If the cctv is suppose to be on motion i think it should be moving from left angle to right angle. You can ask a cctv specialist about this.

The fact that, someone was behind the CCTV actively recording it makes it even more legit....ordinary, that person's witness alone is enough to nail him and on top of that, the person had it on video.

Even if the video was planted, pre-setup, premeditatedly placed there for the sole purpose of catching him in the very act; that does not make that evidence lack legitimacy, unless you want to state and prove that, it was the presence of the video that influenced or pushed him to commit the act.

FYI: All video evidence are pre-setup, in fact, people tilt the camera to the exact spot they believe the activity they want to capture takes place and they do it premeditatedly and well in advance of the activity taking place.....otherwise, it will not be on video.
