APC out of desperation and frustration are fielding nameless party to usurp the already sealed tussle. All the States they rule are suffering, even their father buhari is a renowned failure and disappointment. Looting common men tax is their problem.

Meaning it is a pre-election matter and election petitions tribunal do not hear pre-election cases.
Only a regular court like the Federal High Court can have the exclusive rights of original jurisdiction.

The only caveat is the "qualification or nomination" (certificate etc) of the candidate been challenged.

Just like the case filed by Diri against Lyon....

The Judgement cannot stand.

Several standing makes the judgement shaking before the appeal.

1. statue barred 180 days and maximum 201 days for tribunal sitting.

2. Pre-election matters

ORIENTATION101:

If inec doesnt appeal . diri will vacate the seat until inec conduct fresh Election which will include APC candidate

Diri will appeal because he was a party to the said case

3. No locus because the deputy's nomination is not in order because he is below the constitutionally-required age to even institute the case in the first place.

Exactly, i'm still looking at the standing point of the other two judges.

from their judgement what they are basing their argument on was the latest judgement affecting parties de-registration.

Can you also give a detailed explanation of the reasons behind the two dissenting decisions? This one sided minority opinion cannot stand in the face of scrutiny. Media sensation cannot reverse the judgement. Only the courts can and PDP will need more than a minority report to do that.

Justice Sirajo opined that it was a pre-election matter and should have been handled by a Regular Court and outside of the jurisdiction of the tribunal.

Again, the Constitution is superior to the Electoral Act.

And the issue of fake certificate by APC deputy governor nko? Is that post election matter?

"The constitution is greater than the electoral act" is it also greater than the sharia law?
If yes then those unconstitutional judgements in Kano should be appealed and voided ASAP!

It is a pre-election matter but it was instituted at the Federal High Court in Abuja not at the tribunal.

.....perhaps, you will have to personally open the INEC window and personally handle the substitution of the APC deputy governorship candidate. Well, if higher courts uphold the majority judgement, APC will have to support another political party's candidate who will eventually decamp to APC if he/she wins - just like the 2019 scenario in Rivers State gubernatorial election.

ORIENTATION101:

There is difference between

Re-run( continuation of existing Election)

Fresh Election ( all political parties start allover again)

It very confusing what we want as a nation. I thought we all clamoring for a better Nigeria since we not directly benefiting from these set of people. How can we see something that is black and call it white. We all know these case should have been thrown out by the tribunal and yet some people are still supporting this idiotic judgement. Let face it, the judgment is a mockery of our judiciary, I hope the apex court correct this judgment.
