It's subject to interpretation of the courts in this case the Supreme Court by a competent judge.

We don't cry foul when laws and interpretations impact commoners but we're always quick to join the bandwagon to Wail when the plundering elites are encumbered.

But when the courts make their rulings the executive can ignore then, right? Because that's what this is all about o.

Are you insinuating that the law supports corruption and should be set aside to properly "fight" corruption?

Make your point already!

I have just made a supreme Court pronunciation available to you. If you have any opinion against that, it's left for you. Asari Dokubo and Uwazurike vs Federal Government/ Obasanjo.Kindly Google that , and see the Supreme court verdict. It's not me that gave the Judgement.
and I am also putting it to your ignorant mind that it was the courts that interpreted what makes a matter of national security in the example you stated and not one individual tyrant .

I have given a Supreme court verdict to you. Kindly goggle it and get more information about it. Did America take Osama Bin Laden to any court? There are cases, like the President said. If the Person involved is a National threat, the issue of rule of Law definitely will be suspended. Will you seek for any bail for Skeka, today, if he's arrested despite the law says, a suspect is entitled to a bail?

Wonderful.

That is war you are talking about. The war was ongoing and Osama started it with an act of war against the US.

Shekau is the same. I will agree on that. No problem.

When Buhari wants to apply same to his political opponents, it becomes a problem, Brah!

rule of law is directly proportional to national interest... remember where there is no law there is no offense

1. During democracy our politician devalue the Naira
2. Democracy=Rule of Law=Devaluation of Naira.

So, rule of law only helps the politicians to steal us blind

How did we get here?

Individuals makes a nation,if the interest of an individual is not protected then the national interest is irrelevant.

Only those with anachronistic mentality will support this slow thinker who reads every speech prepared for him without understanding the contents.

My message was passed in English language. There is a limitation to rule of law both in Nigeria Constitution and outside world. If Skeka is arrested today, will you clamour for his bail? Because, the law says, every suspect is entitled to a bail? When America killed Osama Bin Laden , nobody talked of rule of law. Any individual or a group that is a threat to National unity or Security. The rule of law is suspended.

I just tire for people o.

How can anyone in his right mind support this move? Asari was heading a group which armed itself against Nigeria. Uwazuruike was heading a secessionist group.

Which militia is Dasuki heading?

Why has no "Fulani Herdsman" (member of an armed group killing hundreds of people) been arrested and prosecuted? Are mass murders of citizens not a case worthy of national interest?

I just tire.

A country without the rule of law is a lawless jungle.

There is a great difference between protecting national interest and being a dictator. National security should not be in conflict with the rule of law

Buhari widely known for tyrant proclivity cannot be trusted with this . he is only planning to hide under the cloak of national security to exhibit tyranny as usual against the rule of law by trampling on peoples rights.

national security should be seen as aggregate understanding amongst the generality of the people and not what one certificateless lifeless nepotic dictator tyrant terrorist dullard thinks .

Prof. Sagay has become a huge disappointment. To him, rule of law is no more important because he has found himself in the corridors of power.
He may end up becoming a victim of the autocracy he is supporting today.

are they chadian lawyers or somalian lawyers? They are nigerians too. Rule of law is paramount in every sane society. I am studying law presently at unisa and there is something i read about how serious they take fundamental rights. It says " it is better to let a guilty person go free than to jail an innocent person". Now in nigeria it is " you are guilty until proven innocent".
Anyway being a zombie that you are i don't expect you to understand.

Those are among the 100 lawyer defending only one individual on corruption case despite they know the person is corrupt. Judiciary is our problem in Nigeria. Until we started putting the lawyers and looters in jail when found guilty.

What do you expect from group of lawyers and judges who are feeding fat from proceeds of corruption. They keep defending well proven cases of corruption even with published evidences and the bribed judges keep adjourning such cases and granting bails to known fraudsters hiding under human right. This govt of pmb hates corruption and can't stand seeing known economy looters walking free after putting judges on their payrolls.Though human right is to be respected but corrupt judges and advocates should also change their ways and stop selling their conscience for pounds sterling and dollars.

Imagine if Shekau is captured today and we are to obey the rule of law, his trial might last up to 10 years.
Aminu Ogwuche, the mastermind of nyanya bomb blast was set free (under GEJ) even though he admitted to being behind the attacks.
When a neighborhood thief is caught and is being beaten up. Nobody cries rule of law. But when a big thief who is more dangerous is caught, we who have been the victims begin screaming rule of law. God help us

Its like you dont understand what is rule of law.

If he was set free, then The FGN failed in their prosecution to prove it beyond all reasonable doubt.

Minus Rule of Law equals Dictatorship which leads to Anarchy.

Blame the NASS instead that have worked since 1999 on our constitution yet loop holes exists.

FGN cannot decide when to obey court orders under blanket of National security without proving same to the Judge.

This lifeless thing will erupt this country sooner than I thought. What kind of dumb speech is this coming from a supposed democratic president?

I believe the thing was just reading a speech without any form of understanding.

The worst part is that some lawyers can boldly come out to support this view. It makes me sick.

That lifeless thing must be booted out of the presidency.

If I were Osinbanjo, I will quit working under such a tyrant because history won't be kind to him being mingled with such a thing.

When a judge wants to be bias, no matter how much you prove your case, he is still gonna find a way to rule against you. That's Nigeria. The judiciary is supposed to be the last hope of the common man is now a safe haven for big criminals. Even Deziani Madueke is pleading to be tried in Nigeria.
Even the NASS pass laws to protect the elites. See how quick they were to pass death sentence on kidnappers, because only the rich are kidnapped.
We can't continue like that, else the executive becomes the victim.

Government wants to hide under "national interest" to tramp on the rule of law

So unfortunate.

The best thing that can happen to any Democratic country is the rule of law.

Just like Dicey observed, "THE RULE OF LAW IS BETTER THAN THE RULE OF MAN".

What A.V. Dicey means is that the rule of law is defined within an acceptable context in which the tribes and ethnic groups constituting the "Nigerian" State has been thoroughly considered and debated.

On the other hand, national interest or national security which the president alludes to is ambiguous and vague, being subject to whatever the president decides it to mean.

But, why haven't I read a comment from Femi Falana SAN, on this matter. Is he compromised to that extent?
