, the appeal court will have no choice than to halt proceedings until the supreme court decides on the matter. Saraki has used this same tactics to delay his trial and it worked perfectly for him, it is already working for Jimoh Ibrahim as well.

Abeg help me explain to them. Thank God Wole Olanipekun is involved.. .. He used the same Legal trick to stall Uche Ogah’s case and ensured that he was Not sworn in as declared by Abang. I wonder what will be his argument now. Besides this Same trick has worked for Saraki and who says it will not work for Jimoh Ibrahim. What goes around comes around...

I expect my people to have known jimoh ibrahim very well. Those that know him very well will never listen to him let alone reposing confidence in his word. For avoidance of doubt, appeal court panel is sitting tomorrow to conclude the substantive appeal filed by Jegede, whereby all parties were ordered by the panel to come and adopt their brief of argument tomorrow. The case is likely to be dispensed off before the end of this week. We shall all know the truth sooner than later. My people should relax and stop believing rumors and propaganda.

The Act you are talking about is the ACJA 2015, the Administration of Criminal Justice Act 2015.

But sorry, the case in question is not a criminal case and so does not apply.
