The court is clear on the ruling, inec have no constitutional power to remove a candidate or political party whether they re ineligible or not.

The power lies in the hand of competent court of jurisdiction to do so.
What are the powers of inec then?? Just counting votes??

Appeal court will right the wrongs of the tribunal.
APC celebrated in vain. No fresh election.
The whole thing is a game. I am sure the APC sponsored the party to the tribunal and upturned Diri's candidacy.

The party knows it doesn't stand a chance. The goal is to push for a restart and then force everyone to the starting race line.

Most smaller parties are sponsored by the big parties to either split votes, serve as a cog in a candidate's wheel and force an election to be cancelled.

Where the bigger party step in is via the judiciary.

What does INEC want us to do here? Court settled it in Zamfara state when it gave PDP all the political posts in the state without winning a single post! It happened in Bayelsa state again through the court with the PDP ruling the state with infinitesimal votes! What do you want to happen here, believing INEC instead of court?

INEC doesn't have the right to remove the entire party from participating in an election, either ineligibility of a candidate or not.
That power solely lies in court

maybe you lack comprehension .
Inec laws is for conduct and supervision of election.
If any political party candidate didnt meet up with inec requirement , the matter has to go to the court and inec will be issued a valid court order to back their claim.

If inec fail to approach the court , whatever actions they took regards to the candidate is nullity.

Clear terms. If you catch a thief stealing from your house, you have to charge him to court with your evidence.
If the thief die as a result injuries he sustained from beating you will be charge for murder, cos no court pronounce the thief guilty

So if a confused political party decides to submit the name of a ten years old to INEC is name must be printed on the ballot against the constitutional provisions that says you can only vote and be voted for from the age of 18? Even when INEC wrote to the party citing the constitutional infractions the party is allowed to play on our sensibilities simply because they feel that INEC has no power to remove an ineligible candidate?!

supreme court in 2007 has already ruled that inec has no power to remove candidate or party. The decision lies with the court.

Recent cases like APC in zamfara, rivers, bayelsa is an example where only court disqualified their party and candidates that participated in election

so you are saying that even if inec state the requirements of contesting for an election and a party default it, inec has no right to kick such person knowing that what was presented was forged or not what was required by inec

well court dont rule on emotion. It will won't take anything from inec to get a court order to stop any political party that didnt meet up with requirements in order to avoid unnecessary legal issues.

supreme court in landmark judgment in 2007 has already ruled that the power to disqualify a party/ candidate lies with the court.

Inec duty is to conduct and supervise election process.
You have to be qualified first in order for you to participate!

No argument here.
My problem is how come these things were not communicated to the court before the ruling. So it's safe to say our court just rules without proper findings or investigation. Our system is messed up.

You don't even know the implication of what you're talking about.

Meaning that even a teenager can just wake up tomorrow register a party and contest for an election since inec doesn't have the power to stop him or her?

Deadline was Sept 9, and INEC wrote them on Sept 13 to advice them that the Deputy Governor wasn't qualified.

Most Nigerians and their strength of comprehension should make a case study. There are before and after election matters. In addition, there are issues which require the investigative powers of the judiciary to tackle. INEC does not have the subpoena powers of the court. In this case, the matter is centered on pre-election issue and does not require the investigative powers of the court therefore INEC has the power to disqualify.

It is the duty of a court of law to disqualify a candidate not that of the INEC even if there are reasons to do so..No where in our constitution or electoral act empowers INEC to disqualify any party or candidate.The INEC letters have no locus standi on this matter..The commission can only raise alarm for the notice of the party not to disqualify it. Lyon' s deputy in Bayelsa was disqualified by a court not INEC. It was a court that disqualified APP in Kogi ( INEC vrs APP I2020 ) not INEC The decision of justice Ochuckwu was upheld at the AC. The Supreme court several times has upheld that INEC has no legal right to disqualify anybody or party.This is an area I agree with the lead judgement.
