If he truly has psychiatric problems, them the Nigerian army must be sued. I doubt it'll be proper to retain such a person in the military upon such a discovery.

Sunday Awolola, the soldier who allegedly raped a female student of Adekunle Ajasin University, Akungba Akoko, Ondo State, told a magistrate’s court in Akure that he has psychiatric disorder.

Awolola, through his counsel, Kayode Ikotun, said the army transferred him to Akure from Maiduguri, the Borno State capital, to take care of his health and family.

Ikotun pleaded that the suspect, whose wife was recently delivered of a child, should be granted bail.

He had filed a counter-affidavit to an application by Adeoye Adesegun, the prosecutor, who had demanded that the suspect be remanded in prison for the police to gather more facts.

Adesegun objected to the position of Ikotun and immediately told the court that it had no jurisdiction to hear the rape case.

The magistrate, Mayowa Olanipekun, thereafter ordered that the soldier should be remanded at the Olokuta Maximum Prison in Akure, pending legal advice from the ministry of justice.

Olanipekun also ordered that the original case file of the suspect should be duplicated in the office of Department of Public Prosecution of the ministry.

He then adjourned the case till November 15.

What was he still doing in the army? How can we tell if all the rest are mentally stable? From the way they behave I think a check should be carried out on all of them to determine their mental fitness for the job. We shouldn't be having such persons as part of our security system.

This is an indictment of the Army! This case must be prosecuted to its logical conclusion. If indeed the Army knew that this man de craze and still left him in the force, it raises a national alarm! We then have reasonable grounds to conclude that a considerable percentage of serving soldiers are actually craze men in view of their rampant abuse of power

The idea that soldiers are untouchable is still very alive in the consciousness of our society. Many people see soldiers as an institution to be feared and obeyed at all cost....or at the cost of life if disobedience is chosen.

The soldiers on the other hand see themselves with unlimited privilege and civilians as a stock to be exploited....and if their privilege is denied bullet will settle the score.

This guy raped the student as part of the privilege of exploits....it was premeditated!

People often get hung up on the odd extreme case or two, but you forget that it is also lawyers who are prosecuting this soldier (as well as human rights lawyers who brought this case to light and pressured both the army and the state to take action). The VALUE of defense lawyers to society itself is to ensure that the government meets its burden of proof beyond a reasonable doubt before it could deprive anyone of her freedom or even life. A case like this one may seem clear-cut, but the VAST MAJORITY of cases are not.
