A Divisional Police Officer(DPO) ,Segun Atanda has been dragged before a Federal High Court sitting in Ado-Ekiti for an allegedly assaulting a businessman, Mayowa Oluwanisomo.

The plantiff claimed that he was unlawfully arrested detained , harassed intimidated and assaulted by the accused for no just cause on December 18 last year.

The accused was sued alongside another officer simply identified as Mr. Agbabiaka (2nd) and Commissioner of Police (3rd).

Oluwanisomo who filed the application for the enforcement of his fundamental human rights is seeking an Order of the Court for the award of N10 million as general and exemplary damages.

When the case came up for hearing on Wednesday before the presiding judge, Justice D.U. Okorowo, the Respondents and their lawyers were not represented in court.

Counsel to the Applicant, Olorundare Oyedele, told the Court that the Respondents have filed their counter affidavits but he would need a short adjournment to reply on point of law to the new issues raised by the Respondents.

Justice Okorowo in a short ruling said the case was fixed for hearing on Wednesday but the Respondents were not in court despite the service of processes on them saying he would adjourn the suit to February 15.

The judge stressed that he would invoke the rules of the Court on the Respondents if they fail to appear on the next adjourned date.

He advised counsel to the Applicants to ensure the service of hearing notice on the Respondents to ensure appearance.
