The Appeal court should instead nullify the Election tribunal itself, when supreme court comes again with a different opinion they should also nullify appeal court , so we will know that everybody is kuku mad

138 (1) An election may be questioned on any of the following grounds, that Grounds of petition is to say-

(d)that the petitioner or its candidate was validly nominated but was unlawfully excluded from the election.

This is section 285(14)c:
For the purpose of this section, “pre-election matter” means any suit by –

a political party challenging the actions, decisions or activities of the Independent National Electoral Commission disqualifying its candidate from participating in an election or a complaint that the provisions of the Electoral Act or any other applicable law has not been complied with by the Independent National Electoral Commission in respect of the nomination of candidates of political parties for an election, timetable for an election, registration of voters and other activities of the Commission in respect of preparation for an election”

Looking at (d), Was the ANDP candidate "unlawfully" excluded?! If a party decides to deliberately submitts the forms of a 11 years old to INEC as a candidate for any guber election, are you now saying that INEC has no power to uphold the law backing them that says a candidate must be above 35 years to be able to contest as a governor?!

Can you submit a name of a Gov without his deputy and say INEC has no power to reject it?

The Supreme Court was clear in the Zamfara APC issue that INEC reserved the rights to enforce its own guidelines.

So for your answer......INEC has a right to reject an invalid nomination.

That is very ambiguous and neither here nor there.the electoral act was clear and ambiguous.you need to understand the purpose of the electoral act.the lawmakers simply extended that power to tribunals.
The tribunals in recent times have been legislating on disq without any enabling law.why shouldn't they sit on unlawful exclusion which has an enabling law? You sef.drop this issue

How did the judges miss this in the initial judgement. Even a non layer can figure there was no case here.

Yes but that is outside inec guidelines.it is constitutional provisions which can only be enforced by courts not inec

This law came to be in June 2018, and took effect immediately.
The Court has said times without number that trial courts shouldn't ditch issues on technicalities, hence, even if the claims were wrong, it will be erroneous for them to just strike it out without adducing reasons.

Justice Sirajo quoted same.

Bottom line, INEC has no power to disqualify or exclude a party from participating in an election because it doesn't screen candidates of parties contesting an election.

Try to be a Nigerian for once not a diasporic Nigerian

Oshiomole was overwhelmingly voted for but rigged out. There were protests everywhere, so much that the PDP couldn't have incurred the wrath of the people.


As for Peter Obi, he was impeached in the most controversial manner that drew the ire of everyone both within and outside Nigeria. It was a failed "coup detat"

In both cases, the PDP tried but failed woefully. If not for the doggedness of the people and the international community, both governors would have been kicked out..

But here, we have an APC governor who was overwhelmingly voted for sacked. That's the true meaning of non interference. cheesy

Please I just want to know how two courts will hear the case but gives different judgements. Is it that the court that nullifies the election in the first place didn't know about this two case points:

- ANDP did not prove valid nomination of its candidate to contend unlawful exclusion.

- Case of ANDP was statute barred having failed to file within 14days.

Nigerian judiciary is a mess.
ANDP failed to submit the name of a candidate within the stipulated time. This means they had no candidate for the said election. And if a party doesn't have a candidate for an election, INEC is duty bound to exclude the said party from the ballot.
