A London High Court of Justice, Queen’s Bench Division, has placed a worldwide order (mareva injunction) against the assets of Mr. Ifeanyi Ubah and his company, Capital Oil and Gas Industries Limited.

This is just as the feud between Ubah and the Chairman of Coscharis, Mr. Cosmos Maduka, has taken a new twist as the Capital Oil boss Wednesday sent a petition to the Inspector-General of Police (IG), Mohammed Abubakar, alleging threats to his life. He demanded the arrest of Maduka over the alleged threat.

The order by the UK court, which was granted sequel to an application by Access Bank Plc, is aimed at preserving the assets of the respondents pending the determination of the suit brought before it by the bank.

The bank had alleged that Ubah and his company had fraudulently diverted the petroleum products it financed under the joint venture agreement between Capital Oil and Coscharis Motors Limited.

Also restrained alongside Ubah and Capital Oil and Gas Industries Limited, are Rofos Navigation Limited, Xifias Navigation Limited, Heli Navigation Limited and Tutbury Maritime Limited.

[b]THISDAY checks revealed that the order of the UK court, obtained last Friday, was given three days after Ubah and his company obtained a similar injunction in Nigeria restraining the bank and Coscharis Motors Limited from interfering with his assets.
[/b]The court, presided over by Mr. Justice Cooke, ordered that until the return date or further order of the court, Ubah and company, Capital Oil, must not remove from England, Wales or any other part of the United Kingdom, any of their assets which are in England and Wales valued at over $133 million or in any way dispose of, deal with or diminish the value of any of their assets up to the same value.

The injunction covers the following assets: The property and assets of the respondent’s business known as Capital Oil and Gas Industries Limited at 1, Capital Oil Close, Westminster; Ibru Jetty Complex, Ibafon Apapa, Lagos State; or the sale of the money, if any of them have been sold.

The court also ordered that until a further order of the court, the respondent and each of the parties are prohibited from taking any steps whatsoever, whether directly or indirectly, to dissipate, dispose or in any way impinge on Access Bank’s right in and to any product covered by six Bills of Lading dated October 8, 2011, October 14, 2011, October 18, 2011, November 10, 2011, November 13, 2011, and December 21, 2011 including (but not limited) to products that have been and will be received into the shore tanks at Apapa, Lagos, and in particular, approximately 40,000 metric tonnes received in June/or August 2012.

The court further directed that Ubah and Capital Oil should within seven days of service of the order swear and serve on Access Bank’s solicitors an affidavit of all their assets worldwide exceeding £50,000 in value whether in their own names or not and whether solely or jointly owned, giving the value, location and details of such assets.

It noted that failure by the respondents to comply with the orders of the court would be tantamount to contempt of court.

The court also spelt out other consequences, which the respondents would face should they fail to comply with the orders to include being fined or have their assets seized.
The court further added that Ubah and officers of the company could be sent to prison and their assets seized should they fail to obey the orders.

The order of the court warned thus: “If you Capital Oil and Gas Industries Limited disobey this order, you may be held to be in contempt of court and may be fined or have your assets seized and your officers may be sent to prison, be fined or have their assets seized.

“If you Ifeanyi Patrick Ubah, disobey this order, you may be held to be in contempt of court and may be imprisoned, fined or have your assets seized.
“Any other person who knows of this order and does anything which helps or permits either of the respondents to breach the terms of the order may also be held to be in contempt of court and may be imprisoned, fined or have their assets seized.”

The court adjourned further hearing in the suit until November 16, 2012.
But Ubah, in a letter written to the IG through his counsel, Robinson Apkua, alleged that Maduka has been threatening his life.

The letter reads: "We are solicitors to Mr. Ifeanyi Ubah of Capital Oil and Gas Industries Ltd. and on whose behalf and mandate we write this petition.
“We write to formally inform you about the libellous publications against our client and also threats to his life by Chief Cosmas Maduka of Coscharis Group.

“Our client informed us that sometime in 2011 he entered into a business transaction with Maduka. The business was flourishing until Maduka became dissatisfied with the outcome of the business, consequent upon which he has filed a petition to your office.

