l will like to know the legal and logistics cost of divorce of registry marriage (court).
My younger brother's marriage is in shambles for more than a decade now. He lives 150 kilometers away from his wife due to work. Visitation is one way, that is, he is the one that visits the wife and children. The wife does not. The visits usually witness heated argument and sexual intercourse between them may not be more than 2 to four times a year. Also she has packed literally all her belongings from his place 14 years ago.
Though he calls them often and sends money regularly. Sometimes ago the wife declared on the phone that she will no longer allowed him to sleep in her residence if he visits. Not long ago he tried to persuade his wife that it is high time they iron out issues and maintain peace but his wife's reply is full of strong curses, abuses and total rejection of any peace move.
All this while, most of their mutual friends and relatives had tried to settle issues for them but such have not yielded any tangible result. In fact almost all the mutual friends and relatives are no longer interested in calling for a peace talk. My discussions with those who have knowledge of the incessant disputes between the couple indicate that it is better the couple divorce so each can remarry and live a peaceful life afterwards.
A friend of mine says the legal and other logistics costs for initiating and completing a divorce of registry marriage may be up to #500000 or more.
Pls, lawyers on nairaland or other people who have authentic knowledge of registry marriage should advice and give me suggestions. Thanks.

Firstly they are separated and efforts to resolve their union by relatives is abortive. Filing a divorce shouldn't be huge as per amount or sum. It's more than 2yrs stipulated to file for divorce. The divorce process may be pending but as quick as 3-6 months of hearing at court of law. He should get a good lawyer and divorce the Witch

It absolutely depends on the family lawyer that will stand as a legal counsel for her. A lot of these roadside Naija lawyers are rogues.
Many of them might not be competent yet, they charge their client as if they are SANs.
And again, you have screened all advice your lawyer is giving to you because their intention is to keep leeching you by letting the case prolong than time except.
Maybe you don't know, lawyers can work either for the plaintiff or defendants...
Also, they will be telling you that we have to file an application upon applications. The application charges are different from the money both of you have bargained before. And when you compare the amount they charge with the amount they usually pay for the application in court, you will marvel. Some applications are as low as N250 and they will ask you to bring 70k.. .what a wicked world. I hate lawyers because almost all of them are the same except for some god-fearing ones among them.

They can deliberately create an opportunity for the defendants and lawyer struck out your case so that the case will keep on prolonging...

There was a wicked lawyer that helped a client in the case of the landlord and tenant. The case was prolonged for up to 6 and a half years. And for that six years, the tenant was living free accommodation.

My advice is that you should tell your sister to file for children custody (that one is always faster provided the husband showed up) so that all the children will be with their mother (your sister)/ and if she wants to remarry, she should open up to the new guy.... bear children for the new guy live with the new guy, and deliberately expose the new guy on her social media so that the former guy Nah will find his level. But she should not do marriage with the new guy I....but law allow to have children.
if your sister is still living as a single mother, the beast husband might still be.looking for another loophole to devour your sister.

Do you mean that a woman that contracts registry marriage may opt out, marry another man, without actually filling for divorce in court. But just that she be careful not to contract married with the new guy?

There is a difference being separation and divorce. Depending on the marital issue and what your lawyer file for you in court...
The separation allows partial freedom from the ex-husband. But the divorce gives total freedom...without divorce certificate, it is a crime to legally marry another person but with separation, you can carry your children anywhere without consent from husband...and when your sister see the guy she likes, she can cohabit with the person and bear children for him.
Nobody can tie another person's marital destiny on the ground.... Soldier go and solider comes, barrack remains forever. I have seen this happening to many couples who are permanently separated. So, don't let one guy tie your sister marital destiny on a pole like a ram
