The tribunal was right. INEC has no power to disqualify or remove any candidate or party in any election. INEV job is to lay the rules and it’s the court’s job to interpret the rules. I may not be APC’s apologists but law is what it is. INEC needs to conduct fresh election although APC as a party won’t participate because according to the Supreme Court, they don’t have a candidate hence, not eligible to participate in the election.

many of those minor parties are not serious, some will indicate to run and tomorrow they will be following another bigger party. The parties know the rules, they are aware of the deadlines, inec only told them it was late after they indicated interest to substitute the name that it was late. If their name was on the list, it will be of no use. This is one of the disadvantages of those minor useless distracting parties

the name on the list is useless. In an average gubernatorial election with the number of parties we are having, this is the best inec can do. Many gubernatorial candidates will start and most will just fixxle out without noticing anybody.

No they will because no one has challenged their eligibility in court so far and no court of competent jurisdiction has disqualified them, so they will participate though they won’t substitute the deputy. Though them participating is an exercise in futility.

INEC's the referee, it can decide as guaranteed by the electoral law and the constitution but when we disagree with its decisions, we go to court.

Let's keep our fingers crossed and wait for the Appeal Court. At least Diri has indicated he is heading there.

I also believe that the document was submitted to INEC secretariat in Abuja since it's the National Chairman of a party that must send the name, why was there no one to proofread the forms so as to correct any anomaly, what if the year was an error, INEC would have disqualified the candidate based on an error they admitted late.
I'm still waiting to see if same INEC would reject the name of APC candidate for Ondo State election since the party currently has no national chairman that is meant to send the name according to INEC rules.

Assuming without conceding that he was ineligible, the Supreme Court have said that INEC does not have the power to disqualify a candidate, without a court order - Action Congress and Anor v INEC (SC 69/2007). seeing that an ineligible candidate was presented, what INEC should have done was go to court and get an order to exclude ANDP from the ballot for fielding an ineligible candidate. Excluding them without the go ahead of a Court was ultra vires the powers of INEC, and now tax payers money will be wasted on another election. Someone should be held accountable.