“While your men are investigating the matter, which is purely a civil contractual relationship with its attendant rights and liabilities, Maduka went on air – Channels Television and AIT – to slander our client.
“He called our client all sorts of names ranging from a thief to an international fraudster. As though that was not enough and still not allowing your men to do their job, Maduka took four pages in some national newspapers libelled our client and repeated his slander.

“Our client's life is now being threatened as he receives anonymous calls urging him to pay those he owes, while also receiving text messages from unknown persons demanding that he must share the ‘loot’ apparently in reference to Maduka's allegation that he (Ubah) duped him of billions of naira.

“May we point out that our client has neither been convicted of any crime by any court law nor has he been adjudged liable for any breach of contractual business relationship with anyone, including Maduka."

Ubah’s counsel asked the IG to cause the arrest of Maduka, investigate the libellous publications and cause him to write a letter of apology within seven days or face legal action.

Apkua also asked the IG to warn Maduka to desist from further libellous publications against his client pending the conclusion of the police investigation and pending court case or he risks contempt of court.

However,I hope this whole episode exposes and disgraces Aig Imokhuede and the criminal operations he runs under the guise of banking.Using fraud and dubious strong arm tactics to steal or forcefully kill or take over the businesses Access bank granted facility as well as taking over even banks(intercontinental bank for instance) that Aig's companies are indebted to,shows this man is worse than all the oil marketers he is purportedly investigating put together.

Boss13: Now when people tell you to go and study accounting you will refuse. Business-wise Cosmas did not borrow the money, Coscharis Capital Oil did, regardless of the fact that he sits on the board of both companies. True, directors and non-directors can borrow and where they have an interest in another company, this should be declared. No CBN Act refuses any director or NED not to borrow but there must be scrutiny (for example, Management Credit Committee cannot advance a loan greater than its approval limit). FYI, banks do not lend to you based on security but based on the nature of business. However, it is a regulatory requirement under BOFIA 1991 (revised 2009) that banks should ensure there is security for any loan advanced to customers. Negative pledge is a world-wide practise (a lot of blue-chip or what you call multinationals borrow based on that). Dangote borrows on Negative Pledge. Cosmas Maduka has not said he cannot paid, the issue on ground is that the vessel (consignment) is missing?

If you do an independent review of the transaction, you will see that in all genuineness, it is a business worth doing for the growth of all interested parties. However, certain persons decided to be smart as they always are, which to me is just plain stupidity. Ifeanyi is running his mouth, he has forgotten that he did a personal guarantee for Cosmas Capital Oil. Such a foolish man.
Since you have educated yourself enough, you did skip one thing that at the time this loan was given, there was no security tied to it. Is it because of the negative pledge or what, why did they after many months these LCs were opened, did they now begin to hunt for securities which Ifeanyi gave to 'help his Uncle' Cosmas...lol. You want to come here and speak English. His Uncle, Aig of Access and Ifeanyi are one and the same. Please don't undo their common ties...lol

Your position that Cosmas was emotional while speaking is neither here nor there, he admitted he took some decisions emotionally and he regrets it with what is playing out now and that as a result of his position in the bank and what he was entitled to he practically took the loan on behalf of ifeanyi and made him sign as a guarantor for the goods. Ifeanyi signed, now that he can't produce the goods they are going after his assest and he was ranting on TV that they were going after his assests.

So because Maduka was emotional with his decision( which was wrong considering what's going on now) ifeanyi should go scot free.
Ten delivries? you seem to have the figures right.... how about the 21billion sitting with Access yet to be accessed by Ubah bcause Access and Cosmas claim that Ubah has not delivered accordingly. What about the subsidy payments due to Capital, held back by Aunty Ngozi who has refused to pay Capital so as to allow Access deal with Ubah and take over his investments. coded guy: I saw ifeanyi Ubah's interview in channels and I just read this here, comas maduka's side of the story. Its obvious Ubah is a thief! The question is Where are the goods? If he had successfully delivered on this deal, it would have opened up the chance of doing more legit business with Maduka and the bank and even make more money.

