2. He is simply relying on the maxim which holds that it is incumbent on he who alleges/asserts to prove- which in this case, is SERAP.

However you choose to look at- regardless of perspective- the will-power to do the right thing seems to be lacking here. No two ways about it. The political class always watch out for their crew.
