"Subject to the jurisdiction thereof" is the compelling part of the 14th. Foreigners are not, so if they give birth on US soil their kid should not be a citizen. For legal residents/green card holders their kids would be citizens. There is very little case law on this. IMHO Trump will do an EO on this 2nd Term.
