Well said, the Federal high court judgement in ph is null and void because it doesn't have jurisdiction over a state matter. The case ought to have been heard in Edo state because its a state matter, no federal body is involved.

No,it is not.federal high court have jurisdiction on both state and federal matters and inec,national party chapters are under their jurisdiction

The High Court of a state/FCT is the highest English law court in a state or the FCT. The High Court of a state/FCT and the Federal High Court have similar powers.

It will be ignored by INEC. There's already an order From ph.
The Fed High Court did not restrain Obaseki from contesting. Please read the order of that court and what it did was to order for substituted service on the parties through a national daily newspaper the matter was adjourned to Thursday for hearing. There are plethora of Supreme court precedent that protects Obaseki's participation in the PDP primaries and that is what the Edo State High Court Ekpoma Division relied on for the order it granted. Now based on that order which can only be challenged at the Appeal Court, whatever the Fed High Court will rule on Thursday, the day of PDP's primary, which definitely will not restrain Obaseki based on past Supreme court decisions, will have no consequence because a court of concurrent jurisdiction has already ruled, allowing him to participate. One step ahead.

For your information, the Order of interim Injunction from Federal High Court, Port Harcourt and the one from Edo State High Court are conflicting Orders given by Courts of coordinate or equal jurisdiction and both are based on the same subject matter. So, the position of the law in that circumstance is that where there are two conflicting decisions, judgments or orders given by two different courts of coordinate or equal jurisdiction, the latter in time prevails over the former, because it is taken that the latter has overruled the former and the former becomes inoperative in the light of the latter. Therefore, the Order made by Edo State High Court on 23rd June, 2020 takes priority over the one made by the Federal High Court, Port Harcourt on 22nd June, 2020, since the Edo State High Court Order was made later and both are courts of equal jurisdiction.

When it is APC,
"They are courts of equal jurisdiction so the judgement won't stand. They should should have gone to the court of appeal"


And when it is PDP
