You know if l apprehend a burglar in my house, l then decide to become judge and jury and sentence him to whatever punishment, l have effectively carried out an act of illegality.

The key issue of Justice ⚖ is PROCESS & PROCEDURE
without it you have lawlessness and criminality.

There may indeed be a substantive case against the CJN however without following the laid down legal process anything outside of that process is ILLEGAL.

Our country is corrupt and l actually think that it's very probable that all our supreme Court judges are corrupt. But that is not the issue. But due process is to establish truth and justice.

Two wrongs do not make a right.

Considering the supersonic speed in which a caricature of an order was proported to have been obtained is HIGHLY QUESTIONABLE and completely without merit.

There has been no recourse to the constitutional fundamentals they have been totally circumvented. The president can not appoint a Chief Judge.

We also are moving into tribalistic, religious bigotry and nepotism. The only supreme Court judge to join hands with Tanko in this aberration is also from the North.

Because Buhari has declared Tanko CJN does not make him CJN, only the NJC can do that.

As it stands l can see the NJC suspending Tanko.

We have not also factored in the response of the NA when they reconvene on Tuesday. Or will the DSS lock up the national assembly and arrest the legislators

PMB has opened wide the doors of anarchy , let's see how our democracy will survive.

Technicality VS Morality.

There's no doubt that we're Morally Corrupt in this country.

And people are ready to vote in this carcass and brain dead jihadist for a second term of 4 years in 2019??

If Buhari wins a second term, God forbid, he will move Aso Rock to London as he will be taking treatment for his undisclosed illness for another 4 years with the country footing the bill..... and the Cabal will openly be running Nigeria as a mafia state, and you will not even find Buhari, to blame him for anything.. that is what they are planning to do....

Nigerians, if you re-elect this evil man, then you so much deserves whatever will happen to the country afterwards, Enough said!

You're off point, as far as the topic is concerned.

The case is about a mere declaration of asset.

APC and their devilish croonies are trying to turn in around into a criminal case which it isn't.

When in 2015 Osibanjo a mere judge in a,state declared almost $1 million in his bank account, how come nobody questioned how he got them?

The CCT trial is not a corruption trial.
"Mere declaration of asset" is a requirement he should meet before assumption of office. It is enough to kick him out of office.

He, who hires can either suspend or fire
Buhari appointed CJN and he suspended CJN, we should be careful th the way we politicised everything in this country.
The reason Buhari suspended CJN is valid, you can prove me wrong

AGNESikpuNNU:

Even if you link Onnoghen to murder of CHARLES DE GAULE and JF KENNEDY, the law has provided a procedure to deal with him. Anything less or more is acting "ABOVE THE LAW".
Somebody must sooner or later be made to pay for this nonsense.

Exactly the problem we have, the man refused to step aside, he postponed the NJC meeting indefinitely, among other misdeeds but some people think that his suspension is more important to Nigerians when he is on a mission of self-aggrandizement?

U go sch so?

Because obviously you are the real illiterate. The law says every public office holder must unfailingly declare his/her asset prior to assuming the office. Now the No 1 citizen as far as judiciary arm of govt is concern violate this law and cited forgetfulness as a reason.

Now, common sense should tell you that, if and when such public office holder is found guilty of the aforementioned law, it become pertinent that the agency in charge should investigate to the last kobo every of the undeclared asset (s).

If you have common sense (because it is obvious education is far from you), you should have seen that I was referring to some comments of imbecïles like you who are ranting about the amount of money in his bank account. Whether or not he properly declared his assets, it is the NJC that should decide his fate not your useless party.

You know deep in your deluded mind that this is all because of the upcoming elections. Also, there’s a court case about Buhari’s Waec certificate, did he step aside for the issue to be addressed properly?

When did Buhari start overlying court order? I know you have sold your destiny because of 10k/month salary and free 1.5gb data.

People never really understood Buhari from the onset, he’d always maintain that abacha isn’t corrupt, meaning he didn’t steal, but took money from the government cause its his birthright as a Fulani army general, you expect someone that served under abacha to add anything meaningful to the lives of Nigerian, someone that didn’t bother to improve himself. History will never be kind to Obama, Kerry and Hilary for forcing Buhari on Nigerians.

No matter the amount of propaganda/ media trial, nothing will justify this nonsensical display by the cabal and APC.

The CCT trial is not a corruption trial.

This is a ridiculous statement. Osibanjo has never been a judge. He was a professor of Law and in addition has been a Senior Advocate of Nigeria, in private practice for many years. He has also worked for the United nations on a couple of capacities as an expert. His firm, in which he was a senior partner specialises in Commercial Law with international aspects to it. He was also the Attorney General of Lagos state. All of the above is easily found out. What I don't understand is how young people are not embarrassed to display their ignorance on social media. Or is it just deliberate misinformation on your part. As for his lordship and Osibanjo, the point is not how they got their money, those of us in the Legal profession know how each of them got what they have got. At least we know how Osibanjo got his. His lordship's source of funds is a tad more opaque but all will be revealed in time.

The point is for public officials to declare their assets so that we they can be open to scrutiny and are accountable. If the Chief Judicial officer of the Land cannot comply with that simple law, we have no hope.

But that's the point. Babalakin, Olanikpekun, Babalola and a host of there top shot lawyers are multibillionares (yes with a 'B'). However you can easily point to thier sources of income besides legal practice.

