The Court of Appeal sitting in Akure, Ondo, on Saturday, April 6, ruled that the candidate of the Peoples Democratic Party (PDP), Ademola Adeleke, is qualified to contest as governor of Osun state. The ruling thus nullified an earlier judgement of a lower court which disqualified the governorship candidate of the PDP in the 2018 election in Osun on the basis of his certificates. Television Continental reports that the ruling of the appeal court reaffirmed Adeleke’s qualification and eligibility to contest the office of the governor of the state as earlier delivered by a high court in Osogbo. According to the report, the high court in Osogbo had ruled that the governor is qualified having been educated up to secondary school level. Not satisfied with the ruling, the petitioners had headed to the appeal. It was learnt that the appeal court dismissed the petitioners’ claim on three grounds including that the court had no jurisdiction to hear the case. The second ground on which the case was dismissed was that the petitioner has no locus standi to file the case and third was that the matter was brought to court outside the stipulated 14 days after the conduct of the primary. Legit.ng earlier reported that a high court sitting in Abuja reportedly nullified the nomination of Senator Ademola Adeleke as the candidate of the PDP, in the September 2018 governorship election in Osun state. Recall that two chieftains of the All Progressives Congress (APC), Wahab Raheem and Adam Habeeb, had in 2018 dragged Adeleke to court accusing him of not possessing the requisite educational qualification (secondary school certificate) to contest for the office of governor. It was also reported that the Independent National Electoral Commission (INEC) said it can issue a certificate of return to Senator Ademola Adeleke of the Peoples Democratic Party (PDP) only if Governor Gboyega Oyetola of Osun state fails to appeal the judgment of the tribunal that sacked him within 21 days. The commission, on Monday, March 25, debunked rumours that Adeleke had been issued a certificate of return. SOUTH WEST PDP PRESS RELEASE ADELEKE'S VICTORY AT APPEAL COURT. We take due cognisance of the victory of Senator Ademola Adeleke at the Court of Appeal Akure on issues concerning his qualification to contest the Gubernatorial elections. It is gratifying to note that the matter was resolved in his favor, particularly as there is no substance to this red herring accentuated and sustained by the APC for such a long time. Therefore we express our appreciation to the Court for being fair and professional in this matter. This judgment has most fortunately castrated the curious verdict of the FCT High Court, Bwari. While we await hopefully the removal of all roadblocks that the APC has installed to forestall the inauguration of Sen Adeleke as Governor of Osun State, we express our confidence in the Judiciary to do the needful in ensuring that justice and fair play continues to remain as the threshold upon which our democracy is built. Nigeria's Judicial system is another politics on it's own. High Court, Appeal Court and Supreme Court can give 3 different judgement even with the same evidence. It's glaring that the first judgment was a stupid one. 1 Like 1 Share |
