*What is wrong with 1999 constitution?*

"One of the biggest misconceptions is this idea that the 1999 constitution was written by the military. Not True! No single military man was in the constitution drafting committee of 1975/1997 and the CA in 1977. Infact, the 1999 constitution was a replica of the 1979 constitution.

The 1999 Constitution was drafted by a Constitution Debate Co-ordinating Committee headed by Justice Niki Tobi, with Dr. Suleiman Kurmo as deputy. They went round the country collecting memoranda through town hall meetings in Benin, Enugu, Jos, Phc, Kaduna, Kano, Ibadan, Lagos.

...Sokoto. They excluded military formations. After all the debates, the Chairman Tobi said, “In the light of the memoranda and the oral presentation on the 1995 Draft Constitution, it's clear that Nigerians basically opt for the 1979 Constitution with relevant amendments.

They want it, and they've copiously given their reasons for their choice in the different memoranda and oral presentations. So we've recommended the adoption of the 1979 Constitution with relevant amendments from the 1995 Draft Constitution.” Abdulsalami accepted the recommendation.

It's important to unpack this statement. Tobi was saying that based on oral & written submissions, Nigerians preferred the 1979 constitution but with a few amendments extracted from Abacha's jettisoned 1995 draft constitution. Let's look at how the 1979 constitution was drafted...

In 1975, Gen Murtala Muhammed set up the constitution drafting committee headed by eminent jurist FRA Williams. The report of the committee formed the basis for discussions at the 1977 Constituent Assembly chaired by Justice Udo Udoma and had people like MKO Abiola, Bola Ige,Abraham Adesanya, Bisi Onabanjo among the 232 members.

This 1977 CA gave us the 1979 constitution. This is the document the 1999 constitution was based ALMOST WORD FOR WORD. None of the characters involved in the drafting committee or CA in 1975-77 and 1998-99 were military.

According to Simon Kolawole, the 1999 constitution is "pure plagiarism of the 1979 constitution". Exactly as Niki Tobi told us. The only differences were; the 13% derivation, the number of states in the federation (19 States in 1979 & 36 in 1999) and changing of FEDECO to INEC.

Like Simon Kolawole said "The 1999 constitution was NOT written by the military. I also hasten to say that nobody can write a perfect constitution. Even if Prof. Ben Nwabueze, a well-respected constitutional expert, writes a new constitution today, loopholes will surface in a...

Hopefully all those yelling "the constitution is bad, the constitution is wrong, the constitution must be amended", can now post what's wrong with the constitution and suggest amendments.

What a joke

Abacha who was trying to transition from a dictator to a life President also picked some of the worst criminals to represent constituents to give useless Constitution that Abdulsalam passed down to OBJ

..... Goodluck Jonathan also organised a National Confab for constitution amendment picking utterly shady people and setting topics of discussion because of mere 12 million allowance,

So what is wrong you ask

1: Immunity from Prosecution of President, Vice President, Governors and Deputy (they can kill and you must have to wait for their tenures to expire before filing a case)

2: Immuinity in the National Assembly complex for all lawmakers

3: Non accounted non audited Security votes of 100s of million for President, Vice President , Governors and Deputy

4: unaudited on accounted "running cost" for almost all political office holders and senior public servants

5: Age bracket for different political offices, even when you give a 18 years old a riffle in the army to fight war yet he isn't fit to contest

2. If you are not being paranoid you will see 6 states in South South as not been putting food on anybodies table. Does your state get its due allocation or not?
3. Exclusive list is neutral. Good when you have a good leader, Bad when you have a bad leader. And so is every law.
4. You have a point here but no constitution can perfect Nigeria map.

Our problem is not in the constitution but with the people wielding it. The earlier we all realise this the better.

For any constitution to be legal it must be backed by a referendum, besides the military altered what was agreed by the constitutional drafting committee. That constitution is a big scam in that it stated that Nigeria is a federal state, which is a big lie, instead of a unitary state.

There has to be a referendum to adopt a constitution. When our fathers agreed to form a country by bring the 3 regions, this was not the constitution that was agreed on. There's no way we would agree on a unitary system, quota system, no resource control, president elected with primary school leaving certificate! No!

99 constitution don’t represent indigenous Nigerians

Is a military approved designed to intimidate and manipulate.

Let the indigenous people of Nigeria come together and agree on how to live.

Everything in the constitution is trash..

From we the people of Nigeria .... and we no say no be we the people ... but northerners and their military comrades.

That's the main issue simple

The fathers tried their best, but they also started the chain reaction that brought us here.

If the 1999 constitution is our problem, and 60s constitution was perfect then there should not have been ethic violence and the military unrest.

1999 constitution is not good in anyway the thing isn't friendly at all capital punishment supposed to added to it in case of this politicians. Imagine a sorry state southeast found themselves now.
