Buhari supports trial of ex-governors

The All Nigeria Peoples Party‘s presidential candidate in the last general elections, General Muhammadu Buhari (rtd), on Wednesday expressed support for the ongoing prosecution of former governors for money laundering and theft of public funds, even as his running mate in the presidential election, Chief Edwin Ume-Ezeoke, snubbed him in the court.

Speaking with journalists at the Court of Appeal in Abuja, Buhari said that he was not surprised that the Economic and Financial Crimes Commission had started prosecuting the former governors.

He said, ”The EFCC Chairman, Nuhu Ribadu, had said on the floor of the Senate that 31 out of the 36 former state governors were corrupt.

”I am not surprised that he has started prosecuting them. ”

Buhari did not agree that the prosecution was selective. Rather, he said, ”the process has started and is ongoing; it is therefore too early to say that it is selective.”

His lawyer, Chief Mike Ahamba (SAN), who was with him, corroborated Buhari‘s views. He said, ”It is only if they refuse to prosecute others that we can say that it is selective. For now, prosecution is ongoing and it will be wrong for us to say that it is selective.”

Meanwhile, there was a mild drama in court when Buhari‘s running mate, Chief Edwin Ume-Ezeoke, on entering the court premises, sighted Buhari and his legal team coming out of the court room. He quickly turned back to take another route exclusively reserved for justices of the Court of Appeal, just to avoid contact with Buhari.

When confronted outside the courtroom, Ume-Ezeoke said that he did not snub Buhari but could not get to greet him because the court was already hearing the ANPP‘s petition, for which he was in court.

Ume-Ezeoke explained that the ANPP decided to participate in the government of national unity to avoid anarchy.

He said, ”ANPP is wearing two caps, one political, the other judicial. We filed this petition to call on the court to make a pronouncement on the conduct of the election and to support the rule of law. We decided to participate in a government of national unity to avoid anarchy and ensure that the country make progress.”

Even though the Buhari faction of ANPP agreed that there were cracks within the party as evidenced in an interview by Ahamba, Ume-Ezeoke said that there was no division.

US not opposed to Kalu’s trial — Envoy

The United States has denied that it is averse to the trial of the former Governor of Abia State, Orji Uzor Kalu, by the Economic and Financial Crimes Commission.

In his valedictory press briefing on Wednesday, the outgoing US Ambassador to Nigeria, John Campbell, said it was not the business of the US Government to dictate to its allies how to run their judicial systems.

He was reacting to media reports in the wake of the arrest of Kalu, that the US opposed the arrest and trial of the ex-governor.

Campbell said, “This is a Nigerian judicial process, it is altogether improper for the United States to comment on such a process and as far as I know, contrary to press reports, we have not done so.

“The United States Government has made no statement absolutely ever about an entire judicial process that is now underway.”

He also noted that although the US regretted the poor conduct of the April general elections, it welcomed the call for reforms of the electoral system.

He said, “The United States will continue to walk beside Nigeria on its pilgrimage to democracy. We share with Nigerians their disappointment over the conduct of the April 2007 elections.

“We welcome the call by Umar Yar’Adua for the reform of the electoral system; we will continue to support the government of Nigeria and the civil society in an effort to strive and improve the electoral law, the tribunal system and promote the independence of the judiciary and the legislature, both at the national and state levels.

According to Campbell, at the moment, the US had earmarked $15 million for a three-year period in support of the electoral reform process, adding that the US was prepared to provide expertise as might be needed by Nigeria.

He said while the US shared the aspirations of the people of the Niger Delta and was prepared to provide development, medical and other expertise for the area, the kidnapping of toddlers was unacceptable.

He said he would like to see more American companies investing in Nigeria as an improvement on the present trade relations between the two companies.

On the influx of arms from the United States to the Niger Delta region of Nigerian, the ambassador noted that he was yet to identify arms used by militants that were made in the United States.

In a related development, some labour and religious leaders have described the ongoing prosecution of four ex-governors on graft charges as a bold step to tame corruption in Nigeria.

The EFCC has arrested former governors Joshua Dariye, Plateau; Saminu Turaki, Jigawa; Orji Kalu, Abia and Chimaroke Nnamani of Enugu State over alleged money laundering.

