Anyone can tag any situation as National interest, that's why the law is interpreted by the Court.
Not the presidency.

This guy and Magu of EFCC are very very incompetent.

They bungle the simplest of tasks...

I am baffled that Buhari loves useless people as staff.

I support APC but it's mind-boggling. I was really hoping Fashola or Falana would be Attorney General not this fool again!

How's that a stupid question?
The whole point of the court is to avoid anarchy and interpret the law, so when the executive decides to take up that role, then there's problem.
Have you heard of Guantanamo bay? How do you release an anarchist cos courts says so?

Elzazaky definitely is a threat to the unity of the nation. Or if She's is captured today and next week, he's taking to court and he's granted a bail. Will you say government should allow him the bail conditions despite he has a right to be bailed?

this does not make an iota of sense

HOW is that Shiite guy a threat to national peace and interest?

Asari Dokubo was a militant who often threaten the nation and carried out several strikes with his gang. Hence, it is easy to prove a case of "national interest supercedes individual rights".

Can you tell us how Elzazaky has been a threat to Nigeria? Maybe we can then understand how national interest supercedes individual rights in Elzazaky's case.

It's not Malami that said Collective interest or National interest superseded individual interest. It's the Supreme court that said that.

so its the president and or his AGF that determines national interest
so the courts cannot determine national interest
if so, there is no need for the courts to exist because its an open cheque for the cabals/presidency/AGF to manipulate

Yes, we know it was pronounced by the Supreme Court but the worry now is that you are trying to infer that position in the case of Elzazaky.

Are you or Marami or Federal Government a court of law or better still supreme court to pronounce same in the case of Elzazaky.

In which case, Sir? If on the 2 cases (Elzakzaky and Dasuki) then ok but it is not so. It is only the Courts that can determine whose action is detrimental to the State and not Malami, Buhari, or any other person, no matter his position.

But the court is yet to decide his case. Until then, the security personnel has the duty of detaining the accused for the general public interest.

Read to know the happenings around the world. Not only Trump but many US presidents. Goggle Guantanamo bay , there are many inmates out there, whom the court has set free, but till tomorrow , the us government has refused to release them simply because they are deemed threat to US and the world at large. Who now weighs d scale to know where d pendulum points btw public peace and human right. The issue with this govt is that while they love lies they do not know how to lie. It is d duty of d state Attorney to furnish d court with fact to buttress their arguments of public interest vs individual rights and it is d duty of d judges to weigh on d justice scale and give verdicts. That is why there is room for appeal of cases to a superior court if u loose out at a lower one. Malami is not in d position to superimpose his master's selfish interest in interpreting a clear court pronouncement that once bail is granted it must be obeyed and possibly appealed

What is this nonsense you are typing here.

The Public Interest Prevails Over Individual Rights: Malami On El-zakzaky

The immediate past Attorney-General of the Federation, Abubakar Malami has argued that where an individual right conflicts with the public interest, the public interest prevails.

This was in response to a question by Minority Leader, Senator Eyinnaya Abaribe on why he cannot guarantee the rights of Nigerians who have been granted bail but remain in detention. This question bothers on the continued detention of some people, including Shiite leader Ibrahim El-Zakzaky despite the granting of bail by courts.

Malami also said over $779 million have been recovered by the government in its anti-corruption war.

Malami was addressing the Senate on Friday during his screening for a ministerial appointment.

During the screening, Abubakar Malami from Kebbi state went on a long speech about his achievement as the number one legal officer of the country. He spoke at length about the government’s war on corruption

Malami revealed that during his time as the chief legal officer of the government, the balance in FG recovery account from N19bn to N279bn and 12, 412 criminal cases were prosecuted.

“In three years 12, 412 criminal cases were successfully prosecuted in three years. During my time as AGF, we increased the balance in FG recovery account from N19bn to N279bn.”

In his remarks, Deputy Senate President, Ovie Omo-Agege said: “You are a good man, a brilliant attorney. More than that, you are a fearless anti-corruption warrior and that is one of the programmes promised to Nigeria by President Buhari.”

Minority Leader, Senator Eyinnaya Abaribe asked a controversial question:
“Why have you not been able to guarantee the rights of those who have been granted bail but are still in custody?” This question bothers on the continued detention of some people, including Shiite leader Ibrahim El-Zakzaky despite the granting of bail by courts.

Malami argued that where an individual right conflicts with the public interest, the public interest prevails.

Individual rights are paramount endeavor of democracy. Public interest cannot always and freely supersede the individual rights. If pubic interest is meant to prevail over the individual right at every turn of governmental process, there shall be no place for minority. Sometimes I wonder where Nigeria plucks its leaders.

How is Elzazaky a threat to the unity of the Nigeria?

Why do you and the Federal Government appeal his bail to the level of Supreme Court and let the court hold that national interest is above Elzazaky's interest?

You are talking thrash and you make no sense. You, Malami nor Federal Government are not the law. The constitution of the Federal Republic of Nigeria supersedes what you are unilaterally implementing against Elzazaky.

Practically you know nothing about Elzazaky. Ask IBB why Elzazaky was detained during his regime for close to 3yrs. Ask Obj why Elzazaky was also detained during his time. Ask GEJ what led to Elzazaky 3 sons death while he was in power. All of them will brief you. Don't just sit at Nkpor defending Elzazaky
