Following a high court decision sacking the chairmen of all the 18 local councils in the state, the Ondo State Governor, Rotimi Akeredolu, has appointed caretaker chairmen for the councils.

A statement on Sunday by the governor’s Chief Press Secretary, Segun Ajiboye, said the appointees would be sworn in on Monday.

The court held that the election which brought the chairmen into office was a nullity given that one of the political parties, Peoples Redemption Party, PRP, was excluded from the election.

The All Progressives Congress, APC, did not participate in the election which held in April 2016.

The Gov of Ondo State, Arakunrin Rotimi Akeredolu has therefore approved the LIST OF CARETAKER CHAIRMEN FOR ALL THE 18 LGs IN ONDO STATE AS FOLLOWS:

The State Government had earlier approached appeal court and the case is still pending.

Akeredolu has not only showed he has no respect for the law but has made a mockery of himself as a Senior Advocate of Nigeria.

A case before a Court of Appeal was taken to a State High Court who gave a judgement that's inconsiquential. Femi Aborisade that even took the state to court didn't partook in the LG Election that produced those who were sacked.

Meanwhile, the case was actually instituted by Ondo state government against Ondo state independent electoral commission. Whereby they cooked up a false allegation of PRP not being on the ballot paper and they also did not allow ODIEC to be represented by ODIEC lawyer nor allowed Balarabe Musa, National Chairman of PRP to speak in court. In short.

Ondo state did a complete arrangee case. Just to dismiss duly elected local chairman. So much for our democracy!

Appeal Court restrains Akeredolu from sacking LG chairmen, councillors

Akure Division of the Court of Appeal has restrained Ondo State Governor, Rotimi Akeredolu, from removing or sacking chairmen and councillors in the 18 local government areas of the state.

The chairmen and councillors of the councils were sued by the All Progressives Congress (APC) during the administration of former Governor Olusegun Mimiko.

At the resumed hearing of the case, counsel to governor Akeredolu, Mr. Charles Titiloye told the court that his client was not aware of the order of the High Court restraining him from dissolving the councils or of the appeal supposedly filed by him.

Titiloye noted that the state’s solicitor general was in court, to demonstrate how concerned the governor was, over the suit. The solicitor general subsequently rose up to confirm his presence, while the 18 council chairmen and councillors were represented by their counsel, Mr. Olusola Oke.

The governor’s counsel pleaded for adjournment to enable his client study the case, being a lawyer himself.

Governor Akeredolu, according to a hearing notice served on Oke by the state’s Ministry of Justice, had appealed a judgment of the state High Court headed by the Chief Judge of the state, Justice Olasehinde (now retired) which barred the governor from sacking the council officials elected on the platform of opposition Peoples Democratic Party (PDP).

The chairmen and councillors averred that in line with the 1999 Constitution (as amended), they were elected to serve for a three-year tenure, which will lapse on April 25, 2019. In granting their prayers, Justice Kumuyi observed that “the tenure of an elected councillor or office holder cannot be abridged or determined at the whims or caprices of anyone except the electorate.”

She, therefore, restrained the state government from dissolving, sacking, dethroning, impeaching or however removing the claimants from their respective positions, offices, duties, functions, powers and rights. She thereafter adjourned the suit to June 7, 2017, for hearing.

There is already an existing judgement from a High Court, the Governor can't approach another High Court to overrule the verdict of a Court of coordinate jurisdiction. This is the height of executive rascality

Infact labelling the country as 3rd world is insulting to other 3rd world countries on the right track. A 4th world country would be more appropriate. It's lile we take one step forward and 3 steps backward.

The suit involving the 18 local governments areas in the and the Peoples Redemption Party and the state government was concluded at the High Court sitting in Akure, the Ondo State capital.

The court ruled for dissolution of the councils in the state.

Justice S.A Sidiq, who delivered the judgment on Friday, overruled all the applications filed by the lawyers for the claimants.

Mr. Femi Aborisade announced his appearance for the PRP while Mr. Akinladapo Ogunleye, the Solicitor-General of the state appeared for the state government while Mr. Olusola Oke was for the 18 chairmen and councillors, who were also claimants in the suit.

However, there was a mild drama during the court proceedings as the PRP lawyer, Aborisade, who filed the suit against the local government election held in the state in April 2016, was not recognised by the judge as the lawyer appearing for the PRP.

Aborisade, who filed the suit to challenge the Ondo State Independent Electoral Commission on behalf of the PRP over the conduct of the election, was at the High Court to represent his client and also to withdraw the suit.

But the judge recognised one Segun Ogodo as the counsel for the PRP, insisting that he would continue with the case irrespective of the applications for the withdrawal filed by Aborisade.

The National Chairman of the party, Alhaji Balarabe Musa, who was also in the court, disowned Ogodo, saying the party never knew Ogodo nor briefed him to stand for the party in the court. He insisted that Aborisade was the lawyer of the party and not Ogodo.

Justice Sidiq in his earlier ruling said he had earlier given a verdict that recognised Ogodo as the counsel to the PRP, asking Aborisade to go to the Court of Appeal to upturn his earlier ruling on legal representation for the party.

The judge declared that the local government election conducted by the ODIEC in 2016 was null and void and ruled that the 18 local council administrations should be dissolved.
