My broda you should not be afraid ....you have not committed any offence. get a good lawyer to analyse the circumstance before writing any statement....I have a similar case like two years ago..though the damage was not this big. I can comfortably tell the possible outcome. The police does not pay. There will be a negotiation between you and the truck guy and eventually The truck guy will pay for part of the damage while you bear the rest of the cost of repair, for humanity sake. But to achieve what I stated above , while at the station you need to constantly blame the truck guy for disobeying the police .. Its almost a capital offence to point the blame at the police while you are at the station. Be warned. Mind you ...last last, you and the truck guy still have to close the case with something. 3 Likes |

@Op, sorry about the damage to your car. My advise to you is go get your car fast out of the Police Station, because if you leave it at the station, some rogue policemen will continuously vandalize it until all the removable parts are gone.So it's better you park it at your house and effect it's repairs when you have money to do so. As you go to the Police station, prepare for more shocking demands from the Police, for example, you might be asked to pay the sum of N40, 000 for you to tow home your car as it is an exhibit to be used against the erring truck driver. I am writing all the above from personal experience, that is why I don't like the idea of having anything to do with the Police. |

Op talk to a lawyer before you honour any invitation by the police, u should walk into the station with yiur lawyer. It is the lawyer that will advice u on what details to put down and what not to say so that when the case reaches the court or wherever it will lean in your favour. Dont put down any statement if your lawyer has not okayed it |

Synord: You have said well... Though, you might need to re-arrange the order of what he should do. 1.) Get details of the truck (locate it, take pictures of where it impacted your vehicle with its plate number showing, take picture of the driver too) 2.) Take picture of the parking position of your car, (showing that it was not obstructing the road), the damages to it and get an "Estimate Total Cost of Repair" from a professional Auto~Shop) 3.) Accost the Driver and ask him if he will repair your vehicle by himself or if he thinks the Policeman should be held responsible for the repair (record this conversation) Expect him to decline to repair it and blame it on the Policeman... in doing so, he will explain how the Policeman was struggling the steering with him, voluntarily) Try and let him tell you the details of the Police man. Ask him if he can identify him, if he sees him. If he agrees to pay the cost of repair, let him sign an undertaking, with a Witness. 4.) Get his phone number and say you will call him back. Conform that it rings on his phone before you leave his presence. 5.) Send him a Text, repeating what you asked verbally in #3 above. You want him to re-explain what happened, but now in a Text-form, as a reply. 6.) Take the above to a good and smart Lawyer (So many woo-woo Lawyers can spoil a good case while a good Lawyer can even win you a bad case! ) 7.) With your Lawyer in-tow, go to the station and make a formal complain. Your Lawyer should ask to see the DPO. Let your Lawyer explain what happened and ask "if" the Policeman is willing to bear the cost of repair (They will also decline). Let your Lawyer tell them you will be filling a Civil case and joining the Police Force (and Police man), as defendant. Your Lawyer should apply to the Courts for Damages to your Vehicle, loss to you for not been able to use it, cost of litigation, due to negligence on the part of the driver and Police, dangerous driving, e.t.c Now, this is what "may" happen: a.) Police will arrest he driver and FORCE him to repair your vehicle or pay the cost of repair. b.) The Driver too, if he is smart, may engage a Lawyer and sue the Police man as well. As it were, Driver will drag Policeman, just as your are dragging the Driver. At the end of the day, your vehicle must be repaired. Note: It is unlawful to refuse to stop, when stopped by a Police Officer (as in real Police, not these criminals in uniform...but they are still "Police" all the same) ......... Driver Commits an offence It is also unlawful to struggle the steering-wheel with the Driver of a moving Vehicle, irrespective of the situation (there are other legal ways to bring the vehicle to a stop)...........Police Man commits an offence. 4 Likes |

AntiWailer: Not necessarily a total loss. Every Car driving on the Road has one form of insurance or the other (3rd party, Fire and theft, Comprehensive, e.t.c) ` Agreed, if he had comprehensive insurance (assuming our Insurance Coys are not as fraudulent as they are as of today), he can make a CLAIM and be compensated to a certain percentage of the loss, without all the hassles of court (though, l dont know which is easier; hassles of court ...or trying to get a Nigerian Insurer to reimburse a loss) The "bad side' of this is that: 1.) His Premium will rise dramatically such that it will appear his insurance company only "loaned" him the money he claimed (got paid back!). 2.) What he will be paid by the insurance company, will be less some deductions, by the insurance company and he will have to make up the rest. Not a "particularly very good" result either. He can get paid, for the damage on a "private basis". 1 Like |

Yemight2: At the boldened, the question should be why should the police give a driver a reason to drag with them in the first place? Nigeria police behave like savages compared to their counterparts all over the world. Has anyone seen a police officer hopping in a potential criminal's vehicle and dragging the steering wheel with him any where else in the world? Even though I feel bad OP's car got damaged in the process, it would have been a worse situation if the truck rammed over a crowd of innocent people standing where his car was parked because a dumb police officer chose to drag the steering wheel with a driver. |

Just hold the driver of the truck responsible jejely if you want your car to be fixed. If the driver did not try to escape the police, he wouldn't have damaged your car. Infact if you just face the driver, the police will support you. But if you try to blame the police, they'll change the story and can even claim you parked at the wrong spot. All these eye witnesses will run away when you tell them to come support you. You still need a lawyer sha. |

Yemight2: Ignorance is your case. Did you even read the part where the OP said the truck driver beat traffic and tried to escape. That is two faults on the truck driver. One is breaking traffic laws while the second is trying to escape from law enforcement. The Police officer is obligated to arrest and detain offenders and this is applicable all over the world. Policemen in the USA will not hesitate to shoot you if you break the law and attempt to run. |
