CREATIVES DILEMMA

Lolade is a Creative Writer . She writes books in Yoruba language . Her works are well loved in the Southern part of Nigeria . One day she is scrolling through the internet and founds out her works have been translated into English language by another publisher in the South East . She is joyful that her works are spreading and receives a simple" thank you, you are doing well' from the Publisher when she contacted him despite the fact that the translation has been done without her consent and a valid license from the appropriate authority was never issued . Unknown to lolade, her copyright has been infringed upon.

CREATIVES DILEMMA

Oke is a music producer . In 2019, he produced a smash hit track titled " Jump In" for an A list artiste in Nigeria . In 2020, a big company wanted to use the Instrumentals and composition of the song in their video games and contacted the artist he produced the song for. The artiste was paid over 20 million naira but Oke never got a Dime. The artiste claimed he had paid Oke his " production " fees and he is the sole owner of the song . Thus, he wasnt going to give Oke anything after he has bought and paid Oke fully for the song .

WHAT IS COPYRIGHT ?

" Copy" and " Right" meaning" the right to copy my work " . Copyright is one of the relevant aspects of Intellectual Property law that gives the owner of a work the exclusive right to authorise or prohibit certain uses of the works by others.

Copyright gives the creator of a work the power to determine who reproduces, uses , assigns or distributes their works. Copyright covers many works of creatives which includes Literary works like (articles , books) , music , computer programs , paintings , videos etc. Your songs , written lyrics , the computer program you developed , your sound recording on your phone can all enjoy the Benefits provided under Copyright, an aspect of Intellectual Property Law

In simpler Terms, I created something. Before you use what I created , you must seek my permission and I must have authorized the usage for you . I have the right to determine who copies or uses my work . This is the priveledge Copyright gives to creatives .

Eligibility For Copyright .

There are two major criterias for your work to be eligible for Copyright .

Originality and Accessibility .

1) Originality - it must be shown that sufficient effort has been expended by the creator in making the work to give it an original character. The work must have evolved as a result of your idea and thoughts and you must have shown sufficient skill and knowledge  you used in bringing the work to life . Originality does not mean you can not derive inspiration from another source but you cannot dub a work from another creator and claim it was your work . You must add your own distinctive spice .

2) Accessibility - The creative work must be fixed in any definite medium of expression now known or later to be developed, from which it can be perceived, reproduced or otherwise communicated either directly or with the aid of any machine or device. Simply put, an idea cannot be copyrighted . The work must be accessible and in tangible form digitally or physically .Your creative work must be in a fixed form that can be accessed for usage. A work that can not be seen or heard cannot be copyrighted.

For Recording Artistes and Record Labels , this is very important.

PR is important but Proper PR is the ultimate life source of a thriving creative career .

Artistes , Record Label and Promoters must evolve beyond traditional PR stunts and strategies to remain afloat in the ever competitive Nigerian Music industry they have found themselves in . More efforts should be directed at More participatory PR strategies rather than the stereotype “ One off Influencer” approach most seem to employ these days .

WE HAVE A MANAGER , PA , AGENT , DO WE STILL NEED AN ENTERTAINMENT LAWYER IN NIGERIA ?

Creatives and entertainment business professionals often focus their efforts on getting representation through a manager , PA or agent as they believe that having a manager or agent can take the place of having an Entertainment lawyer in Nigeria .

The truth however is legal language and clauses can be quite tricky and there are some aspects of regulations in Nigeria pertaining to the entertainment industry that a manager , PA or agent cannot properly interpret or oversee . This is the duty of an entertainment lawyer and neither the PA , manager or agent have the legal expertise or experience of an entertainment lawyer in Nigeria to oversee pertinent legal dynamics in the entertainment industry of Nigeria .

I HAVE A LAWYER , DO I STILL NEED AN ENTERTAINMENT LAWYER IN NIGERIA ?

Let’s take a look at things this way . There are general doctors , and then there are specialty doctors .

If a lady goes to a doctor and the issues discovered are significantly related to her body , she is referred to a gynecologist . This is not because the doctor does not have working knowledge of what to administer to the lady but because the gynecologist has superior knowledge and that is their area of specialization . Same goes for a man with eye problem or a sick child on consultation with a doctor , the man will be referred to an ophthalmologist who is an expert in treatment of eyes and the child to Pediatricians who is an expert in child treatment .

Only specialists can effectively and efficiently tackle the health issue discovered more than the general doctors .

Same thing goes for lawyers and entertainment lawyers in Nigeria . While Lawyers have general knowledge of the issues , Entertainment lawyers in Nigeria are the specialists in the entertainment field that can treat the issue more effectively and efficiently and it is advised they are contacted to handle all issues in the Entertainment industry for higher success rate .

SHOULD I RETAIN AN ENTERTAINMENT LAWYER IN NIGERIA?

After all , I only do one offs and I might not need the lawyer services every time ? This is the mindset of some creatives and Entertainment business professionals in Nigeria.

The big question is , would you rather have a family doctor that attends to all your issues within a budget agreed upon or would you prefer to pay a doctor every-time you have a medical issue regardless of the fluctuations in prices or medical services or drugs ?

Prevention they say is better than cure . Entertainment lawyers in Nigeria are not only needed when disputes or issues arise. Entertainment lawyers are in-fact retained so that issues don’t arise . They give proper legal advise and help you negotiate properly to prevent avoidable issues .

Having an entertainment lawyer in Nigeria on retainer is beneficial to creatives and entertainment entities because

a) it reduces the cost of the legal services on the client
b) enables faster dispensation of services
c) quicker access to the attorney
d) access to the client’s network of creatives and entertainment business professionals
e) proper communication of issues between parties as client is treated as priority .

Among other numerous benefits

HOW MUCH DO ENTERTAINMENT LAWYERS BILL ?

Depending on the services you need , the bill for legal services from Entertainment lawyers in Nigeria is quite affordable And flexible . Going for retainer-ship with an entertainment lawyer in Nigeria is however advised has it is more cost effective and efficient .
