Unit i agree with u,but lets 'bone story o'.B4 we 'reopen the can'.

Mamus i agree with u that they really aint as fine,esp with the body,i dont think they achieved their purpose to the fullest,because BBA dint train them adequately they kept contradicting themselves like some puppets in a show.But i know that they entertained us a bit,though dourly grin.
Seriously i think the house will become dry when they leave tomorrowi just envision R n T kissing everytime frm the loo to d bed,leaving OFUN to wash the same clean plates over n over again-such boredom,so in a way they helped OFUN with some company that can keep her in the race 4 the money

Jeez. You guys can be so self-righteous.
I mean, you sit down in front of PCs, in YOUR house, doing exactly what you want to do without trying hard to impress voyeuristic eyes picking on you, and then you try and piously state what someone who has been cooped up in a house for months should do. These people in the house don't have too many places to go, and they are probably suffering from cabin fever. In their situation, you all would welcome the chance to escape through drink. And that's what happened.

Anything apart from consensual sex is rape. Every educated person is expected to know this, and i'm shocked that it's her fellow Naijans that are spouting crap lthat she enjoyed it.

What's up? Told you guys that the last saturday's footage would definitely not be included in Friday's Uncut Show because Biggie knows he's wide open to liability and it wouldn't do to provide an opportunity for the PVR owners to record and preserve such explosive material.

I expect that when she does find out at the end of the show, she will take steps to obtain legal redress. Her elder sister is a lawyer and i'm sure she will advise her sister accordingly.  Being that Homegirl doesn't know what transpired, there is no basis for her to leave the House.

I have repeated this so many times on this thread since the incident but people just don't get it. But i guess Nigerians are too difficult to reason rationally with. But you have stated the argument against Richard most succinctly indeed.

R a p e is almost a strict liability offence. This is because the act involves the violation of a person in such a manner that the crime is committed once the physical component is completed i.e. the penetration. It is one of the crimes that does not necessarily require intent because you cannot r a p e someone by accident in the way that you can kill someone accidentally. So while an intent to kill is required to sustain a charge of murder, there is no such requirement for r a p e.

As for the Reasonable Man's test, i fail to see how it would apply here. Are you saying that Richard's lawyer would ask if Ofunneka didn't know she would get drunk if she drank too much vodka? Well, she knew she would. But then as the natural next question in the reasonable man's test, is he going to ask if she didn't know that Richard would take advantage of her intoxication by sexually assaulting her? shocked shocked You see where that argument breaks down, don't you? No reasonable man could reasonably be expected to know that. So that argument will not avail Richard or his lawyer. It also will not avail them to argue that Richard was drunk too. First, there are over a million people who can testify that Richard was sufficiently lucid to have controlled himself. The court will also see that for itself when it views the footage. Secondly, strict liability. He violated her, whether he was drunk or not. He cannot say "i didn't know what i was doing" whereas he found his mark with unerring accuracy.

As for Ofunneka 'enjoying' the assault, you know that is not an argument that would stand up in court. hi everybody

ok, today biggie gave the housemates a treat, he provided them with a slippery slide and a large bouncy velcro wall.

where they are suposed to wear sticky suits and jump unto them and eventually get stuck

but for some reason, victor and tati thought the velcro wall was the slide and attempted to slide down it, lolol

in the end, they got the gist, anyway, tati tried endlessly to get stuck to the poor velcro wall, all to no avail, it was funny to watch sha, hahahaha

and lastly, ashanti finally got her big blowout with ofunneka ,

it was all about the cleaning the dishes, ashanti finally decided to do some chores but somehow twisted the story to make it look like ofunneka is making her do all the housework.

it eneded up in a brief shouting match with ofunneka askin her repeatedly whether she was high , and ashanti replied saying that ofu liked to act like everyone's mother , blablabla
so, at the end,ofu told her to go and sleep or better still, "go sit on your ass!"

ashanti went away smiling, thinkin she had performed some dastardly act

If she realises that she had made a huge blunder the week before this act, would it not be normal reaction to act as though ignoranct and hide under the r a p e cover. I think we should look at all possibilities and not allow our emotions get the better of us.

There's a popular saying that "The law is an ass. And that is an insult to the animal." The facts the law will take cognizance of are

1. Did Ofunneka consent to the sexual contact? The answer here will be 'No' because in her drunken state she lacked capacity to consent to or reject the sexual contact.

2. Was there penetration? The answer here is 'Yes'

It is largely open and shut.

