That part you quoted spoiled the whole script. US is not like Nigeria where you can easily give up a child for adoption without both parent's consent. That they are divorced does stop the biological father from being the father, even if she has custody.
There is noway the Child Services would allow such adoption to go through. Moreover, the circumstances of her legal immigration status would raise a red flag.
