AAA593 ejimatic The tribunal thoroughly erred. A similar case had been taken to the Court by APP..that they were excluded. INEC argued that the time had elapsed for substitution of names and that was why they excluded the party. Justice Ojukwu of the FHC, Abuja upheld INEC's position that the APP did not meet the stipulated conditions of INEC. (FEB 21, 2020) APP appealed the judgement.and the Appeal Court dismissed the case in favour of INEC. Guess who led the panel? As for the case of APP and INEC 2020 it was a court of law that upheld the exclusion of APP not INEC..So INEC erred by usurping the duty of a court in the Bayelsa election. So ANDP disqualification. by INEC is iunconstitutional. |

fergie001: Tribunal for Nigeria,mtchew... The tribunal decisions are binding upon the parties. However, they’re appealable or challengeable in the court, provided the law under which the tribunal is established provides for the opportunity of appeal to the higher courts. You can't change court decision in a tribunal meaning,this matter no get weight. |

I disagree with this dissenting judgement. The letter written by INEC had no locus standing if the party fulfilled all constitutional requirements so they didn't need to challenge the case at high court. Secondly the question here is who has power to disqualify or pronounce a candidate illegible. INEC or court, this case has been settled even recently in Kogi election. Court is the only one with power to do so even in David Lyon case in the same election. |

On the day PDP was presenting his witnesses the judge that gave majority judgement was there .On the day APC was presenting its witnesses he was not there at all .Yet he went ahead to assess witnesses he did not see in his judgement. Is that a fair hearing? If you were in APC would you be happy? Section 258 of the constitution says the sitting on that day when all members were not there is a nullity.. In my opinion it is a case of miscarriage of justice not technicality. |

AAA593: INEC did not disqualified the Party but the Court disqualified the candidate not the Party which mean APC did not field any candidate in that Election. So in Fresh Election what all parties need to do is field Qualified candidate, if the Electoral Law permit renomination. |
