In an affidavit deposed to by the Deputy Registrar/Head of School Examination Department WAEC, Henry Sunday Adewunmi Osindeinde confirmed that Adeleke sat for the May/June 1981 at Ede Muslim High School, Yidi Road, Ede...

Osideinde stated that the examination centre number was 19645 while Adeleke’s number as a candidate in the centre was 149....

WAEC attached a copy of the results of all 221 candidates that sat for the May/June 1981 in the centre at Ede Muslim High School...

Osindeinde said in the affidavit that: “By virtue of my position as Deputy Registrar/Head of School Examination Department, I have read the enrolled order of this court (specifically orders iv, v and vi) dated 11th September 2018 directing and compelling the WAEC to depose to an affidavit confirming or denying the said orders contained in the said enrolled order and referred to in this paragraph And I wish to state as follows:

“The said candidate named in this suit known as Adeleke Ademola, with Centre Number 19645 and Candidate Number 149, indeed sat for the Senior Secondary School Certificate Examination in May/June 1981 conducted by the council at Ede Muslim High School situate at P. O. Box 6 Yidi Road, Ede, State of Osun.

“The copy of the result listing referred to by the court order as the ledger containing the results of all the candidates (001 – 221) who sat for the Senior Secondary School Certificate Examination in the said school is hereby certified, attached and marked: Exhibit WA1.."

Look, what Senator Adeleke is trying to prove is that he qualifies for a WAEC certificate because he sat for one of the subjects in WAEC exams, and not that he was actually presented with a WAEC certificate. It is now left for WAEC to determine if he actually qualifies and present a WAEC certificate to him.

The same Nigeria where Oshiomhole ran to the Supreme Court (just before his second tenure as governor) to get an order to stop an inquiry into claims that he forged his certificate, in the face of overwhelming evidence.

What Adeleke presented was a list of students who were registered to sit for the WAEC exams and a copy of the results of the students that sat for the exams. It is not in doubt that he sat for one subject in which he scored F9. The problem is that is he eligible for a WAEC certificate? WAEC needs to answer that question, and don't forget the issue of fake result presented to INEC and the courts. Somebody must be punished for faking the result.

I said show evidence or screen shot of Senator Adeleke 's certificate and you are posting the same story of he sat for the exams (in which he only sat for 1 subject and scored F9)

The constitution did not say Waec certificate.It says educated up to school certificate level.A court has already settled it

If PDP presented an ineligible candidate, it is not a victory for them. APC had many ineligible candidates disqualified and did not participate in the elections.

What do you understand by School Certificate level?

If a job requires a school certificate level, don't you need to present the school certificate to prove you attained school certificate level?

If a job requires Masters degree level, you mean you will not present your masters degree before you qualify?

Please help me with the link that settled it.

Audu Abubakar was eligible for governorship and so was not disqualified. He died and the court ruled that he should be replaced.

The court did not exactly disqualified the PDP candidate in the omehia case, what it determined was the legal candidate of PDP, and it ruled that it was Amaechi and not Omehia.

The Osun State High in Osogbo, the state capital, yesterday dismissed a suit challenging the eligibility of Senator Ademola Adeleke as the candidate of the Peoples Democratic Party (PDP) in the September 22 governorship election in the state.

The plaintiffs, Rasheed Olabayo and Oluwaseun Idowu, who are members of the PDP in the state, had alleged that Adeleke did not possess secondary school certificate and urged the court to restrain PDP from presenting him to the Independent National Electoral Commission (INEC) as candidate of the party.

They also asked the court to restrain INEC from accepting Adeleke from PDP as its candidate on the basis that the Senator was not qualified, quoting Section 177 (d) of the 1999 Constitution.

In his ruling yesterday, the court presided over by Justice David Oladimeji noted that the claims of the plaintiffs that Adeleke does not possess school certificate cannot disqualify him from contesting the election because the constitution does not state that a candidate for the office of the governor must possess a certificate.

Justice Oladimeji stressed that the constitution only stipulated that the candidate must be educated up to secondary school level, and that with the acknowledgement of the plaintiffs that the Senator attended Ede Grammar School, the senator was deemed to be educated up to the stipulated level

The quack ruling is against PDP, if it eventually turns out that PDP fielded a candidate contrary to constitutional eligibility.

Thanks for the link.
I find this judgement very strange and curious. You know that the courts sometimes give highly political judgements, that's why we need to be patient and wait for the judgements of superior courts.

To me the judge lied when he said that the constitution only talked about secondary school level and not secondary school Certificate level

This is Chapter 6, part 2 of the 1999 constitution (as amended);

177. A person shall be qualified for election to the office Qualification for

of Governor of a State if election as Governor.

(a) he is a citizen of Nigeria by birth;
(b) he has attained the age of thirty-five years;

(c) he is a member of a political party and is sponsored by that political party; and

(d) he has been educated up to at least School Certificate level or its equivalent.

You can clearly see the word CERTIFICATE there.

Because even based on its equivalent senator Adeleke does not qualify as he has no proof that he has any certificate equivalent to WAEC. Maybe certificates from other countries.

If the word certificate is deleted and rendered Secondary School level, it mean anyone that has ever attained secondary school level, ie drop outs, even students that can prove he or she had spent just one day in school would be eligible. No need to sit for WAEC exams.

Even though the Osun State election petition tribunal judgement will definitely be set aside; if it stands however, the person that came second from the PDP primary cannot be a beneficiary if the Abuja high court judgement stands. The implication of today’s judgement is that PDP had no valid candidate in the Osun State election and cannot be deemed to have participated. Consequently, Oyetola being the only valid contestant with the highest numbers of votes remain the elected governor of the state.

It still doesn't matter.
Adeleke is not the governor and APC can't sue him for not being a governor.
Should the judgment stand, PDP will legally replace him.
There are ways this can be done through the court.