Former governor Boni Haruna of Adamawa, who has also been indicted by the anti-graft commission, has however not been arrested.

Speaking in an interview with the News Agency of Nigeria on Wednesday in Lagos, Mr Michael Olukoya, the state Chairman of NLC, said EFCC should arrest as many of them as allegedly enriched themselves illegally while in office.

“The bane of Nigeria is corruption. So, any effort made by EFCC, or any agency or group, to reduce corruption is commendable,’’ Olukoya said.

In his own comment, a former President, Trade Union Congress of Nigeria, Dr. Peace Obiajulu, commended the process, adding that there should be no sacred cows.

“It is good, if nobody is victimised. If the accused persons are able to prove their innocence, fine, but if not, let the law take its course.”

Kalu, Turaki: Increased security vigilance at Kuje Prisons

There has been an increased security alert at the Medium Security Prison, Kuje, Abuja following the large number of visitors that has been trooping to the place in recent times.

The number of visitors to the place has substantially increased since Monday, as a result of the incarceration of the former governors of Abia and Jigawa states, Chief Orji Kalu and Alhaji Saminu Turaki.

Based on the development, a prison official told our correspondent that there had been a directive to all the officers to be more vigilant in the screening of those visiting the inmates.

But the Public Relations Officer of the Nigerian Prison Service, Mr. Kayode Odeyemi, told our correspondent in Abuja that there was no need to increase security at the prisons.

”The security at the prison is not threatened at all. We do not need to beef up security for any reason. We have capable hands to handle security at the place at any time.

”We understand that there has been an increase in the number of people going there to visit the inmates. But you have to understand that they have a right to go there.

”However, it is not all of them that go there that are allowed to visit the inmates. It is not everybody who visits a place that has genuine reasons for being there.”

A source at the prison confirmed that since the duo were brought in on Monday, the number of visitors had increased significantly.

Though, according to him, all the visitors were not only for the former governors, the majority of them came to see them.

”The number of visitors here is not usually this large, except when you have high profile detainees. Since Monday, people have been trooping in to visit the two former governors.

”Honestly, senators, House of Representatives members, commissioners and a lot of their family members have been here to see them.

”We used to have less than 50 visitors in a day, but since Monday, we register up to 100 daily. But, we can cope with that.”

When our correspondent visited the prison on Wednesday, he witnessed an influx of many people, just like the day before.

The security guards and men of the State Security Service manning the entry points before the main gate were seen turning away some vehicles, while asking others to park far away from the points.

Nyame stole N1.6bn - EFCC - Court remands him, Dariye in prison custody - Igbinedion, Attah sighted abroad

THE Economic and Financial Crimes Commission (EFCC) has accused the immediate past governor of Taraba State, Reverend Jolly Nyame, of stealing N1.637.3 billion, belonging to the state between 1999 and 2007.


Nyame was a three-term governor of the state, having first ruled between 1991 and 1993, before securing another two terms from 1999 to 2007.


The commission has commenced his trial before an Abuja High Court, Gudu district, listing against him, stealing, criminal diversion and dishonest misappropriation of public funds, as well as bribery and criminal breach of trust.


The alleged offences hallmarked the 41-count charge slammed on him by the anti-corruption commission. The former governor could also not secure his freedom on Thursday, as the trial judge, Justice Abimbola Banjoko, ordered him remanded in prison custody till 26 July {next Thursday}, when his bail application would be determined.


The former governor would have spent about two weeks in Kuje prison custody by the next adjourned date, having been sent to the same custody when he was arraigned last Friday. The commission’s counsel, Mr. Rotimi Jacobs, had opposed Nyame’s bail application on the grounds that the EFCC was still investigating him over other allegations that bordered on corrupt acts while in government, contending that his release on bail could hamper the ongoing probe.


Nyame’s counsel, Emmanuel Torro (SAN), while appealing to the court to consider his client for bail, said the alleged offences were bailable, adding that the former governor had no record of jumping bail.


He added that no ground existed in the counter-affidavit of the EFCC’s counsel that the accused would commit further offence, if released on bail. Torro further submitted that the issue of bail was at the discretion of the court, saying that an accused was presumed innocent until the contrary was proved.


