The Federal Government has withdrawn all Charges levelled against the Former Chairman of the Economic and Financial Crimes Commission, Mallam Nuhu Ribadu following indication that he might be named an Adviser to Acting President Goodluck Jonathan.

The Code of Conduct Bureau had in a charge alleged that Ribadu failed to declare his asset as a public officer while in office as EFCC Chairman asserting that he thereby violated the provision of the Code of Conduct Bureau Act in respect of asset declaration.

The application to withdraw was made pursuant to the inherent powers of the Federal Government to stop proceedings against anyone under trial for any offence. The Code of Conduct Tribunal will sit later to drop all the charges .

The tribunal had issued a warrant of arrest for the former EFCC boss, for failing to appear before it to clarify issues relating to his asset declaration before assuming office as EFCC chairman. Ribadu failed to appear claiming his life was under threat. 

Ribadu's lawyer, Femi Falana said, “Ribadu’s inability to appear before the tribunal was due the difficulties associated with the renewal of his international passport Ribadu is being accused of alleged failure to declare his asset as required of a public servant while in office.

The tribunal however ruled that if Ribadu voluntarily appears before it on the next adjourned date of January 7, “the bench warrant shall have no effect.”

The prosecutor, Ahmed Kyari had applied for an indefinite adjournment to enable them effect the bench warrant on Ribadu. 

The Former Chairman of the Economic and Financial Crimes Commission (EFCC),Nuhu Ribadu, had told the world that President Umaru Musa Yar'Adua was after his life and actually forced him into exile.

He also recalled the traumatic experience he went through while at the National Institute for Policy and Strategic Studies (NIPSS), Kuru, Jos in Plateau State.

Ribadu said the President, right from the on set, was not comfortable with the mode of operation at the commission, when he was in charge.

Ribadu also lamented that it was not his plan to go on exile let alone go back to school there, noting that the world economic hardship has taken a toll on him.

He is currently studying at the prestigious Oxford University in the United Kingdom.

He told the BBC: "Whatever that happened that is how God wants it, but it is something with the government. The way we worked in the past, this government doesn't want it.

"They said I should go to school, I was in school. They followed it up and said they had sacked me. Not done on the graduation day, I was not allowed to receive my certificate, I was forced out with my children and family.

"The President knows and he has sent me out of the country."

Asked whether he was making a blanket allegation on the present administration, Ribadu stated, "Who will have done this work if not him (Yar'Adua)?"

"Is this even something that we will argue? Everybody knows that it was the government. God knows what happened and God will judge us."

On the allegation that former President Olusegun Obasanjo used him and dumped him, Ribadu argued: "People should know there was differences in our work. This Obasanjo I don't even know him. It was work that joined us and he gave me freedom and has never said Nuhu come and do this.

" But you cannot stop people with their dispositions. I investigated him and found nothing indicting against him but I got his daughter.

"Today I am suffering here because I don't want to stay abroad. It is suffering here. Only recently I started earning salary after one year.

"I got a job with the Centre for Global Development. I thank God the demand for my service is increasing in the world. Hardly two or three days without my attention being needed across the world. I thank God for this."

Its very true. James Ibori is probably crapping on himself in fear. This goes to show that no condition is permanent. i'm no fan of ribadu because of his pro-obj leanings but I feel safer with ribadu back in the saddle to checkmate come of the really dangerous and billionaire power broker rogues running around financing elections

Draining within Nigerians! One day Ciecielia Ibru & other looters like Ibori's charges would be dropped by FG just because of appointment. There is hope for Bode George, Erastus Akintola and others.

FG Withdraws Case against Ribadu

In what is seen as a prelude to his appointment as Special Adviser to the Acting President on Anti-Corruption, the Office of the Attorney-General of the Federation has applied to the Code of Conduct Tribunal (CCT) for the withdrawal of the case of non-declaration of assets instituted against the former chairman of the Economic and Financial Crimes Commission (EFCC), Mallam Nuhu Ribadu.
It is not yet clear if the current EFCC Chair, Mrs Farida Waziri, will report to him if he is eventually appointed by Acting President Goodluck Jonathan.

At the CCT sitting in Abuja yesterday, the AGF, represented by the Special Assistant on Litigation, Dr. J. O. Olatoke, stated that his application for withdrawal of the case had nothing to do with a new application the defence counsel intended to submit for CCT to strike out the case.
The defence counsel, Mr. Femi Falana, represented by Mr. Samuel Ogalla, had earlier made known to the Acting Chairman of the Tribunal, Justice Murtala A. Sani (SAN), his intention to submit an application to the CCT to strike out the case against his client.
Ogalla’s application was rejected by Justice Sani based on the fact that the tribunal had no substantive chairman and therefore could not take a new motion but could only attend to non-controversial matters.

Justice Sani then advised the prosecuting counsel to formalise his application for withdrawal of the case for proper documentation at its next sitting on Thursday, April 8, 2010.
Speaking after the sitting on what prompted the withdrawal of the case, the prosecuting counsel said before the dissolution of the cabinet, “the former Attorney-General of the Federation, Prince Adetokunbo Kayode (SAN), reviewed the cases on ground and directed that this case should be withdrawn”.

Olatoke said the constitution of the Federal Republic of Nigeria vested in the AGF the power of nolle prosequi to discontinue any criminal prosecution at any stage of the case and that it is within the prerogative of AGF under the constitution to decide the cases he wants to prosecute.
Ribadu had praised the elevation of Jonathan to the position of acting president in February, adding that the resolution of the National Assembly indicated that things were changing for the better in the country.

The former EFCC chairman also said he was ready to return to the country to be part of the process of reconstruction desperately needed in the society.
THISDAY had reported in February that the Federal Government was wooing Ribadu and was ready to drop the “trumped-up” charges against him, in addition to restoring Ribadu’s rank, who was demoted by two ranks from Assistant Inspector General of Police (AIG) to Deputy Commissioner of Police (DCP) before he was finally dismissed for going AWOL (away without official leave) after failing to report for duty in Edo State.

The police disciplinary committee that recommended his dismissal was headed by Ogbonna Onovo, who is now the Inspector General of Police (IG).
When Ribadu was denied his certificate by the National Institute for Policy and Strategic Studies (NIPSS) for failing to wear his police uniform - which would have meant donning his demoted rank and subsequently challenged the demotion in court at the time - it was Jonathan who ordered NIPSS to release his certificate.

If this is April Fool joke then it must be a very long one

The propects of dropping charges against Ribadu and recalling him to Government has been mulled in the media in the last one month. So I was really not suprised. Just Happy.

LAGOS (AFP) – The Nigerian government has asked for charges to be dropped against the former head of its anti-graft body who is on trial for failing to declare his assets while in office, his lawyer said Thursday.

"The federal government filed the application to discontinue the trial of Nuhu Ribadu before the code of conduct bureau. The application will be approved on April 8," Femi Falana told AFP.

Ribadu, a senior police officer, was appointed by former president Olusegun Obasanjo to head the Economic and Financial Crimes Commission (EFCC).

He was removed as head in controversial circumstances in December 2007 and accused of not declaring his assets while in office in compliance with the 1999 constitution.

Anti-graft campaigners say that Ribadu fell foul of powerful former state governors by trying to bring them to justice over embezzlement charges, arguing that the anti-corrption war has lost steam since his removal.

Transparency International still ranks Nigeria as one of most corrupt countries in the world