The guy is an illiterate and could not see the bigger picture.
If this is the story that you read and decided to call Ifeanyi a thief you must be Cosmas then... you can't even be objective enough not to lie inbetween your teeth, I have read this before I saw Ifeanyi on TV. Whilst Cosmas spoke with emotions, Ifeanyi dropped business facts on the table. Ifeanyi or Capital Oil never took any loan from Access Bank, Cosmas did.
Cosmas took advantage of the fact that he was a director in Access Bank to give himself a loan of over 288million USD ignoring all forms of corporate governance if Access had any.
Cosmas was greedy to the teeth.
He should lick his wounds and how dare Cosmas dafam the character of Fred Ajudua who is yet sentenced by any court for economic crimes when he was trying to describe and kill the chracter of Ifeanyi Ubah. Absolute bullshit.

If you are a shareholder of Access Bank and you have not started dumping your shares in the market, I pity you. Such a bank where ethics is lacking is bound to go down.
CBN is probably working with ACCESS to take over Capital. Sanusi is not clean, himself and and Aunty Ngozi want to reap where they did not sow. I am just saying Maduaka and AIG are stupid for thinking they are above the law, yet they are shouting foul play. How dare they (Maduaka and Aig) disrespect a court of the land empowered by the set principles of the 1999 constitution of the Federal Republic of Nigeria. zebudaya: No business man invests $285 Million dollars into a business to "help his brother's business". He did it out of pure greed after calculating his ROI. Ifeanyi Uba said the money they are asking for, is frozen by Access bank and the government, so he can't pay. He also said "They are all in this together" even the ministry of Finance. NOI and co.

They are all guilty and looking for a fall guy. They want to give a goat a bad name only to hang it, and then it's back to business. This is the same type of trial that Jesus Christ had, with the masses screaming crucify him, crucify him. The Government should probe the fraud, name all the fraudsters and stop bullshitting we the people with panels and committees who lure ideas down an alley and strangle it to death.
I agree. How can you put a man who is as guilty as the accused as the head of a panel to investigate people like him. AIG and the board of directors of Access Bank are all thieves. They have a trend of taking over people's businesses. No wonder AIG and HERBERT were laid off by GTBANK and never got the promotion they deserved because of these sort of tendencies.

Federal High Court sitting in Lagos, presided over by Justice O. E. Abang, Monday restrained Access Bank Plc and Coscharis Motors Limited, who were absent when the order was given, from interfering with the properties of Capital Oil and Gas Ltd, pending the determination of a substantive suit before the court.

Access Bank Plc and Coscharis Motors Limited are defendants in a suit instituted by Capital Oil and Gas Limited and its Managing Director, Mr. Ifeanyi Patrick Ubah, before the court challenging the veracity of the defendants’ claims in respect of an alleged loan facility, the terms of which they claim have been breached by the plaintiffs.

When the matter came up for hearing last Friday before Justice Abang, the respondents were neither in court, nor represented by their counsel notwithstanding that they had been served with the court processes.

Counsel to the applicants, R. A. Lawal Rabana (SAN), informed the court that he was in court to move the application, dated October 30, 2012, and which was duly served on the defendants.

Rabana stated that the writ of summons was served on the defendants much earlier with the application and motion. The plaintiffs’ counsel also informed the court that the hearing notice of the motion was equally served on the first and second defendants on the 6th and 9th of November respectively.

The court noted that the defendants had seven days under the rules of the court to respond to the court processes served on them, whether positively or otherwise, and that by the records in the court’s file, the seven days had elapsed.

After confirming that the defendants were properly and duly served the originating court processes in respect of the application, including the hearing notices, the court satisfied itself that the respondents were fully aware of the sitting of the court and were not in court and did not send a lawyer or a letter to give reasons for their absence.

Capital Oil’s counsel therefore urged the court to allow him to move his application, which he termed “very urgent”. He informed the court that the respondents were moving at alarming speed to deal with and destroy the assets, properties and business interests of the applicants, including third party assets and businesses, which have dealings with the applicants.

Rabana also told the court that the respondents had arrested two ships carrying the goods and consignments belonging to the applicants. He said one of the ships was arrested in South Africa, while the other one was arrested in Nigeria.
The lawyer also informed the court that the respondents were wreaking great havoc on the business interests of the applicants.

The respondents, he said, filed an action at an English court, which they now use as a basis to go after the assets of the applicants worldwide.
Rabana therefore prayed the court to give a preservative order; otherwise, by the time they come back to the court, there will be nothing left for the defendant because the respondents would have destroyed the res (thing(s) as well as immovable or real property).

