A Federal High Court in Abuja has declared the suspension of Senator Ovie Omo-Agege for 90 days illegal.

Justice Nnamdi Dimgba who precised over the case ordered an immediate re-instatement of the Senator to his position in the National assembly.

The judge, in a judgment delivered on Thursday, held that though the legislature has the power to deal with erring members, it did not follow due process in arriving at its decision.

Justice Dimgba nullified the suspension after stating that the reason given for the suspension of Omo-Agege by the Ethics and Privileges Committee was a fundamental breach of the Constitution.

He ordered the Senate to pay Omo-Agege all his salaries and allowances.

This is not new!

What is new and wrong is the leadership in the upper and lower chamber. Why would you suspend a colleague representing some set of people just the way you are(representing some set of people), because you are decorated as the head of the chamber?... there should be some other ways to punish erring members other than suspension which interpretes that a constituency is not represented for the period the suspension will cover

Saraki & Dogara are just too 'gavel drunk'

Of course it was illegal. This was infringing on the rights of the constituents . The Saraki Senate is irredeemably corrupt. All corrupt ex Governors, ex ministers and multi term Senators are hiding there. They are pushing the corrupt Saraki up to weaken government. Nigerians will HIT them hard soon..

hmm. the way bukola is running the 8th assembly is like a dictator.if Bukola is opportuned to be president of nigeria, that is when people will realise Buhari govt is far better. like people don't know saraki at all.

He can only remain suspended if the senate seeks for "stay of execution" and if the court will grant them. but for now as from tomorrow Omo Agege by law ceased to be suspended and he can resume seating

The national Assembly members should work in accordance with the Constitution & act as law makers rather than acting against it because it was really wrong suspending a fellow member that is also representing a senatorial area the way they are representing their own area.

He will go with police protection, the senate should look inwards especially the APC caucus.