Justice Banjoko, after the counsel’s submission, adjourned the matter for ruling next Thursday. Among the charges against Nyame, dated 13 July and signed by Mr. Isah Bature Gafai of the commission’s Legal and Prosecution, were:


That you, JOLLY TEVORU NYAME, between January and February, 2005 at Abuja in the Abuja Judicial Division of the High Court of the Federal Capital Territory, while being the Governor of Taraba State of Nigeria and in such capacity entrusted with dominion over certain property to wit: the sum of N250,000,000.00 (Two Hundred and Fifty Million Naira) meant for the purchase of stationery by the Taraba State Government committed criminal breach of trust in respect of the said sum and you thereby committed an offence punishable under Section 315 of the Penal Code Act Cap 532 Laws of Federation of Nigeria.


That you, JOLLY NYAME, between January and February, 2005 at Abuja in the Abuja division of the high court of the Federal Capital Territory, while being the Governor of Taraba State of Nigeria and in such capacity entrusted with dominion over certain properties to wit: in such capacity for the purchase of stationery by the Taraba State government, committed criminal breach of trust in respect of the said fund by collecting the sum of N180,000,000.00 (One Hundred and Eighty Million Naira) from the entire sum for your personal use and you thereby committed an offence punishable under Section 315 of the Penal Code Act Cap 532 Laws of Federation of Nigeria 1990.


That you, JOLLY NYAME, on or about 3rd April, 2005 at Abuja in the Abuja Judicial Division of the High Court of the Federal Capital Territory, while being the Governor of Taraba State of Nigeria, dishonestly misappropriated certain funds to wit: the sum of N180,000,000.00 (One Hundred and Eighty Million Naira) which sum formed part of N250,000,000.00 (Two Hundred and Fifty Million Naira) belonging to the Taraba State government approved by you for the supply of stationery for the Taraba State government and thereby committed an offence punishable under Section 309 of the Penal Code Act Cap 532 Laws of Federation of Nigeria 1990.


That you, JOLLY NYAME, on or about 3rd April, 2005 at Abuja in the Abuja Judicial Division of the High Court of the Federal Capital Territory, while being the governor of Taraba State of Nigeria, accepted from one Abubakar Suleiman of Alusab International (Nig.) Ltd., through Salman Global Ventures (Nig.) Ltd., a gratification in the sum of N80,000,000.00 (Eighty Million Naira) (which was not a lawful remuneration) as a reward for the award of contract by the Taraba State Government to USAB International (Nig.) Ltd. and you thereby committed an offence punishable under Section 115 of the Penal Code Act Cap 532 laws of Federation of Nigeria 1990, among other counts.


It was also another day of dashed hope for the former governor of Plateau State, Chief Joshua Dariye, as he was also ordered remanded in EFCC custody by Justice Banjoko till 30 July when his application for bail would also be decided.


Dariye was dragged before the court by the EFCC over allegations that he stole about N760 million while he was governor for eight years.


Dariye’s counsel, Conrad Joseph (SAN), had argued that there was no evidence that his client jumped bail in London, and that he did not interfere with the commission’s investigation.


EFCC’s counsel, Rotimi Jacobs, while opposing the bail application, alleged that the former governor did not honour the commission’s invitation, adding that he jumped bail in London where he was standing trial over allegations of money laundering.


After the submissions of counsel for the parties in the trial, the judge adjourned the matter till 30 July for ruling. She ordered that Dariye be kept in prison custody.


Meanwhile, former Edo State governor, Lucky Igbinedion and his Akwa Ibom State counterpart, Victor Attah, were last Sunday sighted in London where they watched a live football match.


A source stated that Attah and his wife were recently sighted at the highbrow Cromwell Hospital in London where his wife was being treated for an illness.


His wife was said to have been moved out of the hospital to Barbados, his wife’ home country. The ex-governor’s wife is believed to be suffering from a kidney problem.


A former security aide to the former Akwa Ibom State governor confirmed that Attah was out of the country over his wife’s treatment.


When contacted, former media aide to the ex-Edo State governor, Mr. Lucky Wassa, declined comments, saying he was no longer in government.

