You’re right. It’s against the law when a mentally fit person has sex with someone who is mentally unfit.

And it is not against the law for two mentally unfit people to have sex. It’s just not encouraged because of the possibility of children coming from that sexual activity. And one can’t trust that they will have the presence of mind to use protection. Not to mention that sexual activity increases acuity in some patients with different types of diagnoses (not gonna go into details with all of that now).
