Anybody can forget to declare an asset. Him admitting he forgot to declare that should have ordinarily ended the case at CCB just as it was done for Tinubu. What is sauce for the goose is sauce for the gander. This is the position of the law right now.

The lay man's interpretation of the "infamous" section 3d is that a public officer can afford to conceal his assets from declaration. Then when the CCB investigates and finds you out, you admit and then go scott free.

Our politicians can, but we should never expect our CJN to hide behind the flaws of the constitution.