President Umaru Yar’Adua and Vice President Goodluck Jonathan told the Presidential Election Petition Tribunal in Abuja on Thursday that they were ready to respond to the issues raised by former vice president, Atiku Abubakar, in his petition challenging their victory in the April 21 presidential election.


The full hearing in the petition has been fixed for August 13. The position of the president and his deputy was made known at the pre-hearing conference held by the tribunal. The tribunal, presided over by Justice James Ogebe, directed them to file their reply within the next 14 days.


The tribunal on Thursday also ordered the Peoples Democratic Party (PDP) to file its response latest by next Monday, the Inspector General of Police was given seven working days, while the Independent National Electoral Commission (INEC), was given 14 days to respond to the petition.


Atiku, his running mate, Senator Ben Obi and the Action Congress (AC) in the petition among others, prayed the tribunal to declare the election invalid because of the “unlawful exclusion" of Atiku.


They also requested that the April 21 poll be annulled for non-compliance with the provisions of the Electoral Act 2006 and for "corrupt practices".


Professor Alfred Kasunmu (SAN) for Atiku had asked the President of the Court of Appeal, Justice Umaru Abdullahi, to fix a date for the commencement of pre-trial conference.


When the court fixed yesterday for pre-trial conference, Mr.Joseph Daudu (SAN) on behalf of Yar'Adua and Jonathan, brought a motion on notice, asking the court to set aside the service on his clients because "the petitioners failed to comply with the specific orders of this court as to the manner or mode of substituted service. The mode of service adopted which differed from that specified by the court rendered the purported service a nullity".

How far can the EFCC go?

THE current onslaught of the Economic and Financial Crimes Commission (EFCC) on former state Governors, who allegedly looted public funds in the last four years, and are no longer covered by Section 308 of the Constitution on immunity, is an act of self-redemption for the organisation, but a lot depends on how far it is willing to go, how fair and transparent it is seen to be, and whether at the end of the day, justice would have been seen to have been done. This is all that matters, not the politics and the grandstanding now surrounding the exercise.

Why redemption? With the coming of the Yar'Adua administration, there had been a kind of lull at the EFCC. Before May 29, the EFCC had boasted loudly that many of the state Governors who would no longer be returning to office would be arrested and made to answer questions about their management of public resources. The EFCC indeed announced that it had investigated about 30 Governors and its findings were very bad. Ribadu added that many of the Governors will end up in jail! But after May 29, it was as if the EFCC went to sleep. The people expected immediate action knowing that truly the Governors were capable of running away, what they got instead were chest-beating declarations by some of the Governors that they were untouchable. Added to this were concerns about the continued viability of the EFCC and the place and relevance of the EFCC Chairman, Nuhu Ribadu, under a new administration.

Then, just when everyone had thought that the EFCC was losing relevance, it bared its fangs and began to arrest the Governors and arraign them in court in batches. In the past week, this has been the top story in the land. This is also about the Yar'Adua government. By allowing the EFCC to go after the former Governors, the Yar'Adua administration is also advertising its determination to punish corruption. But how far also, is the Federal Government willing to go? There are emerging questions.

One, the Governors that have been taken to court so far, or that are being targeted are not in the estimation of the public the only ones that they expect to see in the dock. They want other Governors in court as well to come and explain why after eight years of service, the various states of the federation are in such a messy state. The EFCC insists that it is still investigating those other Governors and that it wants to do a proper home work before spreading its drag net. One major criticism of the EFCC now and in the past is that its morality is too selective and vindictive. It must avoid that pitfall this time around.

Saminu Turaki, former Governor of Jigawa state, Orji Kalu of Abia state, George Akume of Benue State, Joshua Dariye of Plateau state, Jolly Nyame of Taraba state, Boni Haruna of Adamawa state and Chimaroke Nnamani of Enugu state are already having a "fellowship" with the law. But really in terms of the quantum of resources that they managed, and before the law, this is not an excuse, these Governors are not in the big league. For this reason, the public would like to see some of the other Governors, the big budget Governors, the ones with homes in all the major capitals of the world, in the dock. Thirty Governors were originally fingered. The EFCC must make sure that they do not run away before the cleansing process gets to their turn. Lest it be said that it deliberately targeted the present set in order to allow others to flee.

