The former Governor of Imo State, Emeka Ihedioha, of the Peoples Democratic Party, PDP, has gone back to the Supreme Court, seeking to be returned as the Governor of the State. He he approached the Apex Court on Friday, based on the following reasons.

1. That Hope Uzodinma was not the All Progressives Congress, APC, Candidate, and was not a Candidate of any party, in the 9th March Governorship election in Imo State, based on the judgement of the same Supreme Court on 20th December, 2019.

2. That Uche Nwosu was declared as the rightful Candidate of the APC and Action Alliance, AA, and was disqualified for double candidature.

3. That APC could not have produced 2 Candidates in one election.

4. That the Supreme Court has no power to allocate votes to any Candidate.

5. That the Supreme Court has no power to increase the number of people accredited by the Independent National Electoral Commission, INEC.

6. That somebody that was not a Candidate in an election, cannot be the winner of an election he was not a Candidate.

7. That the Nigerian Police has no power to organise elections in Nigeria.

8. That results tendered by a Police Officer cannot be admitted in any court as exhibit, as he is not an INEC Officer.

Based on the above facts that are still subsisting, Ihedioha and the PDP have applied for a review, and he may return to his Office as the duly elected Governor of Imo State

1. Parties are bound by their pleadings and litigations.no party can go outside the boundary of their pleadings and all evidences brought outside pleadings is null and void.
See nwokorobia vs nwogu 1994 supra
See oyewusi vs olagbami per jsc kekere ekun.
See shell vs abedi 1974.
The case was between aa and nwosu on his candidature, apc and hope were not joined or made party in that case.therefore,it goes to no issue.
See kakih vs pdp.
This also takes care of number 2 and 3

4.. The supreme court has enormous powers to even allocate or reallocate votes wrongly computed or calculated or inflated.look at the supreme court rules and the constitution.
See sam vs ekpelu 1991
See okoroafor vs nwogu 2010
See uduma vs arunsi.

4 takes care of five.
1 takes care of 6.

7. This is ridiculous and funny, the police never said they were organising any election, they are the to secure the electoral zones and as a neutral party, they are usually given a copy of the result sheets as an inbuilt mechanism to guide against alteration and rigging by pdp at collation point.it is a settled law that the copies given to the police are very important.it is a tie breaker.see uduma vs arunsi.
See sekibo vs uchendu 2018

8. The evidence act 2011 covers the evidence presented by an officer.moreover,he was properly subpoenaed through the igp office.it is not only inec that can tender result sheets.the copies tendered by the officer was that of the police so how can inec tender it?