After listening to the applicants’ counsel, the court confirmed from the registry that the respondents were duly and properly served with the originating processes of the case, the court then allowed the applicants’ counsel to move the motion, and the court reserved ruling for Monday.

Giving its ruling yesterday, the court looked at the unchallenged depositions of the applicants’ counsel alongside the supporting affidavits and noted that it was the duty of the courts to protect the rules of court.

The judge therefore granted the interlocutory order restraining the defendants, their agents, privies and or servants or any other body acting on the instructions of the defendants from interfering with the properties and businesses of the applicants, pending the determination of the substantive suit.

The court also ordered the applicants to file an indemnity within 48 hours to indemnify the court in the event that the court ought not to have made this order or the order was found to be frivolous.
The matter was fixed for further hearing on January 21, 2013 and the court ordered that hearing notice be issued to the defendants.

The plaintiffs had in the Motion on Notice sought for an order of interlocutory injunction restraining the defendants/respondents, their agents, privies or any other person(s) acting for or claiming through them or acting on their behalf from interfering with the applicants’ properties and business interest, pending the final determination of the suit

Technically speaking, the guy is so correct. He pointed out that how can a bank avail $288m without any form of securities to its director Maduaka...lol. This true and funny. Meanwhil small businesses will need as low as 10million naira to grow, this banks will either turn it down or hold down all assets in your name. This is where Diamond Bank stands out, they are the highest supporters of small enterprises with good directions for growth.

They are all skimmers.... remember intercontinental gave Aig loan to buy access, Aig found a way not to pay back his loan to Interncontinental bank by arranging with Sanusi to buy it. They are all fraud.

Maduaka is a long throat thief... $288million USD, who ever does that? As far as am concerned, Ifeanyi's explanation on TV is more apealing than Maduaka bringing emotional sentiment. Aig of Access is simply a thief on suit, he should be investigated. You cannot be hawk and a lion at the same time. He is always preying for good businesses to forcefully take over. The guy anf Herbert are just criminals sniffing for juicy businesses to bring down and take them over. I hear Aunty Ngozi was cut a deal if her plans with them works out....lol So much for a world class Finance guru.

Four African girls have created a generator that produces electricity for six hours using a single liter of urine as fuel.

The generator was unveiled at last week's Maker Faire in Lagos, Nigeria, by the four teens Duro-Aina Adebola, Akindele Abiola, and Faleke Oluwatoyin, all age 14, and Bello Eniola, 15.

So how exactly does the urine-powered generator work?
•Urine is put into an electrolytic cell, which separates out the hydrogen.
•The hydrogen goes into a water filter for purification, which then gets pushed into the gas cylinder.
•The gas cylinder pushes hydrogen into a cylinder of liquid borax, which is used to remove the moisture from the hydrogen gas.
•This purified hydrogen gas is pushed into the generator.

And as for delivering the fuel itself? Well, we'll leave that up to the consumer.

The Maker Faire is a popular event across the African continent, drawing thousands of participants who travel to Lagos to show their inventions and other practical creations.

As the Next Web describes it, the Maker Faire is intended to highlight creations "that solve immediate challenges and problems, and then works to support and propagate them. Put another way, this isn't just a bunch of rich people talking about how their apps are going to change the world.

If you say Ifeanyi is, what about the people who accused him of fraud without weighing the legal implications. Did you not watch the prgram this morning. Did you not hear Ifeanyi declare that Capital Oil does not have any running loan with Access. Under law Maduaka secured a loaned money from access without any form of security. Isn't fraudulent or the highest form of it. He isdirector of the bank and used undue access to the bank to secure loan for his interest in oil and gas.

Access Bank and Maduaka does not have a case.

Maduka is carelss with words.. How can you say Ifenayi is a combination of Ajudua and three other rogues when you whre not forced to take business risk with him. If I was Ajudua and co, I will sue him for defamation of character. Non of these guys have ever been found guilty of any crime so far.
Maduaka is empty and quick to ride on emotions than facts.
This man has explained in clear terms that Access bank is equally fruadulent and broken bOFA laws by granting loans without securities of any kind. Nigeria is just a jungl were rascals like AIG are heads of bank and backed by Aunty Ngozi to emerge CBN governor in future. Every reasonable banker in Nigeria should and must kick against these evil calculating plans. Aig should be investigated.