Second, the present exercise appears limited to the activities of state Governors between 2003 and 2007. How about the Governors who served between 1999 and 2003? With the sole exception of Abubakar Audu of Kogi state, there has been no known attempt to investigate this category. If the EFCC cannot do so, the Code of Conduct Bureau and the ICPC should step in and bring them to book. And this should not be limited to the Governors. How about Federal Ministers between 1999 and 2007? President Olusegun Obasanjo as well as former Vice President Atiku Abubakar? Certainly, the last two should be investigated afresh in the light of the recent declaration by Dr Shamsidden Usman before the National Assembly that the so-called foreign reserve of $43. 3 billion is a piece of propaganda because what is actually available to the country is $8.8 billion. Nigerians would like to see the dramatis personae involved in that drama of national deception and dispossession in court. Saminu Turaki, the former Jigawa Governor has already pointed in that direction when he disclosed that he provided N10 billion to support the Obasanjo Presidency's Third Term agenda. He is not the first Governor to claim that public funds were used to facilitate that crazy project.

Third, before the present blow-out, the EFCC had made it known that some of the Governors had returned some money and property to the state in exchange for their freedom. This is called plea bargaining. If the Federal Government is going to allow some Governors to escape under the cover of plea bargain then it must allow every other Governor that privilege. But the public must be told why. And the names of all the Governors who have been making reparations should be made known with a complete list of whatever it is that they are returning to the state. Plea bargaining which is part of the EFCC Act is however, an unpopular option with many Nigerians. The Nigerian people have been most affected by the corrupt practices of their leaders. They are frustrated by the absence of growth in their society, and the spread of poverty in their land. Plea bargain must not become an under-hand tool for helping the corrupt to save face.

Fourth, the EFCC rank and file and the leadership love drama and politics. Under the Obasanjo administration, Nuhu Ribadu was quite a voluble public official, who went beyond the call of office to hug the limelight and jump into the political fray. He has been quiet lately. In the matter of the former Governors, he must resist the temptation to adopt his old tactics. Needless windbaggery can only have the effect of compromising the trial in the courts. The media will taunt him; the public will invent controversies, but he must keep his eye on the ball. Doing so means focusing on his job as a professional. And let him keep his distance from the Presidential Villa. The moment the impression is created that he is being used by the Yar'Adua government or by his former boss, Obasanjo to achieve certain political ends, then that would be the effective end of the present exercise.

Five, the EFCC must watch out against the temptation of targeting the former Governors in a manner that suggests that it is interested in a quota system or that a federal character principle is at work. Only those who have questions to answer and their agents should be arraigned. And whoever is invited by the EFCC should be treated with utmost respect. There may be great public disenchantment with the former Governors and what they did in office, but their rights as human beings, their right to dignity should not be violated in any way. The day Orji Kalu was brought to court for arraignment and later remanded in prison custody, EFCC officials, dressed in their official jackets for special effects, were practically shoving and half-pushing the man as the crowd pressed in upon the accused person. Couldn't better security and crowd control measures have been adopted? In the case of Dr Chimaroke Nnamani, his phone was snatched from him and switched off by EFCC officials who turned away persons who had come to see him in the hospital. It is trite law that a man is innocent until he is proven guilty.

But perhaps more important in all of this are the moral lessons. How are the mighty fallen. Say it on the streets of Awka, Enugu, Jos, Dutse, or wherever you wish, that these men who used to bestride the land in siren-bearing vehicles, serenaded by a retinue of fawning aides who mouthed "your Excellency, your Excellency" as if they received special training in the pronunciation of that word, men whose word was akin to law, men who ruled and reigned, men who became so self-important they signed documents only with red and green pens, with flourish, are now helpless reeds in the hands of the law!

Dr Orji Kalu appeared in court smiling, he even waved to the crowd (he probably thought he was on a campaign trail), but having taken a trip to prison, and having spent a few days in remand custody, he must know by now that this is not funny at all. Orji Kalu, we are now told, is an American citizen. But this is not a case of abduction; nobody is asking for ransom, Kalu is only being asked to explain certain things he did as a Nigerian citizen. And na now the man just become American citizen? Saminu Turaki sized up the situation quite early and more pragmatically. He wept. Turaki wept. Chimaroke Nnamani took one look at the situation and opted for hospital custody. To God be the glory! One EFCC official held on tightly to Dariye's right hand as he came out of court. Two months ago, such irreverence would have been considered a breach of protocol and state security. Other former Governors are on the run. Or have since taken refuge in other lands.