In the case of Onnoghen, it's not clear since it's been shown all his income cannot account for the €@@$$h seen in his accounts.

BTW I don't think anyone is really accusing him of fraud as such, which is why it's CCT and not the EFCC on his neck (at least for now).

THAT Said, I don't support this recent move by PMB government. They claim they acted thru a court order. My main grouse is the cherry pick of which court orders to obey and which to flout. It NOT healthy for our democracy

Still, the action taken by the FG is wrong and not in the interest of democracy and principle of seperation of powers.

NAIRALANDER, AM SURE WE ARE ALL INTELEGENT AND WANT THIS NATIONAL TO BE THE BEST ??

Barring a late minute change, the Chief Justice of Nigeria (CJN), Justice Walter Nkanu Onnoghen, has a date in court in Abuja tomorrow for alleged failure to declare some of his assets, including about $3million.

Onnoghen is scheduled to be arraigned before the Code of Conduct Tribunal (CCT).

The Federal Government has already filed a six-count charge against him in that respect.

The $3million in said to be lodged in five accounts.

The domiciliary and Naira accounts in the Standard Chartered Bank are coded as USD account No. 870001062650; Euro account No. 93001062686; Pound Sterling A/CNo. 285001062679; e-Saver Savings (Naira) account No. 5001062693; and a Naira A/C No. 010001062667.

The alleged undeclared amount is put at about $3million in the evidence before the CCT.

The charge sheet is dated January 10 and filed on January 11.

Onnoghen will be prosecuted by the Code of Conduct Bureau (CCB) through the Attorney-General of the Federation (AGF), Mallam Abubakar Malami (SAN).

The application to put the CJN on trial was filed by two prosecutors, Musa Ibrahim Usman and Fatima Danjuma Ali on behalf of the Attorney-General of the Federation and the Code of Conduct Bureau.

The application reads: “Pursuant to Section 24 of the Code of Conduct Bureau and Tribunal Act, I hereby apply to the Tribunal for the commencement of trial for the offence of failure to submit all assets and liabilities contrary to Paragraphs 15(1) and (2), Code of Conduct Bureau and Tribunal Act, 11(1) of the Fifth Schedule, Part 1 of the Constitution of the Federal Republic of Nigeria, 1999(as amended) and punishable under paragraph 18(1) and (2) of same constitution against Honourable Mr. Justice Walter S. Nkanu Onnoghen( GCON).

“In support of this application, I attach herewith four copies of the charge, affidavit and summary of evidence consisting of a list of witnesses.

“If the application is granted, we shall be relying on the facts disclosed in the summary of evidence and further evidence the tribunal may consider necessary at the trial.

“I attach herewith four copies of the charge against the accused.”

In an affidavit in support of the application by an investigator with the Code of Conduct Bureau (CCB), Mr. James Akpala said “it is in the public interest to charge the CJN.”

He said: “I know as a fact that the Head Office of the Bureau received a petition alleging that the CJN failed to declare his assets according to the law.

“I know as a fact that the defendant did not comply with the provisions of the Code of Conduct for public officers in that he failed to declare his assets after his elevation to the Supreme Court and immediately after taking oath of office in the year 2005 and he failed to declare his five Standard Chartered Bank accounts in his two forms CCB1 leveled 2014 and 2016 respectively.

“The investigation had been concluded and it is in the public interest to charge the defendant. That all witnesses are ready and available to testify. That prosecution is ready to commence trial.

“At the trial, the complainant will rely on the testimony of the witnesses set down in the list attached hereto and tender all relevant documents in proof of the case.”

The allegations against the CJN are as follows:

“That you, Justice Walter Nkanu Onnoghen, CJN, GCON between 8th June 2005 to 14th December 2016 being a public officer serving as a Judicial Officer in the Federal Republic of Nigeria as a Justice of the Supreme Court failed to declare and submit a written declaration of all your assets and liabilities within the prescribed period of three months after being sworn in as the Justice of the Supreme Court of Nigeria on the 8th day of June 2005 and you thereby contravened the provisions of Section 15(1) of the Coded of Conduct Bureau and Tribunal Act Cap C15 Laws of the Federation of Nigeria( LFN) 2004 and punishable under Section 23(2) a, b, c, of the same Act.

Its very funny that people are lashing out on only Buhari (he also acted stupidly) with so much vitriol when the real culprit is the CJN. A whole head of.the Judiciary. First of all, he didn't declare his assets beacuse obviously he can't describe this sources of wealth. No one screamed Blue murder on something that obvious. Secondly with an authoritarian move, he suspended a meeting that was meant to.act on the CCT's order to suspend him. That move alone is undemocratic, corrupt, selfish and an abuse of power from.a whole CJN because he was trying to delay Justice. No one lost their brains over that. The NBA who should have called him.out on this but they kept mute all because of Partisan politics.

No one brought the internet down. If he had done the right thing, will the Executive have to.step in? This is just Hypocrisy on Steriods!!

Let me tell you the rape of Democracy here, A CJN who has kept a whole body like the NJC hostage, A senate who should.be sitting to.delibrate on national, legislative and budget issues but left their jobs to campaign and also the President for foolishly unsurping the power of an independent body. The anger should be directed at all of them. We should learn to.stop making the same mistakes when we cherry pick with bias on who to call out cus of sentiments that will favour no one. Call all.of them the f*ck out!! Perioood!

This is a well balanced opinion!
