Well, if you read the story, you will see that the guy opened his beer parlour outside the Sabon Gari area....where he could have opened his beer parlour legally with no Hisbah disturbing him

In other words, he broke state law.

He would lose his case.

Unless it was that he opened his beer parlour in a legally designated area like the Sabon Gari area of Kano..then he might have a case.