. The poet is right: "Life is but a walking shadow, full of sound and fury, signifying nothing". Only if they knew. All the people now strutting their stuff in the corridors of power ("Your Excellency, your most distinguished Excellency"wink should learn from this. E wo iku Gaa, e se ooto.

If there is any honesty in the call for perfection by Nigerians who dont think like Nigerians they will spend more time calling for perfection in the lives of ordinary Nigerians as seen in the pics below, than calling for perfection on how a thief is treated.

They should tell us if those they claim to think like will sit back and watch their citizens go through this sort of life.

12 Other Ex-governors For Trial



Twelve more governors are to be tried by the Economic and Financial Crimes Commission (EFCC) for alleged corrupt enrichment anytime from now, Saturday Tribune can authoritatively report.

The trial of the former 12 governors, it was learnt, was put on hold in order to enable the EFCC make noticeable progress in the trial of the initial five governors that charges have been filed against.

The former governors already in the dock include Orji Kalu of Abia State, Joshua Dariye of Plateau State, Saminu Turaki of Jigawa State and Jolly Nyame of Taraba.

Former Enugu State governor, Dr. Chimaroke Nnamani, has had his trial put on hold because of his ill-health.

A charge has, however, been filed against him before a Federal High Court sitting in Lagos.

One of the former governors reportedly listed for trial is a former ally of President Olusegun Obasanjo, who was stopped by the EFCC from seeking political office at the federal level in the last general election.

One of the alleged biggest financiers of the election of the incumbent president, Alhaji Umaru Yar’Adua, is also said to be one of them.

Before he left office, he alongside a relation who served as a top officer in his government, were said to have returned a lot of money in foreign currencies to the EFCC when they were caught in a money laundering scam.

The list also reportedly contained a controversially-sacked governor in the South-West and another colourful former governor, who battled Obasanjo till both left office.

Another governor that reportedly played prominent role in the eventual emergence of Yar’Adua as the candidate of his party, the Peoples Democratic Party (PDP), is equally said to be on the list.

When some of the former governors contending with Yar’Adua for the party’s ticket were said to be reluctant in stepping down for him as directed by Obasanjo, the former governor, who was in a prime position in the club of governors, was said to have played the final card that portrayed Yar’Adua as the consensus candidate of the governors.

Also on the list is said to be a former governor that reportedly assisted greatly in brokering the controversial Government of National Unity (GNU).

Apart from being a power broker in his party, he is also said to be close to the incumbent president.

His trial was said to have been delayed due to the fact that the GNU was yet to stabilise and he was said to have been spared for now to nurture his ‘baby’.

Saturday Tribune also gathered that Turaki is “critically ill” in Kuje Prison where he is being held based on the order of the court. He is said to be battling with a chronic kidney disease.

A prison source told Saturday Tribune that prison doctors were attending to him and that he could be moved to a hospital outside the prison if so recommended by the in-house doctors.

The source said that apart from two doctors doing shift, there is a permanent doctor on duty, adding that there is no cause for alarm.

Kalu was said to be bubbling with life and mixing very well with other inmates, especially those of Hausa extraction.

Our source revealed that the youthful governor is more like the leader of the inmates now, with almost everybody differing to him.

I don't want those arrested to be governors only. I want to see ministers (especially those in charge of construction work and infrastructural development - they ve done nothing in 9 years) arrested, but let us not overload EFCC, they will probably like to secure the convictions of those already charged before they go after more.

Is arresting just the governors is the solution to corruption in Nigeria?
Believe it or not, there are some ministers, senators, local government chairman, professors, Police (Ehindero) and so on that are much more corrupt than the governors.

And what happened to the second in command to the governors (assistant governors)? Do you really think these folks are clean?

LG Chairmens are also very corrupt, considering the fact that EFCC accused some of the governors of laundering funds through the LGs