And as for drinking of your own free will and following a guy to his place, it still doesn't translate to consenting to sexual relations. If the guy has sex with you while you were drunk, he's liable for r a p e, even if you were wearing the shortest, skimpiest dress on earth. Yes, the law is an ass indeed. So if you're planning on getting some girl drunk so you can have your way with her, just know that you run the risk of getting hit with a r a p e charge. grin

But we are missing the point here. The legal action is not going to be against Richard the penniless student. He committed a crime which only the state can prosecute (upon receiving a complaint from Ofunneka). The action is going to be against Endemol, Mnet and other promoters of Big Brother Africa for failing to intervene and manage a situation they created by plying the housemates with alcohol. As soon as Biggie realized the housemates were abusing the alcohol, he could have called them to order. Instead he did nothing. Maureen begged him to keep Richard away from the drunk girls; again he did nothing. He could have gone to the garden shot earlier to protect the reputation of the housemates, instead he made them unwitting and unwilling players in a soft-porn spectacle viewed by people all over Africa.

Dalby, it's obvious you're not a lawyer. I have reached this conclusion from your layman's arguments. Trust me Richard is liable for r a p e under South African law, but the legal action is more likely to be against the promoters of Big Brother Africa.

Richard got a call from his father and cried because his father couldn't tell him anything about Ricki. He refused to tell Richard anything about his wife. So i guess Ricki could have called it quits. Who can really blame her?

biggie gave the housemates an opportunity to talk to one of their loved ones, courtesy of MTN

ofuuneka talked to her old friend from high school,who, to be honest wasnt sounding extremely enthusiastic,

e be like say she dey live for either yankee or jand because ofu hadnt been in contact with her for like a very long time, when ofu asked if she had been watchin her, the girl said,

"welll , just since last week when the producers called , all the same, ofu was still very happy as she burst into tears while talkin to her

and then tati spoke to her sister yolanda, and when she asked her how gustav( her boyfriend) was, yolanda answered a very aloof " fine" , then tati asked her " just fine?"    

so, i guessed it dawned on her that she is in alot of truoble

then came rich boy, he spoke to his old man vincent, and when he asked about ricki, omo, the old man no fit yarn , as in he said nothing, richi asked him like 3 times " how is my wife"
the man said, "how are you doing, lets talk about you and me. i can't tell you what is going on"
richard nearly broke down, he was crying and his dad said" stop crying, you're a big man now, i can see you, pull yourself together"

then he went back into the house and started thinkin


tati joined him and he expresses his fears that ricki had finally left him " she's gone, she's gone, i hope she's still alive"

Hello All,

Sure you all had a wonderful weekend.
Was away in the penthouse with my self and I. grin grin grin Since LC refuse to send me there i had to crash land.  It was worth it men wink

I had to cut my trip short because of pressing issues. grin.

Richard is the most stupid and foolish man on earth i seen since i was born. Yes he is!!
I have seen men drunk to stupor but still conduct themselves in an orderly manner. the stupid fool was fully aware of what was happening. Since all the guys left. I'm sure he has been wishing he had fun with all the ladies left in the house,

There are men like that and I hate them all. God will punish them all. May God never ever bring such men into our life in Jesus name, DID I hear all the ladies in the house say a louder AMEN!!!!!!!!!!!!!!!!!!!!!!!

I pray that, come what may, this shall not effect Ofu when she comes out of the house "tall one" undecided

I m quite surprised that a fellow naija could think this way and even utter this kind of comments. how can u doubt the fact that Ofunneka was sexually assaulted by the so called married fool, Richard? she was quite unconscious of what is happening to her but Richard was still sane when he was indulging in such act. Had it been that he was unconscious too, he wouldn't have mentioned the kiss he shared with Offunneka afterwards. It really shows how irresponsible that married fool is.

Already, he has the intension of molesting all the ladies in the house as his strategy to win the game. so what are we saying now? This shows fully well that what he did on Saturday was quite intensional and done in sanity.

To back up my contributions, i would like u all to visit www.tvsa.co.za where u would get full analysis of South Africans about the issue. U just check the BBA version in the site.

As for me, i will really prefer Ofunneka to win the game and not Cheater Richard nor Tatiana the tart and husband snatcher.

You sure are right about that one, but remember there are always at least 2 sides to an argument. In court the judge or the jury can give a binding verdict that has a legal basis.

Lawyers a while ago told Gov. Ameachi in Rivers not to go ahead with the case, because it lacks basis, but today the storey is different. It is still the same lawyers telling Omehia to file in a case to set aside the previous ruling (challenge the verdict of the apex court). Na so una work dey, if you no talk you no go chop. NO FOOD FOR LAZY MAN grin grin grin
